HomeMy WebLinkAbout20031204Order No 29392.pdfOffice of the Secretary Service Date December 4, 2003 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION IN THE MATTER OF DETERMINING PRICES FOR UNBUNDLED NETWORK ELEMENTS (UNE) IN QWEST CORPORATION'S STATEMENT OF GENERALLY AVAILABLE TERMS (SGAT). CASE NO. QWE-Ol- ORDER NO. 29392 On November 12, 2003 , Qwest Corporation filed a Motion to Withdraw and Substitute Testimony in this case. The Commission opened this case in June 2001 , and issued a Procedural Order approving a process to establish prices for Qwest's unbundled network elements (UNEs). The procedure established by the Commission called for workshops to facilitate discussions and, if possible, agreement by the parties on rates for specific UNEs. When the case was opened, Qwest filed direct testimony of its witnesses to establish the foundation for the discussion of Qwest's proposed UNE prices and its cost model results. An initial workshop convened on June 23, 2001. Qwest states in its Motion to Withdraw and Substitute Testimony that, as a result of the procedure approved by the Commission, Qwest and the Commission Staff were able to identify numerous UNE prices that are not controversial. Qwest's Motion states that its initial testimony and, to a lesser extent, some of Qwest's cost studies and models have become stale. Qwest asserts that it agreed to withdraw all of its previously submitted testimony, exhibits and cost studies and replace them with simplified and updated versions submitted with Qwest' Motion. According to Qwest , " providing the most current version all of Qwest's advocacy on UNE and interconnection costs will assist the Commission and any interested parties as they participate in the remaining phases ofthis case." Qwest asked the Commission to enter an Order allowing the Company to withdraw all of its previously filed testimony, exhibits and other costs submissions and replace them with new testimony and exhibits of Teresa K. Million and Dick Buckley filed with the Motion. The Commission has determined to approve Qwest's Motion to Withdraw its previously filed testimony and replace it with the testimony submitted with its Motion. Accordingly, the Commission issues this Order approving Qwest's Motion , and directing that the testimony, exhibits and cost studies initially filed by Qwest in this case are withdrawn, and are ORDER NO. 29392 replaced with the direct testimony of Teresa K. Million and Dick Buckley, along with the exhibits to their testimony. ORDER IT IS HEREBY ORDERED that the Motion to Withdraw and Substitute Testimony filed by Qwest is approved. The testimony, exhibits and cost studies initially submitted by Qwest in this case are withdrawn, and are replaced with the direct and supplemental testimony of Teresa K. Million, including exhibits, and the direct testimony of Dick Buckley, and exhibits.
