NOTICE OF A PROCEEDING TO ESTABLISH UNE PRICES FOR QWEST CORPORATION
NOTICE OF PROCEDURAL SCHEDULE AND RIGHT TO INTERVENE

On April 9, 2001, Qwest Corporation filed in Case No. USW-T-00-15 a Motion for a Procedural Order asking the Commission to adopt Qwest’s proposed schedule “for the determination of Qwest’s forward looking costs to be used in setting the prices for the elements and services contained in Qwest’s Statement of Generally Available Terms (SGAT).” Case No. USW-T-00-15 was initiated on June 10, 2000, when Qwest filed its SGAT pursuant to Section 252(f) of the Telecommunications Act of 1996, 47 U.S.C. § 252(f). Qwest’s SGAT sets forth the terms and conditions for interconnection, access to unbundled network elements, ancillary services, and resale of Qwest’s telecommunication services. However, the SGAT as filed did not contain prices for Qwest’s unbundled network elements (UNEs).
On June 1, 2001, Qwest filed an Amended Motion for Procedural Order asking the Commission to approve a schedule “reflecting a more informal and open approach to the task of determining the Total Element Long-Run Incremental Costs (TELRIC) of Qwest’s unbundled network elements.” Qwest’s Motion requests approval of a series of informal workshops to precede the preparation and filing of formal evidence. Qwest represents that it will explain and provide assistance for the use of its cost model – the Integrated Cost Model – and will provide information about the inputs used to produce its results, show the effect of using alternative inputs and provide information about the models and inputs used, as well as the results adopted, in other jurisdictions. Qwest also represents that it will in the workshops provide results from the HAI model if requested for comparison purposes. Following the workshops, Qwest proposes that the case move to a more formal schedule that provides for the filing of direct and rebuttal testimony and an evidentiary hearing.
Qwest’s Amended Motion states that it does not “intend to seek price changes for those UNEs whose prices were previously set, using TELRIC in the AT&T arbitration case, Case Nos. USW-T-96-15/ATT-T-96-2, Order No. 27050.” Instead, “Qwest will ask that the Commission accept those previously arbitrated prices to be Qwest’s permanent prices for those services.” Amended Motion, p. 2.
YOU ARE HEREBY NOTIFIED that the Commission has determined to initiate this proceeding to establish UNE prices for Qwest Corporation. The Commission has determined to proceed as proposed by Qwest in its Amended Motion and will schedule informal workshops for interested parties to participate in the determination of prices for Qwest’s UNEs.
YOU ARE FURTHER NOTIFIED that persons desiring to intervene in this matter for the purpose of presenting evidence or cross-examining witnesses at hearing must file a Petition to Intervene with the Commission pursuant to this Commission’s Rules of Procedure 72 and 73, IDAPA 31.01.01.072 and -.073. Persons intending to participate at the hearing must file a Petition to Intervene on or before June 26, 2001. Persons desiring to present their views without parties’ rights of participation and cross-examination are not required to intervene and may present their comments without prior notification to the Commission or the parties.
YOU ARE FURTHER NOTIFIED that all hearings will be conducted pursuant to the Rules of Procedure adopted by the Idaho Public Utilities Commission. IDAPA 31.01.01.000 et seq.
YOU ARE FURTHER NOTIFIED that the Commission will schedule three workshops to allow the parties an opportunity to participate in the determination of Qwest’s UNE costs. The first workshop is scheduled for July 23, 2001, at 9:30 a.m. During the first workshop, the parties should discuss the possible use of those UNE prices that were set in Case Nos. USW-T-96-15 and ATT-T-96-2, which was an arbitration between Qwest and AT&T. The Commission will convene at least two other workshops to be completed no later than August 31, 2001, and will issue notice of the workshops when the dates are finally settled.

February 2002 Qwest files and serves its cost studies and explanatory testimony and exhibits.
Workshop One convenes in the Commission Hearing Room at 9:30 a.m.
Workshops are completed.
Qwest files direct testimony, including any modifications to cost studies and agreements reached by the parties during the workshop process.
Staff and Intervenors file direct testimony.
Qwest files rebuttal testimony.
All discovery is completed.
The Commission will convene a hearing or a prehearing conference in February 2002 and will issue a notice of the specific hearing dates.
O R D E R
IT IS HEREBY ORDERED that the Commission, in response to Qwest’s Amended Motion, initiates this proceeding to determine the prices for unbundled network elements in Qwest Corporation’s Statement of Generally Available Terms. In order to expedite the discovery process the Commission also directs that all discovery responses shall be provided within 21 days of receipt of the discovery request.
