PRJ- T -09- On October 21 2009, Project Mutual Telephone ("PMT") filed a Petition requesting a state waiver of certain Federal Communications Commission ("FCC") numbering resource guidelines following denial of its Application filed with NeuStar, the North American Numbering Plan Administrator ("NANP A" THE PETITION According to its Application, PMT's customer , S1. Luke s Magic Valley Medical Center ("S1. Luke ) in Twin Falls, Idaho, requires 10 sequential blocks of numbers (i., ten blocks of 1 000 numbers) so as to ensure all phases of its health facility will have the same prefix and be sequential and fit into S1. Luke s dial plan. S1. Luke s needs these numbers as soon as possible, and will begin using them as soon as the request for waiver is approved and the numbers are released for service. S1. Luke s plans to return 2 200 of its existing numbers once the new numbers are put into service. On September 15 , 2009, PMT submitted an automated worksheet to NeuStar via its online system to obtain numbering resources necessary to meet S1. Luke s demands. PMT's application was denied due to a failure to adequately comply with the "months to exhaust" (MTE) and/or utilization requirements. To be assigned a full code and meet S1. Luke s needs PMT was instructed to request a state waiver. STAFF RECOMMENDATION Staff thoroughly reviewed PMT's request for a state waiver of FCC numbering resource guidelines. Staff noted that S1. Luke s is a single entity asserting a need for numbers as a result of an expansion in its business facility. The numbers will be held solely by S1. Luke and will enable PMT to meet the health facility s demand for sequential numbers in Twin Falls. PMT participates in the 1 000-block pooling in the Twin Falls rate center. Methods such as pooling and rate center consolidation help make number conservation efforts more ORDER NO. 30947 effective and are designed to extend the time it takes to exhaust a rate center s number resources. According to FCC orders and numbering guidelines, carriers may appeal NANP A decisions of this nature to the appropriate state regulatory authority. Finally, Staff noted that the Commission has granted similar waivers in the past to meet the requests of larger customers. See Order Nos. 28769, 29279, 30351 and 30427. Staff concluded that granting the requested waiver would result in an efficient use of Idaho numbering resources. DISCUSSION AND FINDINGS After reviewing PMT's Petition and Staff s recommendation , the Commission finds that PMT's Petition requesting a state waiver of FCC numbering resource guidelines should be granted. It appears that the requested number assignment is necessary to enable PMT to meet the needs of its customer, St. Luke s. Granting the request will facilitate St. Luke s business expansion. Finally, because PMT participates in number pooling, unused 1 000-blocks will be returned to the NANPA. As noted by Staff, S1. Luke s has pledged to return 2 200 of its existing numbers once the new numbers are put into service. Consequently, we find that it is reasonable to direct that NeuStar provide the new number assignment requested by PMT. The Commission directs further that any unused I ,OOO-blocks be returned to the NANP A within six months. ORDER IT IS HEREBY ORDERED that Project Mutual Telephone s Petition requesting a state waiver of FCC numbering resource guidelines is approved. IT IS FURTHER ORDERED that NeuStar assign 10 sequential numbering blocks to Project Mutual Telephone so that the Company may assign the numbers to its customer, S1. Luke , and that any 1 000-blocks not used by S1. Luke s within six months after they are assigned be promptly returned to NeuStar. THIS IS A FINAL ORDER. Any person interested in this Order may petition for reconsideration within twenty-one (21) days of the service date of this Order. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code ~ 61-626.
