IDAHO PUBLIC UTILITIES COMMISSION
MINUTES OF DECISION MEETING
May 21, 2018 – 1:30 P.M.
In attendance were CommissionersPaul Kjellander Kris Raper and Eric Anderson. Commissioner Kjellandercalled the meeting to order.
The first order of business was APPROVAL OF MINUTES FROM PREVIOUS MEETING on Tuesday, May 9, 2018. The Commission voted unanimously to approve the minutes as written.
The second order of business was MATTERS IN PROGRESS:
2. Action Item: Edward Jewell’s May 3, 2019, Decision Memorandum re: In the Matter of Idaho Power’s Application to Evaluate Schedule 84-Net Metering; Case No. IPC-E-19-15.
Mr. Jewell reviewed his Decision Memo and stated; on April 5, 2019 Idaho Power filed an application requesting the Commission temporarily suspend Schedule 84 for new applicants and initiate a collaborative process to explore modification to compensation structure and excess energy value applied under Schedule 84.
April 18, 2018, the Commission issued a Notice of Application of Procedural Comment Deadline that deadline passed on May 2; a number of parties filed Comments that are before you now. There were six questions that were to be answered by the Commission; how would the Commission like to process this case.
Commissioner Raper moved that; the Commission establish a two week intervention time frame for the IPC-E-19-15 docket, encourage the parties to get together and establish a proposed schedule for the Commissioners to considered that would also include some settlement time frames involved and include within the motion that we not suspend Schedule 84 to new customers,but that we do suspend the January 1, 2020 effective date of any changes.
The next order of business was RULEMAKING:
3. Action Item: Notice of Omnibus Rulemaking –Temporary and Proposed Rulemaking for IDAPA 31, Rules of the Public Utilities Commission.
Mr. Goodson reviewed his Decision Memo and stated; the Legislature adopted Idaho Code 67-5292 which states in part that rules shall automatically expire July 1 the following year unless the rule is extended by statue. This year the Legislature did not extend all Administrative Rules as it has done in the past. This year the Governor Little has directed Division of Financial Management (DFM) and all state agencies with Idaho Administrative Procedure Act rules to exercise necessary executive authority to minimize the impact on state agencies, and the public.If the Commission does not reauthorize the rules they will expire on July 1, 2019.
Under the direction of the Commission the Staff has reviewed the existing rules. Staff recommends that all existing rules of the Commission be adopted with the exception of rule 31.51.02, Automatic Dialing and Announcement Devices, these rules are antiquated and are longer necessary due to Federal Communication supersedes the current rule set.
Commissioner Raper moved that; the Commission approve Staffs recommendation and submit the corresponding notices of Omnibus Rulemakingto DFMwith the correction that Mr. Goodson stated that any written comments be submitted to our Commission Secretary, Diane Hanian.
The next order of business was FULLY SUBMITTED MATTERS:
4. Deliberation re: Petition for Reconsideration in the Matter of the Investigation of Atlanta Power Company Service and Customer Relations; Case No. ATL-E-18-01. [Edward Jewell, Attorney]
Commissioner Kjellander stated that items 4 under Fully Submitted Matters would be deliberated privately.
Commissioner Kjellander stated, there was no further business before the Commission and he adjourned the meeting.
