HomeMy WebLinkAbout20130619final_order_no_32832.pdfOffice of the Secretary Service Date June 19,2013 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION IN THE MATTER OF POTLATCH ) TELEPHONE COMPANY DBA TDS )CASE NO.POT-T-13-02 TELECOM’S PETITION FOR A WAIVER OF ) FCC THRESHOLD REQUIREMENTS FOR ) NUMBERING RESOURCES FOR )ORDER NO.32832 KENDRICK,IDAHO ) On June 10.2013,Potlatch Telephone Company dba TDS Telecom (TDS)filed a Petition with the Commission requesting a waiver of Federal Communications Commission threshold requirements for numbering resources in the Kendrick,Idaho service area.TDS is installing a new switch in its Kendrick,Idaho office and requires one unique NPA-NXX that contains 10,000 numbers and a location routing number (LRN).An LRN is assigned to identify the switch and allow for porting numbers.TDS is requesting to be assigned all 10 blocks within the new NPA-NXX with a provision that TDS will protect the numbers from permanent customer assignment.After TDS has migrated all its customers to the new switch,TDS will remove the old switch from the network and migrate the existing NPA-NXX and LRN to the new switch.TDS has committed to return the entire new code of numbers that it is requesting within 12 months of removal of the old switch. On May 30,2013,TDS submitted a code request for an LRN to NeuStar,the number pooling administrator.The administrator denied the request because TDS did not meet the months to exhaust or utilization criteria established by the FCC.Federal regulations allow a carrier to appeal a decision by the pooling administrator to withhold numbering resources to the appropriate state commission.The Commission may overturn the administrator’s decision on a determination that the carrier has demonstrated a verifiable need for numbering resources and has exhausted all other available remedies.See 47 U.S.C.§52.15(g)(3)and (4). Staff reviewed TDS’s request and recommended the Commission approve it.After reviewing the Application and Staff’s recommendation,the Commission finds it appropriate to approve the waiver request filed by TDS.The requested number assignment is necessary for TDS to install its new switch,and will not affect numbering resources because TDS plans to return the block of numbers once the new switch is installed.Accordingly,the Commission ORDER NO.32832 1 finds it reasonable to direct that NeuStar release the NPA-NXX block to TDS to enable TDS to install its new switch to serve its customers. ORDER IT IS HEREBY ORDERED that Potlatch Telephone Company dba TDS Telecom’s request for a waiver of the FCC’s numbering resource requirements is approved. THIS IS A FINAL ORDER.Any person interested in this Order may petition for reconsideration within twenty-one (21)days of the service date of this Order.Within seven (7) days after any person has petitioned for reconsideration,any other person may cross-petition for reconsideration.See Idaho Code §6 1-626.
