FOR A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY TO PROVIDE LOCAL EXCHANGE TELECOMMUNICATIONS SERVICES. ) ) ) ) ) ) ) ) CASE NO. PCS-T-98-1 ORDER NO. 28080 On July 20, 1998, Preferred Carrier Services, Inc. (PCS) filed an Application for a Certificate of Public Convenience and Necessity to provide competitive local exchange services within the state of Idaho. PCS is a Texas corporation and a wholly-owned subsidiary of Phones for All, a Delaware corporation. The Company proposes to resell local exchange service to residential and business customers in the U S WEST and GTE service areas. PCS currently provides local exchange service in four states. On May 19, 1999, the Commission issued a Notice of Application and Notice of Modified Procedure. During the period for the filing of written comments, only the Commission Staff filed comments. Staff’s comments indicate that when Staff expressed an interest in the Company providing a surety or performance bond, PCS proposed a $15,000 cash bond accompanied by quarterly reports to record any deposits or disbursements from the bond account. Staff recommended approval of PCS’s Application subject to the posting of a $15,000 cash bond as proposed by the Company. COMMISSION FINDINGS Based on our review of the record, including the filed written comments and Staff’s recommendation, we find that the Application of Preferred Carrier Services, Inc., complies with Procedural Order No. 26665 and the Commission’s Rules to obtain a Certificate of Public Convenience and Necessity. We find that PCS should provide a $15,000 cash bond and file quarterly reports of deposits to and disbursements from the bond account. We therefore approve PCS’s Application for a Certificate to provide local exchange telecommunications service within Idaho, subject to the posting by PCS of a $15,000 cash bond. O R D E R IT IS HEREBY ORDERED that Preferred Carrier Services, Inc. is granted a Certificate of Public Convenience and Necessity to provide local telecommunications services within Idaho, subject to the posting of a $15,000 cash bond. PCS shall provide quarterly reports of any deposits or disbursements from the bond account. THIS IS A FINAL ORDER. Any person interested in this Order may petition for reconsideration within twenty-one (21) days of the service date of this Order. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code § 61626.
