The terms and conditions of the local telephone company will apply to payment arrangements. Carrier or Company - Whenever used in this tariff , " Carrier" or "Company" refers to Operator Service Company unless otherwise specified or clearly indicated by the context. Commercial Credit Card Call - A billing arrangement by which a call may be charged to an authorized credit card number, such as MasterCard or VISA. Customer or End User - The calling party using the services of Osc. The end user is responsible for the payment of charges, unless that responsibility has been accepted by others, such as in the case of collect or third party calls. Holidays - The Company recognizes the following holidays: New Year s Day, Independence Day, Labor Day, Thanksgiving Day, and Christmas Day. LATA - Local Access Transport Area (LATA) denotes a geographical area established by the U.S. District Court within which a local exchange company provides communications services. Operator Station - A call that requires live or automated operator assistance. Operator station calls may be billed to the called party (collect) or to a valid third party telephone number. Pay Telephone - A telephone instrument equipped with a device that allows a charge to be made for each call. Person-to-Person Call - A service whereby the person originating the call specifies to the Company Operator a particular person to be reached, or a particular station, room number, department, or office to be reached through a PBX attendant. Service Wire Center - A specified geographic point from which the vertical (V") and (") horizontal coordinates are used to calculate airline mileage for the purposes of rating a call. Subscriber - The person, firm, partnership, corporation, or other entity who owns, leases, or manages the pay telephone, PBX, or other switch vehicle from which a Customer places a call utilizing the services of the Company. The Subscriber has a pre-existing business arrangement with the Company. Service is provided twenty-four (24) hours per day, seven (7) days per week. Limitations Service will be furnished subject to the availability of the necessary facilities and/or equipment and subject to the provisions of this tariff. The Company reserves the right to discontinue furnishing service, upon written notice, when necessitated by conditions beyond its control, or when the Customer is using the service in violation of the provisions ofthis tariff, or in violation oflaw. The Company does not undertake to transmit messages, but offers the use of its facilities when available, and will not be liable for errors in transmission or for failure to establish connections. 2.4 The Company reserves the right to discontinue the offering of service or deny an application for service if a change in regulation materially and negatively impacts the financial viability of the service in the best business judgment of the Company. All services and resold facilities provided under this tariff are directly or indirectly controlled by the Company and the Subscriber may not transfer or assign the use of service or facilities without the express written consent of the Company. Such transfer or assignment shall only apply where there is no interruption of the use or location of the service or facilities. Prior written permission from the Company is required before any assignment or transfer. All regulations and conditions contained in this tariff shall apply to all such permitted assignees or transferees, as well as all conditions of service. Services provided under this tariff may be used for any lawful purpose for which the service is technically suited. Payment for Service All charges due by the Customer are payable to the Company or to any agency duly authorized to receive such payments. The billing agency may be a local exchange telephone company, credit card company, or other billing service. Terms of payment shall be according to the rules and regulatory agencies, such as the Idaho PUC. Any objections to billed charges must be promptly reported to the Company s billing agent. Adjustments to Customer s bills shall be made to the extent that circumstances exist which reasonably indicate that such changes are appropriate. The Company may require advance payments equal to one week's estimated charges. Payment periods may vary by product. Where service is provided by OSC to a Customer for the purposes of resale, the Company s Customer is responsible for collection and payment of all taxes. Other Rules The Company reserves the right to refuse Third Party billing at its discretion. 6.2 The Company reserves the right to refuse to process Credit Card or Calling Card billed calls when authorization for use f the card cannot be validated. The company reserves the right to discontinue service, limit service, or to impose requirements on Subscribers as required to meet changing regulatory rules and standards of the Idaho Public Utilities Commission. Timing of each call begins when the Company s switch receives the call and ends when either the called or calling party hangs up. 1.2 Call measurement and rounding increments for billing purposes are specified for each product of the rate section of this price list. 1.3 There will be not billing applied for incomplete calls. Time of Day Rate Periods The following time of day rate periods apply to End User calls unless otherwise specified in this tariff. Daytime - 8:00 AM up to but not including 5 :00 PM Monday through Friday. Evening - 5 :00 PM up to but not including 11 :00 PM Sunday through Friday. Night - 11 :00 PM up to but not including 8 :00 AM every day, all day Saturday, and from 8 :00 AM up to but not including 5 :00 PM on Sundays. The distance between the Wire Center of the Customer s equipment and that of the destination point is calculated by using the "V" and "H" coordinates in the following manner: Step I - Obtain the "V" and "H" coordinates for the Wire Centers serving the Customer and the destination point. Step 2 - Obtain the difference between the "V" coordinates of each of the Wire Centers. Obtain the Difference between the "H" coordinates. Step 3 - Square the differences obtained in Step 2. Step 4 - Add the squares of the "V" difference and "H" difference obtained in Step 3. Step 5 - Divide the sum of the square obtained in Step 4 by ten (10). Round to the next higher whole number if any fraction results from the division. Step 6 - Obtain the square root of the whole number obtained in Step 5. Round to the next higher whole number if any fraction is obtained. This is the distance between the Wire Centers. Calls are routed via the company s Operator Services Center to any valid NP A-NXX in the state ofIdaho by the Company s switch and the transmission facilities ofOSC's underlying carrieres). OSC Long Distance Service is provided for use by transient end users at host locations. This service anticipates the provision of Operator Services or billing options. Calls are measured as described in Sections 3.1 and 3.3 of this tariff and rated based on time of day, call duration, call type and mileage. Various rate plans are available one of which is selected by each Subscriber. The holiday rate discount applies to company recognized holidays. Time of Day and Holiday Discounts do not apply to the per-call operator service charges. Per-minute usage sensitive charges, as well as per-call operator service charges, and location surcharges apply. In those instances in which the Customer places a jurisdictionally local call using this service by dialing the long distance access method described above, the call will be carried by the Company and charged at the rates listed below in 4.3 and according to the terms and conditions of this tariff. Pay Telephone Subscriber Service This service is available to call aggregators (pay telephone providers, hotels, universities, etc.) who also subscribe to OSC's operator assisted services. To qualify for this service , Customers must have a current OSC 0+ communications service agreement and each location must handle three or more 0+ calls a week. This service is made available for the direct transmission (1 +) of telephone calls. Rates vary based on the number of active aggregator locations subscribed to OSC's service by the Customer. U sage is billed in six (6) second increments after an initial minimum period of (1) minute. A per minute Directory Assistance Call Completion rate applies for the duration of each completed call. This per minute usage rate is in addition to the charge for determining the telephone number requested by the Customer. OSC Directory Assistance Call Completion is available for use with Station to Station calls. Directory Assistance Call Completion may not be used in conjunction with operator assisted calling. For billing purposes, calls are billed in six (6) second increments after an initial billing increment of one (1) minute. This charge is in addition to applicable usage and per call service charges. The Non-Subscriber Surcharge does not apply to calling card calls, intraLATA calls conference calls, calls to Directory Assistance, toll-free or 900 telephone numbers, Ship-to-Shore service or Telecommunications Relay Service, calls originated from cellular phones; Customers with disabilities and calls billed to all lines which have discontinued pre subscription to the Company but for whom an active billing record still exists in the Company s billing system.
