HomeMy WebLinkAbout20151217final_order_no_33438.pdfOffice of the Secretary Service Date December 17,2015 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION IN TUE MATTER OF ORBITCOM,INC.’S ) REQUEST FOR CANCELLATION OF ITS )CASE NOS.ORB-T-03-01 CERTIFICATE OF PUBLIC CONVENIENCE AND )ORB-T-08-01 NECESSITY NO.430 ) ____________________________________) ORDER NO.33438 On September 8,2015,OrbitCom,Inc.filed a request to cancel its Certificate of Public Convenience and Necessity (CPCN or Certificate)No.430.On April 27,2015,OrbitCom and lonex Communications North,Inc.dba Birch Communications filed an application with the Federal Communications Commission (FCC)to transfer all OrbitCom assets and customers to lonex.On June 5,2015,the FCC approved the transfer.In its Decision Meeting on December 14,2015,this Commission addressed OrbitCom’s request for cancellation of Certificate No.430. COMMISSION FINDINGS In November 2003,OrbitCom,Inc.filed an application for authority to provide local exchange and interexchange telecommunications services in Idaho.In June 2004,the Commission granted OrbitCom’s application for a Certificate.Order No.29516.In October 2008,OrbitCom requested that its CPCN be amended to operate in northern Idaho as OneEighty Networks,which the Commission granted.Order No.30666. On September 8,2015,OrbitCom requested the Commission cancel its Certificate and stated the transfer of all assets and customers to Jonex Communications North,Inc.dba Birch Communications was complete.Based upon this request,the Commission cancels Certificate No. 430 and directs Staff to remove the Company’s price list or tariff on file. ORDER IT IS HEREBY ORDERED that OrbitCom,Inc.’s request for cancellation of its Certificate of Public Convenience and Necessity No.430 is granted.Certificate No.430 is no longer in effect,and OrbitCom is no longer authorized to provide telecommunications services in the State of Idaho. THIS IS A FINAL ORDER.Any person interested in this Order or in interlocutory Orders previously issued in this case may petition for reconsideration within twenty-one (21)days of the service date of this Order with regard to any matter decided in this Order or in interlocutory ORDER NO.33438 1 Orders previously issued in this case.Within seven (7)days after any person has petitioned for reconsideration.any other person may cross-petition for reconsideration.See Idaho code §§62-619 and 6 1-626.
