O1C-T-99-1 On November 5, 1999, O1 Communications of Idaho, LLC filed an Application requesting that the Commission issue it a Certificate of Public Convenience and Necessity. The Company sought authority to provide both facilities-based and resold basic local exchange services to customers currently served by U S WEST, GTE, and Citizens Telecommunications. Following receipt of the Application, Staff began an examination of the Application and requested that the Company provide additional materials. On March 7, 2000, the Company’s general counsel forwarded a letter to the Commission Staff stating that O1 “wishes to withdraw its Application for a Certificate of Public Convenience and Necessity to provide basic local exchange telecommunications service in the State of Idaho.” Procedural Rules 67 allows a party to withdraw a pleading upon notice to the Commission. IDAPA 31.01.01.067. The Staff recommends that the Company’s request to withdraw its Application be granted. Because no Notice was issued in this case, Staff recommends that a Minute Entry be prepared documenting for the record that the Application has been withdrawn.
