Sheets are numbered sequentially. When a new sheet is added between sheets already in effect / a decimal isadded. For example / a new sheet added between sheets 14 and would be 14. B. Sheet Revision Numbers - Revision numbers also appear in the upper right corner of each page. These numbers are used to determine the most current sheet version on file with the IPUC. Authorized User - A person/ firm , corporation, or any other entity authorized by the Customer to communicate utilizing the Carrier'service. Available Usage Balance - The amount of usage remaining in a Debit (N) Account at any particular point in time. Each Debit Account begins wi th an initial usage amount which is depleted as services provided by the Company are utilized by the Customer. (N) Customer - The person/ firm , corporation or other entity which orders / cancels / amends or uses service and is responsible for payment of charges and compliance with the Company's tariff. Company or Carrier North American Telephone Network, unless otherwise clearly indicated by the context. Commission - The Idaho Public Utilities Commission. Debit Account - An account which consists of a pre-paid usage (N) balance depleted on a real time basis during each Debit Service Call. Debit Card - A card issued by the Company which provides the Customer with a Personal Account Code and instructions foraccessing the Carrier's network. Debit Service Call - A service accessed via a Toll Free (i. "1-800/1-888") number or other access code dialing sequence whereby the Customer or Authorized User dials all of the digits necessary to route a call. Network usage for each call is deducted from the available usage balance on a Company-issued Debit Account.(N) Dedicated Access - See Special Access Origination/Termination. NATN - Used in this tariff to refer to North American Telephone Network , L.C. unless clearly indicated by the text. Personal Account Code - A pre-defined series of numbers to be (N)dialed by the Customer or Authorized User upon access to theCarrier's network which identifies the Debit Account from which charges for service shall be debited and which validates thecaller's authorization to use the services provided. Renewal - A method of replenishing a Debit Account's Available Usage Balance with additional minutes of use as authorized and paid for by the Customer. Retailer person or other legal entity who contracts todistribute services of the Company at terms and condi tionsspecified in this tariff. (N) Special Access Origination/Termination - Where access between the customer and the interexchange carrier is provided on dedicatedcircuits. The cost of these dedicated circuits is billed by the access provider directly to the end user. Subscriber - The person / firm or corporation / or other entity which orders / cancels / amends / or uses service / and authorizes NATN to pre subscribe the service to NATN' s network. Switched Access - Where access between the Customer and the Carrier is provided on local exchange company circuits capable of accessing the local switched network. The cost of switched Feature Group access is billed to the Carrier. Terminal Equipment - Devices / apparatus / and associated wiring such as teleprinters / telephones / or data sets. V & H Coordinates - Geographic points which define the originating and terminating points of a call in mathematical terms so that the airline mileage of the call may be determined. NATN'services and facilities are furnished for communications originating at specified points within the state of Idaho under terms of this price list. NATN installs / operates / and maintains the communications services provided hereinunder in accordance with the terms and condi tions set forth under this price list. NATN may act as the Customer's agent for ordering access connection facilities provided by other carriers or entities, when authorized by the Customer / to allow connection of a Customer's location to the NATN network. The Customer shall be responsible for all charges due for such service arrangement. The Company'services and facilities are provided on a monthly basis unless otherwise provided, and are available twenty-four hours per day / seven days per week. Limitations presubscribed service is offered in Equal Access areas only. Service is offered subject to the availability ofthe necessary facilities and equipment, or bothfacilities and equipment, and subject to the provisions of this price list. NATN reserves the right to discontinue or limit service when necessitated by conditions beyond itscontrol/or when the Customer is using service in violation of provisions of this price list / or in violation of the law. The Company does not undertake to transmi t messages/ but offers the use of its facilities when available, and will not be liable for errors in transmission or for fail ure to establish connections. Limi tations, con t . '2.Use All facilities provided under this price list are directly or indirectly controlled by North American Telephone Network / LLC. and the Customer may not transfer or assign the use of service or facilitieswithout the express written consent of theCompany. Such transfer or assignment shall only apply where there is no interruption of the use or location of the service or facilities. Prior wri tten permission from the Company isrequired before any assignment or transfer. All regulations and conditions contained in this price list shall apply to all such permitted assignees or transferees / as well as all conditions of service. Services provided under this price list may be used for any lawful purpose for which the service is technically suited. Liabilities of the Company NATN'liabili ty for damages arising out mistakes / interruptions / omissions / delays / errors /or defects in transmission which occur in the course of furnishing service or facilities, in no event shall exceed an amount equivalent to the proportionate charge to the Customer for the period during which the faults in transmission occur. The Company shall not be liable for claim or loss expense or damage (including indirect, special or consequential damage) / for any interruption, delay /error / omission , or defect in any service / facility or transmission provided under this price list / if caused by any person or enti ty other than the Company / by any malfunction of any service or facility provided by any other carrier / by an actof God, fire , war / civil disturbance, or act of government / or by any other cause beyond the Company's direct control. Liabilities of Company, con/to The Company shall not be liable for / and shall befully indemnified and held harmless by Customeragainst any claim or loss, expense/ or damage (including indirect, special or consequential damage) for defamation, libel/slander / invasion,infringement of copyright or patent / unauthorized use of any trademark, tradename or service mark,unfair competi tion / interference wi th misappropriation or violation of any contract / proprietary or creative right, or any other injury to any person / property or entity arising out of the material, data, information, or other content revealed to/ transmitted, or used by the Company under this price list; or for any act or omission of the Customer; or for any personal injury or death of any person caused directly or indirectlyby the installation, maintenance location,condition, operation, failure, presence / use or removal of equipment or wiring provided by the Company / if not directly caused by negligence of the Company. No agent or employee of any other carrier shall be deemed to be an agent or employee of the Company. The Company shall not be liable for any defacementof or damages to the premises of a Customer resul ting from the furnishing of service which is not the direct result of the Company s negligence. The above tariff language does not constitute a determination by the Commission that a limit ofliabili ty imposed by the Company should be upheld in a court of law. Acceptance for filing by the Commission recognizes that it is court' sresponsibility to adjudicate negligence and consequential damage claims. It is also the court's responsibility to determine the validity of the exculpatory clause. Advance Payments For Customers whom the Company determines an advance payment is necessary / NATN reserves the right to collect an amount not to exceed one ( 1 ) month's estimated charges as an advance payment for service. This will be applied against the next month's charges and a new advance payment may be collected for the next month. Taxes All state and local taxes (i. e. / gross receipts tax, sales tax, municipal utilities tax) are listed as separate line items and are not included in the quoted rates. Terminal Equipment The Company's facilities and service may be used with or terminated in Customer-provided terminal equipment or Customer-provided communications systems / such as a telephone set / PBX or key system. Such terminal equipment shall befurnished and maintained at the expense of the Customer / except as otherwise provided. The Customer is responsible for all costs at his or her premises, including personnel, wiring, electrical power / and the like / incurred in the use of the Company's service. When such terminal equipment is used, the equipment shall comply with the generally accepted minimumprotecti ve criteria standards of the telecommunications industry as endorsed by the Federal Communications Commission. Installation and Termination Service is installed upon mutual agreement between the Customer and the Company. The service agreement does notal ter rates specified in this price list. 10 Payment for Service The Customer is responsible for payment of all charges forservices and equipment furnished to the Customer or to an Authorized User of the Customer by NATN. All charges due by the Customer are payable to the Company or to the Company' authorized billing agent. Terms of payment shall be according to the rules and regulations of the billing agent and subject to the rules of regulatory agencies / such as the IPUC. Any objections to billed charges must be reported to the Companyor its billing agent. Adjustments to Customer's bills shallbe made to the extent that circumstances exist which reasonably indicate that such changes are appropriate. 11 Cancellation by Customer Customer may cancel service by providing 30 days written notice to the Company. 2 . 12 Interconnection Service furnished by NATN may be connected with the servicesor facilities of other carriers. Such service or facilities, if used / are provided under the terms / rates and conditions ofthe other carrier. The Customer is responsible for all charges billed by other carriers for use in connection with NATN's service. Any special interface equipment or facilities necessary to achieve compatibility between carriers is the responsibili ty of the Customer. Unless otherwise specified , the Customer will be given five (5) days written notice and allowed a reasonable time to comply with any rule or remedy any deficiency. For the use of telephone service for any other property or purpose other than that described in the application. For failure or refusal to provide the Company with a deposit or advance paYment to insure payment of bills in accordance with the Company's regulations or failure to meet the Company's credit requirements. For neglect or refusal to provide reasonable access to the Company for the purpose of inspection and maintenance of equipment owned by the Company. For non-compliance with and/or violation Commission'regulations or the Company'rules regulations on file with the Commission. the and For non-payment of bills for telephone service. wi thout notice in the event of Customer use of equipment in such a manner as to adversely affect the Company' equipment or the Company s service to others. Whenever service is discontinued for fraudulent use of service / the Company may before restoring service / require the Customer to make / at his own expense / all changes in facilities or equipment necessary to eliminate illegal use and to pay an amount reasonably estimated as the loss in revenues resulting from such fraudulent use. For failure of the Customer to make proper application for service. For Customer's breach of the contract for service between the Company and the Customer. When necessary for the Company to comply with any orderor request of any governmental authority havingjurisdiction. For extended periods of inactivity over sixty (60) days. 14 Inspection, Testing and Adj ustment Upon reasonable notice , the facilities provided by the Carriershall be made available to the Carrier for tests and adjustments as may be deemed necessary by the Carrier for maintenance. No interruption allowance will be granted for the time during which such tests and adjustments. Kasper / President 1177 Perimeter Center West, Suite 510 EastAtlanta, Georgia 30338 Boise, Idaho North American Telephone Network, LLC.Idaho Price List Original Page 16 SECTION 2 - RULES AND REGULATIONS, CON / T . 15 Tests, Pilots, Promotional Campaigns and Contests The Carrier may conduct special tests / pilot programs / waivers and promotions to demonstrate the ease of use / quality of service and to promote the sale of its services. 16 Interruption of Service Credit allowances for interruptions of service which are not due to the Carrier's testing or adjusting / to the negligence of the Customer / or to the failure of channels, equipment or communications systems provided by the Customer / are subject to the general liability provisions set forth in section 2.herein. It shall be the obligation of the Customer to notify Carrier immediately of any interruption in service for whicha credit allowance is desired by Customer. Before giving such notice / Customer shall ascertain that the trouble is not wi thin his or her control/or is not in wiring or equipment if any / furnished by Customer and connected to Carrier'terminal. Interruptions caused by Customer-provided orCarrier-provided automatic dialing equipment or access-code programmed PBXs are not deemed an interruption of service as defined herein since the Customer has the option of using the long distance network via local exchange company access. Idaho North American Telephone Network, LLC.Idaho Price List original Page 17 SECTION 3 - DESCRIPTION OF SERVICE General North American Telephone Network, Inc. offers long distance telecommunications services to residential and businessCustomers. Intrastate service is provided only to Customers of NATN' s companion interstate offerings. Descriptions and rates contained in this tariff apply to the intrastate portion of the Carrier's services. Services provided by NATN include direct dialed (1+) service and travel card service. Direct dial services are available via Switched or Dedicated Access Origination or Termination. When a Customer elects to use Travel Card service / calls may be initiated from any location from which the caller can dial the appropriate access codes. Usage timing begins upon receipt of answer supervision from the called party at thedistant end. Call duration timing will commence from that point. Chargeable time for a call ends upon disconnection by either party. In calculating the total time for a particularcall/any fraction of the last increment of use / is rounded up to the next higher increment. Minimum call durations / usage measurements and rounding increments are specified on a per-product basis in Section 4 of this tariff. No charges apply for incomplete calls. If a Customer believes he or she has been incorrectly billed for an incomplete call/the Company will, upon notification / investigate the circumstances of the call and issue a credit when appropriate. The distance between the originating and terminating points is calculated by using the "V" and "H" coordinates of the serving wire centers as listed in NECA FCC Tariff No.4 and defined by BellCore (Bell Communications Research) / in the following manner: Step 1: Step 2: Step 3: Step 4: Step 5: Step 6: Formula: Obtain the "V" and "H" coordinates for the servingwire center of the Customer'swi tch and the destination point. Customers access the NATN network by dialinga Toll Free (i. e. "800/888) number or other access dialing sequence and entering a Personal Account Code. The Company's system informs the Customer of the Available Usage Balance remaining in his/her Debit Account and prompts the Customer to place a call by entering a destination telephone number. Network usage for calls placed is deducted from the Available Usage Balance in the Customer's account on a real time basis as the call progresses. Customers purchase a Debit Card which assigns each Customer a Debit Account / provides each Customer wi th a Personal Account Code and lists instructionsfor accessing and using Carrier's service. Debit Cards are available in varying denominations. Purchase of a Debit Card entitles the Customer touse the NATN network for a number of minutes equivalent to the card denomination divided by theeffecti ve per minute rate. The Customer I s right to utilize network usage wi thin a given Debit Account expires one year after issuance and activation of the Debit Card associated with that Debit Account number. No minimum service period applies. Payment for Debit Card Services and any Available Usage in a Customer's Debit Account is nonrefundable.
