West ("Company between various locations within the State of Idaho. West Communications Original Issue Richard Sands, President Page 5 SECTION 1 - DEFINITIONS Billina Services Company - Company with billing and collection agreements with local exchange companies. Called Station - The terminating point of a call (Le., the called number). Callina Card Call - A billing arrangement whereby a customer may charge the call price to a valid calling card issued by a regulated local exchange company with whom the Company has billing and collection arrangements either directly or indirectly through a billing service company. Callina Station - The originating point of a call (Le., the calling number). Coin Call - A call whereby the consumer is notified by the payphone of the call price and deposits coin to place a call. Collect Call - A billing arrangement whereby the charge for a call may be billed to the called station , provided the called station accepts responsibility for such charge when asked by payphone s automated operator. Commission Fee - Monies paid by the Company to the customer. Commission fees represent a portion of the revenue generated from completed call originating from payphones located on customer s premises. Consumer - Individuals who use the Company s telephones and the Company services to place calls. "Consumer" also means the party actually billed for completion of such calls. Customer - The person or legal entity which enters into arrangements with the Company for telecommunications services. "Customer" means the hotel, motel hospital, prison, campus, mall, etc., contracting with the Company for payphone service. West Communications Original Issue Richard Sands, President Page 6 SECTION 1 - DEFINITIONS (continued) Dial Callina Card Station to Station - A service whereby the consumer dials zero, then the called station number and their calling card number; and where the call is completed without the assistance of an operator. Fixed Service Charge - A fee in addition to the underlying long distance for using the payphone s animated operator feature. Incomplete Call - Any call where voice transmission between the calling and called station is not established (Le., busy, no answer, etc. Non-Sent Paid Call - A call placed from a pay telephone where the consumer charges the price of the call on calling card or has the call billed to the receiving party. Pay Telephones - A pay station instrument registered with the Federal Communications Commission and conforming with all Idaho Public Utilities Commission regulations and orders governing such equipment. Sent Paid Call - A call placed from a pay telephone where the consumer deposits coin into the instrument to pay the price of the call on a payphone in advance basis. West Communications Original Issue Richard Sands, President Page 7 SECTION 2 - RULES AND REGULATIONS Undertaking of Company 1 The Company provides intrastate and interstate telecommunications to consumers who use a Company pay telephone. Such services are available consumers from customer locations through the Company s pay telephones and via resold transmission facilities procured from interexchange carriers (IXC' and in accordance with the provisions of this tariff. 2 The Company shall, by record notification, identify itself to consumers on every non sent paid call, including those handled automatically. Such identification will occur before any charges are incurred. 3 Where 911 service is available 911 the Company shall directly route 911 emergency calls to the 911 provider. When a consumer dials "0" the call will be routed to the LEC or to the Alternate Operator Service Provider as described in the Company s "" Exemption Application. 4 The Company, through its billing agent(s), shall provide the local exchange company such information as may be necessary for billing purposes as well as an address and toll free number for consumer inquiries. Limitations Service is offered subject to the availability of the necessary facilities or equipment, and subject to the provisions of this tariff. 1 The Company reserves the right to discontinue service when necessitated by conditions beyond its control, or when the consumer or customer is using the service in violation of the provisions of this tariff. RULES AND REGULATIONS (continued) 2 The Company does not undertake to transmit messages, but offers the use of its facilities when available, and will not be liable for errors on transmission or for failure to establish connections. 3 The Company reserves the right to refuse service to consumers due to insufficient or invalid billing information and/or refusal of a third or called party to accept billing. 4 The Company shall assure that consumers are not billed for emergency calls or calls that are not completed. For non sent paid billing purposes, calls shall be itemized, identified and rated from the point of origination to the point of termination. Sent paid calls shall be rated from the point of origination to the point of termination. No call will be transferred to another telecom- munications company if that company cannot or will not complete the call. Use Services provided under this tariff may be used only for the transmission of communications by Company payphones in a manner consistent with the terms of this tariff. Services provided under this tariff shall not be used for unlawful purposes. 3 The use of the Company s service without payment for service or attempting to avoid payment for service by fraudulent means or devices, schemes, false, or invalid numbers, or false calling or credit cards is prohibited. 2.4 Liability 1 The Company s liability, if any, for its willful misconduct is not limited by this tariff. With respect to any other claim or suit, by a consumer, customer or and other for damages associated in any way with the installation, provision termination, maintenance, repair , restoration or use of services governed by ISSUED: 16 JANUARY 1993 ISSUED BY: -. West Communications Original Issue Richard Sands, President Page 9 SECTION 2 - RULES AND REGULATIONS (continued) this tariff, including all equipment and facilities incidental to or associated with such services, the Company s liability, if any, shall not exceed an amount equal to the charge applicable under this tariff to the period during which services were affected. This liability for damages shall be in addition to any amounts that may otherwise be due the Consumer under other provisions of this tariff, if any, as a credit allowance. 2.4.2 The Company is not liable for any damages caused in whole or in part by or associated . with , any service (including but not limited to channels, maintenance, repair or restoration) or equipment which it did not furnish. In the event the Company is subjected to any liability of damages for its acts or omissions, other than willful misconduct, notwithstanding the provisions of the two preceding sections, the Company shall be indemnified, defended, and held harmless by the customer and consumer against all claims, losses, or damages arising in whole or in part from, or in any way associated with the installation provision , termination, maintenance, repair, restoration or use of services governed by this tariff, including any and all equipment and facilities incidental to or associated with such services. 2.4.4 The Company s failure to provide, maintain, or restore service under this tariff shall be excused by emergency situations, unavoidable casualties and acts of God, subject to the Credit Allowances in this tariff, if applicable to interruptions in service. 2.4.5 The above tariff language does not constitute a determination by the Commission that a limitation of liability imposed by the Company should be upheld in a court of law. Acceptance for filing by the Commission recognizes that it is a court's responsibility to adjudicate negligence and consequential damage claims. It is also the courts responsibility to determine the validity of the exculpatory clause. West Communications Original Issue Richard Sands, President Page 10 SECTION 2 - RULES AND REGULATIONS (continued) Terminal Equipment The Company s pay telephone will operate in conformance with applicable Idaho Utilities Public Commission regulations and orders. Installation and Termination 1 Payphone service is installed upon contractual agreement between the customers and the Company. The contractual agreement specifies the responsibilities of the parties, the terms and conditions of installation termination of service, commission fee structure, and commission fee payment schedule if any. 2 The Company s failure to provide, maintain, or restore service under this tariff shall be excused by emergency situations, unavoidable casualties and acts God, subject to the Credit Allowances in this tariff, if applicable to interruptions in service. 3 On each Company payphone the Company will:a) post on the telephone instrument in plain view of anyone using the telephone , the following notice indicating: the name and toll free telephone number of the owner or other responsible party. ii)the no cost procedure for reporting service difficulties. iii)the no cost method of obtaining User refunds and quotes for refunds. iv)where calls are timed, time limits per call. West Communications Original Issue Richard Sands, President Page 11 SECTION 2 - RULES AND REGULATIONS (continued) normal and emergency dialing instructions, including coin-free 911 and operator access. vi)Operational characteristics, such as pre-payor post-pay. vii)The instrument is not owned by the LEC and charges for calls made on the instrument are not regulated. viii)All MTS companies serving the state of Idaho can be reached by dialing the access code or number provided by the MTS company. ix)the charge for a local call Payment for Service and Credit Allowance All charges due by the consumer are payable to any agency duly authorized to receive such payments. Billing will be done through a billing service company with whom M. P. C. - West either directly, or indirectly, has billing and collections agreements. Due dates and methods of payment are those specified by the billing agency, but in any case, due dates shall not be less than 15 days from the mail date. All sent paid calls are payable in advance. Customers may receive credit adjustments for contested charges by contacting the billing agency whose number is shown on the customer s bill. Adjustments exceeding these allowances, if any, will be authorized after appropriate investigation. Credit card companies will credit the contested amount(s) and notify the Company for investigation and rebilling if appropriate. West Communications Original Issue Richard Sands, President Page 13 SECTION 3 - DESCRIPTION OF SERVICES OFFERED Service Offering Pay telephone services for local; intraLATA intraexchange; intraLATA interstate calls; interLATA intrastate calls; and interstate calls are offered consumers from customer locations in the State of Idaho. Such services are available for use 24 hours per day. Payment Methods Consumers may select anyone of the following payment methods for services provided by the Company:a) Bill to valid calling cardb) Bill to a called number (collect) provided, however, that the called party accepts such charges when asked by the payphone automated operator.c) Depositing coin. Timing of Calls 1 On Calling Card calls, chargeable time begins when the called station answers. C. West equipment will be programmed so no billing on automated collect calls will begin until the called station accepts the charges. 2 On collect calls, chargeable time begins when the called station accepts the charges. M.C. West equipment will be programmed so no billing on automated collect calls will begin until the called station accepts the charges. 3 On coin calls, chargeable time begins when the called person is connected with the calling party. Chargeable time ends when the calling station "hangs up" thereby releasing network connection. If the calling station does not hang up, chargeable time ends when the network connection is released by automatic timing equipment in the network. West Communications Original Issue Richard Sands, President Page 14 SECTION 3 - DESCRIPTION OF SERVICES OFFERED (continued) For billing purposes, chargeable time is based on the actual connection duration as defined above, rounded to the next full minute. 3.4 Calculation of Distance The rates set forth following are mileage sensitive and based on the airline distance rate centers associated with the originating and terminating points of the call. The airline mileage between rate centers is determined by applying the formula below to the vertical and horizontal coordinates associated with the rate centers involved. The Company uses the rate centers and associated vertical and horizontal coordinates compiled by Bell Communications Research in the NPA-NXX V&H Coordinates Tape. Mileage Formula: (V1-V2) + (H1-H2) Service Area Originating service is available from Company payphone locations throughout the State of Idaho. SECTION 4 - RATES AND CHARGES General 1 .1 The rates and charges set forth following are applicable to calls placed from customer locations and originating and terminating within the State of Idaho. For sent paid calls, calls are priced in one minute increments on a coin deposited before service basis. 1.2 M.C. West offers customers a choice of optional rates plans as set forth below. The general rules, regulations and rate provisions contained in this tariff apply regardless of which rate plan is selected, unless otherwise noted. 1.3 Customers may select anyone of the rate plans and associated options; consumers will be charged according to the rate plan selected by the customer whose facilities are used to originate the call. 1.4 Each rate table offers mileage and usage sensitive rates; appropriate operator service charges also apply. Time of day discounts , as well as usage sensitive rates and operator charges , vary from plan to plan.
