FOR A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY TO PROVIDE LOCAL EXCHANGE TELECOMMUNICATIONS SERVICE, PRIVATE LINE TELECOMMUNI­CATION SERVICE, SWITCHED ACCESS SERVICE, AND INTRALATA TOLL SERVICE. ) ) ) ) ) ) ) ) CASE NO. MTI-T-96-1   ORDER NO.  26932 On December 5, 1996, the Commission received an Application from McLeod Telemanagement, Inc. (McLeod) for a Certificate of Public Convenience and Necessity to provide (1) local exchange telecommunication service, (2) private line telecommunication service, (3) switched access telecommunication service, (4) telecommunication service through resale, and (5) intraLATA toll service.  McLeod requests certification to provide services in Idaho in the exchanges in which U S WEST Communications, Inc. (U S WEST) is the incumbent local exchange carrier.  McLeod’s Application states that it currently is a provider of telecommunication services to businesses and residential customers, primarily in the states of Iowa and Illinois. The Commission issued a Notice of Application  and Notice of Modified Procedure on February 6, 1997, to process McLeod’s Application.  No comments were filed during the comment period.  Staff reviewed the material provided by McLeod and is satisfied that McLeod has provided the necessary information required by the Commission’s Rules of Procedure and Procedural Order No. 26665, which sets out the requirements for information to be included with an application for a certificate.  Staff therefore recommends that the Commission issue a Certificate of Public Convenience and Necessity to McLeod authorizing it to provide telecommunications service in the areas currently served by U S WEST. COMMISSION FINDINGS Based on our review of the record we find that the Application of McLeod Telemanagement, Inc. complies with Procedural Order No. 26665 and the Commission’s Rules to obtain a Certificate of Public Convenience and Necessity.  We therefore approve McLeod’s Application for a Certificate to provide local exchange service only in the territory served by U S WEST. O R D E R IT IS HEREBY ORDERED that McLeod Telemanagement, Inc. is granted a Certificate of Public Convenience and Necessity to provide local telecommunications service in U S WEST’s service area. THIS IS A FINAL ORDER.  Any person interested in this Order (or in issues finally decided by this Order) or in interlocutory Orders previously issued in this Case No. MTI-T-96-1 may petition for reconsideration within twenty-one (21) days of the service date of this Order with regard to any matter decided in this Order or in interlocutory Orders previously issued in this Case No.  MTI-T-96-1.  Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration.  See Idaho Code § 61-626.
