No. Original Sheet 5 Operator Services Tariff TARIFF FORMAT Sheet Numbering - Sheet numbers appear in the upper-right comer of the sheet. Sheets are numbered sequentially. However, new sheets are occasionally added to the tariff. When a new sheet is added between existing sheets with whole numbers, a decimal is added. For example a new sheet added between Sheet 14 and Sheet 15 would be Sheet 14. Sheet Revision Numbers - Revision numbers also appear in the upper-right comer of the sheet. These numbers are used to determine the most current sheet version on file with the Commission. For example, 4th Revised Sheet 14 cancels 3rd Revised Sheet 14. (a) Check Sheets - When a tariff filing is made with the Commission, an updated Check Sheet will accompany the filing. All revisions made in a given filing are designated by an asterisk (*). There will be no other symbols used on this sheet if these are the only changes made to it (i., the format, etc., remains the same, just revised revision levels on some sheets). No. Original Sheet 6 Operator Services Tariff SECTION 1 - DEFINITIONS AND ABBREVIATIONS 1.1 Definitions: Carrier/Company - Midessa Communications Management Systems, Inc. ("Midessa ), unless otherwise specified or clearly indicated by the context. Collect Call - A billing arrangement whereby the charge for a call is charged to the called party, provided the called party accepts the charge. Commission - the Idaho Public Utilities Commission. Completed Calls - Calls answered on the distance end, and, where required, a positive acceptance is received. Holidays - Carrier s recognized holidays are New Year s Day, Memorial Day, July 4th, Labor Day, Thanksgiving Day and Christmas Day. Inmates - One whose liberties are legally restricted by judgment or order of a court, or who are confined under arrest, involuntary commitment, or other legal process, and who are physically restrained from leaving the premises. Institutions of Confinement - Those portions of prisons, jails, mental hospitals, etc., that house or enclose inmates. Halfway houses, house arrest, etc., where inmates have freedom during some or all of the day to leave or to make telephone calls from telephones other that those provided by the institution, are not institutions of confinement under this rule. Inmate Service Provider (PSP)- Any person or entity, including the owner of the payphone that in the ordinary course of its operations, makes payphone service available to inmates served within the confines of a penal, correctional or mental institution, for intrastate telephone calls. No. Original Sheet 7 Operator Services Tariff 1.1 Definitions : (continued) Local Exchange Company/Carrier (LEC)- Telecommunications service provider offering and/or provisioning local telecommunications services. Normal Business Hours - The Company s normal business hours are 8:00 a.m. to 5:00 p. Monday through Friday, excluding holidays. Operator and Directory Assistance Services - Operator and directory assistance services (operator services) are any telecommunications services that include, as a component, any automatic or live assistance to a telephone caller to arrange for billing or completion, or both of a pay telephone call from an institution of confinement. The include, but are not limited , intercept, call completion and assistance, and directory assistance services, whether local MTS or both. Operator Service Provider (OSP)- Any entity offering and/or providing operator services including service to pay telephones in institutions of confinement. OSP Customer - The institution of confinement that collects and routes calls by inmates of the institution of confinement to an OSP. 0+" Call - a call made by the end user dialing the digit "0" followed by the terminating telephone number. On some automated call equipment, a digit or digits may be dialed between the "0" and the terminating telephone number. " Call - a call made by the end user dialing the digit "0" and no other digits. Pay Telephone - A telephone instrument that requires the use of anyone or more of coin collect, third-party billing, or credit/calling cards in order to complete local or toll calls including those located in an inmate of an institution of confinement. Telephone Caller/Telephone User - An inmate of an institution of confinement who originates or attempts to originate a call from a pay telephone in the institution. Telephone Customer - The person paying rates and charges for a pay telephone call originated by an inmate of an institution of confinement. Issued Date:July 11, 2001 By:Harry R. No. Original Sheet 9 Operator Services Tariff SECTION 2 - RULES AND REGULATIONS Service Offering The Company will provide operator services to institutions of confinement throughout the State ofIdaho. The Company s services are available twenty-four (24) hours per day, seven (7) days per week. Limitations on Service 2.2.Carrier reserves the right to provide services only to and from locations where the necessary facilities and/or equipment are available. 2.2.Carrierreserves the right to discontinue furnishing service, upon written notice, when necessitated by conditions beyond its control or when service is being used in violation of the provisions of this tariff or in violation of the law. Title to any equipment provided by Carrier under these regulations remains with Carrier. Carrier s prior written permission is required before any assignment or transfer. All regulations and conditions contained in this tariff shall apply to any such assignee or transferee. Use of Service Service shall not be used for any unlawful purposes, or for any purpose which is not allowed under the terms ofthis tariff or the laws of the State ofIdaho. No. Original Sheet 10 Operator Services Tariff 2.4 Limitation of Liability 2.4.Carrier shall not be liable to any person, firm or entity for damages, either direct indirect, consequential, special, incidental, actual, punitive, or for any other damages or for any lost profits, arising 'out of mistakes, accidents, errors, omissions interruptions, delays or defects in transmissions, and not caused by the negligence of the carrier, commencing upon activation of service and in no event exceeding an amount equivalent to the proportionate charge for the period of service during which mistakes, accidents, errors, omissions, interruptions, delays or defects in transmission occur. Carrier makes no warranty, whether express, implied or statutory, as to the description, quality, merchantability, completeness or fitness for any purpose of the service or local access, or as to any other matter, all of which warranties are hereby excluded and disclaimed. 2.4.2 Carrier shall not be liable to any person, firm or entity for damages, either direct indirect, consequential, special, incidental, actual, punitive, or for any other damages or for any lost profits, arising out of the use or misuse, whether lawful or unlawful moral or immoral, of the services provided hereunder. 2.4.Carrier shall not be liable for any and all loss, claims, demands, suits, or other actions or any liability whatsoever, whether suffered, made, instituted, or asserted by the customer or by any party or persons, for a personal injury to, or death of, any person or persons, and for any loss, damage, defacement, or destruction of the premises of the customer or any other property, regardless of ownership, caused or claimed to have been caused directly or indirectly by the installation, operation, failure to operate, maintenance, condition, location, or use that is not the direct result of the carrier s negligence. No agents or employees of other carriers shall be deemed to be agents or employees of Carrier. 2.4.4 Exculpatory Clause: The language set forth in this tariff does not constitute a determination by the Commission that a limitation of liability imposed by the Company should be upheld in a court of law. Acceptance for filing by the Commission recognizes that it is a court's responsibility to adjudicate negligence and consequential damage claims. It is also the court's responsibility to determine the validity of the exculpatory clause. No. Original Sheet 11 Operator Services Tariff Service Provisions The Company will provide operator service to institutions of confinement or correctional facilities. 5.2 Any 0+ collect local calls will be transported over the facilities of the underlying local exchange carrieres) (LECs). IntraLATA and interLATA 0+ collect calls will be transported over the facilities of the Company s underlying interexchange carrieres) (IXCs). Call detail information, such as the date and time of the call, duration of the call, and called and calling telephone numbers, may be furnished, upon request of the administrator, to the facility where prison authorities stipulate that such information is appropriate in preventing or identifying abuse or unlawful use of service and where the provision of such information is not in violation of any federal, state or local laws regulations or orders. Call detail information will be available to the facility administrator on a real-time basis. 7 A positive response from the called party will be required for completion of all 0+ collect calls. A positive response shall be in the form of a pulse/tone generated response or a verbal acceptance. The call will be terminated 15 seconds from the last message given if no positive acceptance is received. Issued Date:July 11 2001 By:Harry R. No. Original Sheet 12 Operator Services Tariff Service Restrictions Inmate Calling Service is restricted to the use of"O+" collect calls. Only 0+ collect calls for local, intraLATA and interLATA calls will be allowed. All other calls including, but not limited to, local direct, credit card, third number, 1 + sent-paid, toll free numbers (i.e. 800or 950 numbers), pay-per-call numbers, (i.e. 900, 976), 911 directory assistance, incoming calls, and 1O1XXXX dialing sequences shall be blocked. The Company will make arrangements to block access to certain telephone numbers at the request of the facility administrator. Inmate calls will be placed only to telephone numbers pre-approved by the facility administrator. 6.4 At the request ofthe facility administrator, limitations may be placed on the time of day and the duration of calls, and the number of calls placed per individual. Permission restrictions may also apply. The Company shall block local or long distance numbers as directed by the institution of confinement that is the OSP customer. Use and Restoration of Service The use and restoration of service in emergencies shall be in accordance with the Part 64 Subpart D of the Federal Communications Commission Rules and Regulations which specify the priority system for such activities. No. Original Sheet 13 Operator Services Tariff Responsibility oflnstitutions of Confinement (OSP Customer) All facilities are responsible for providing telephone equipment compliant with all FCC regulations regarding such equipment. All facilities are responsible for monitoring the use of service by inmates and to promptly report any abuse detected. Maintaining information posted on or in proximity to the telephone instrument as provided by the OSP, and for notifying the OSP when this information is made illegible or removed. Equipment Maintenance. Testing. and Adjustment Upon reasonable notice, equipment shall be made available for such tests and adjustments as may be necessary to maintain them in satisfactory condition. No interruption allowance will be granted for the time during which such tests and adjustments are made. Payment for Services Charges for accepted collect calls will be billed to the called party by the Company or its billing agent, and will be due and payable in accordance with the billing terms established herein. Payment is due upon receipt. Payment will be considered timely if paid within 20 days after the bill is rendered. The bill shall be considered rendered when deposited in the US. mail with postage prepaid. In the event of a dispute concerning a bill, the customer or called party must pay a sum equal to the amount of the undisputed portion of the bill and proceed with complaint procedures set forth in this tariff. No. Original Sheet 14 Operator Services Tariff Payment for Services (continued) The called party is responsible for payment of all charges for accepted collect calls received from the correctional facility where service is provided by the Company. Charges are based on actual usage and will be billed monthly in arrears. 6 Federal, state and local taxes are listed as separate line items, and are not included in the rates set forth herein. 7 A late payment penalty will be incurred in the amount of one and one-half percent (1.5%) per month of any past-due amount. 8 A $15.00 returned check charge will be imposed for any check returned from the bank due to insufficient funds, closed account or for any other reason which prevents collection of the amount due. Disclosure of Operator Service Provider The Company will use call branding to identify itself prior to the collect call being accepted. The company will also notify the person accepting an inmate call that the call is being made from an institution of confinement. Uncompleted Calls 11.1 The Company will not knowingly bill for unaccepted or uncompleted collect calls originating from pay telephones in institutions of confinement. 11.2 The Company will use answer supervision to determine whether a call has been accepted. 11.3 The Company will provide full credit for any call of one minute or less upon being informed by a customer that the call was not completed. 11.4 An uncompleted call includes, but shall not be limited to: calls terminating to an intercept recording, line intercept operator or a busy tone; or calls that do not answer. No. Original Sheet 15 Operator Services Tariff Customer Complaint Procedure The Company will attempt to resolve any billing disputes brought to its attention. Customer service representatives can be reach by dialing the telephone number set forth on service invoices. The Company will review the dispute and advise the customer of its findings. Any unresolved disputes may be directed to the attention of the Idaho Public Utilities Commission. In the event of a dispute concerning an invoice, the invoice recipient must pay a sum equal to the amount of the undisputed portion of the bill and notify the Company of the disputed amount. Emergency Access If requested by the institution of confinement, pay telephones located in an institution of confinement will be made available for use of inmates to provide no-cost reporting of emergencIes. Information Displayed at Telephone Location The Company will post the following information on or in proximity to the telephone instruments located within institutions of confinement: The name, address and toll free number of the OSP and the name, mailing address and toll free number of the owner of the pay telephone if the owner is not the OSP. (These toll free telephone numbers may be blocked to telephone callers in the institution of confinement. The address and telephone number of the Idaho Public Utilities Commission and a statement of its consumer complaint authority over improper charges, inadequate services, etc. The total charge for completing a local call; and The time limit per call, if applicable. No. Original Sheet 16 Operator Services Tariff SECTION 3 - DESCRIPTION OF SERVICE AND RATES Timing of Calls 1.1 Call timing begins when the called party provides a positive response of acceptance of the collect call and a connection is established between the calling party and the called party. This response may be in the form of a pulse/tone touch response or verbal acceptance. Chargeable time ends when either party disconnects. There are no charges incurred if a call is not completed. Equipment The Company s service may be used with OSP customer-provided telephone equipment. Such equipment will be furnished and maintained at the expense of the institution of confinement except as otherwise agreed in advance and in writing. The institution of confinement is responsible for all costs at their premises, including personnel, wiring, electrical power, and the like incurred in the use of the services. All equipment shall must comply with the generally accepted minimum protective criteria of the telecommunications industry. Usage charges for all mileage sensitive products are based on the airline distance between rate centers associated with the originating and terminating points ofthe call. Inmate Calling Services A positive response must be received from the called party indicating a willingness to pay for the call received prior to completion of the call. This response will be in the form of a pulse/tone generated response or a verbal acceptance. The Company will terminate the call within 15 seconds from the last message given if no positive acceptance is received. Inmate calling service shall be arranged to allow only collect calls for local intraLATA, and interLATA calls. Billing Increments and Rounding 1.1 U sage charges are determined by the time of day rate periods and minutes of use within each rate period. The rate period is determined by the time and day of call origination. Unless otherwise specified, usage is billed in whole minute increments. 4. 1.All partial usage will be rounded up to the next highest billing increment. Partial cents will be rounded to the next highest whole cent.
