APPLICATION OF TARIFF
This tariff sets forth the service offerings, rates, tenus and conditions applicable to the furnishing of local
exchange service by Matrix Telecom, Inc d/b/a Matrix Business Technologies ("the Company ) in the
serving areas defined herein.
The provision of local exchange services is subject to existing regulations and tenus and conditions
specified in this tariff and may be revised, added to or supplemented by superseding issues.

With Respect to Directory Listings (cont'
1.5.
(iv)Credit limitation: The total amount of the credit provided for the preceding
paragraphs (i) and (ii) shall not exceed, on a monthly basis the total of the
charges for each charge listing as specified in paragraph (ii), for the line or
lines in question.
(v)Definitions: As used in paragraphs (i), (ii) and (iii) above, the terms "error
mistake " or "omission" shall refer to a discrepancy in the directory listing or
directory assistance records which the Company has failed to correct and where
the error affects the ability to locate a particular subscriber s correct telephone
number. The terms shall refer to addresses only to the extent that an error
mistake or omission of an address places the subscriber on a street or a
community different from the one provided to the Company.
(vi)Notice: Such allowances or credits as specified in paragraphs (i) and (ii)
above, shall be given upon notice to the Company by the subscriber that such
error, mistake or omission has occurred; provided, however, that when it is
administratively feasible for the Company to have knowledge of such error
mistake or omission, the Company shall give credit without the requirement of
notification by the subscribers.
With Respect to Caller ill Blocking
The Company shall have no liability for monetary damages (including without
limitation claims for direct, indirect, special, incidental or consequential damages
whether or not the Company has been advised of the possibility of such damages),
arising form any failures, errors, malfunctions or omissions of Caller ID Blocking,
whether or not arising from or relating to any ordinary negligence by the Company.
1.5.Exculpatory Clause
The included Tariff language does not constitute a determination by the Commission
that a limitation of liability imposed by the Company should be upheld in a court of
law. Acceptance for filing by the Commission recognizes that it is a court'
responsibility to adjudicate negligence and consequential damage claims. It is also
the court's responsibility to determine the validity of the exculpatory clause.
