FORA CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY TO PROVIDE COMPETITIVE TELECOMMUNICATIONS SERVICES WITHIN THE STATE OF IDAHO ORDER NO. 29685 CASE NO. MAE-O4- On October 27, 2004, Matraex, Inc. filed an Application for a Certificate of Public Convenience and Necessity to offer resold and facilities-based local exchange services to residential and business customers in the State of Idaho. In the Notice of Application and Modified Procedure issued December 9, 2004, the Commission sought comments regarding the Company s Application. Order No. 29608. No comments were received other than those submitted by Commission Staff. Application. In this Order the Commission approves the Company THE APPLI CA TI 0 N On October 27, 2004, Matraex, Inc. filed an Application for a Certificate of Public Convenience and Necessity with the Commission seeking its review and approval.The Application requests authority for the Company to offer resold and facilities-based local exchange services to residential and business customers in the State of Idaho. Matraex plans to provide voice and data solutions to customers through the combination of its own facilities and leased/resold services. Matraex is an Idaho corporation located in Eagle, Idaho. The Application states that the Company currently provides web hosting and programming services, and will market initially to these existing customers. The Company plans to serve both business and residential customers, and to provide bundled telephone and Internet services including plain old telephone service (POTS), Tl telephony, managed PBX solutions, and routed Internet access. Matraex intends to offer service in the Greater Boise area, with plans to expand to Canyon, Owyhee Boise, and Elmore counties.The Application states that the Company has entered into interconnection negotiations with Qwest Corporation. ORDER NO. 29685 STAFF COMMENTS In its evaluation of the Company s Application, Staff determined that Matraex, Inc. is incorporated in the State of Idaho and headquartered in Eagle, Idaho. For the past six years the Company has been providing web hosting and programming services in Idaho and also provides IT solution implementation consulting and services. Matraex has provided financial sheets for quarters from October 25, 2002 through October 24, 2004 as well as the appropriate contact information for its registered agent for service of process within Idaho. The Company plans to offer resold and facilities-based voice and data services to business and residential customers in Boise and the surrounding area with plans to expand the service area to include Canyon, Owyhee, Boise, Elmore and surrounding counties. November 9, 2004, the Commission approved an interconnection agreement between Qwest Corporation and Matraex, Inc. Staff has reviewed the Application submitted by Matraex and believes the Company understands and agrees to comply with the Commission rules and requirements. Based on this review, the Company s filing fulfils the requirements of the Commission Rules and Procedural Order No. 26665.The Staff believes that the Company possesses the requisite financial managerial and technical qualifications necessary to operate provider of telecommunications services. Therefore, the Staff recommended approval of the Application for a Certificate of Public Convenience and Necessity. COMMISSION FINDINGS Based upon the comments, the law, and the record, the Commission grants the Application. When considering an application for a Certificate, the Commission must determine if the applicant has the necessary qualifications to provide service while still fostering competition in the local telecommunications market. Based upon our review of the filing and the record in this case, the Commission finds that Matraex, Inc.' s filing satisfies the requirements of the Commission Rules and Procedural Order No. 26665.Thus we approve Matraex Application for a Certificate of Public Convenience and Necessity to allow the Company to provide telecommunications services statewide. This is consistent with our previous Orders granting statewide authority to provide telecommunications services to carriers meeting the established requirements. ORDER NO. 29685 ORDER IT IS HEREBY ORDERED that Matraex, Inc. is granted a Certificate of Public Convenience and Necessity to provide competitive telecommunications services within the State of Idaho. THIS IS A FINAL ORDER. Any person interested in this Order may petition for reconsideration within twenty-one (21) days of the service date of this Order with regard to any matter decided in this Order. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code 9 61- 626.
