Idaho LEAST COST ROUTING, INC.Idaho Price List Original Page 2 SECTION 1 - TERMS AND ABBREVIATIONS Authorized User - A person, firm, corporation , or any other entity authorized by the Customer to communicate utilizing the Carrierservice. Company or Carrier - Least Cost Routing, clearly indicated by the context.Inc.unless otherwise Customer - The person, firm, corporation or other entity whichorders, cancels, amends or uses service and is responsible for payment of charges and compliance with the Company s tariff. End User - Any person , firm , corporation , partnership or other entity which uses the services of the Carrier under the provisions and regulations of this tariff. The End User is responsible for payment unless the charges for the services utilized are accepted and paid by another Customer. Equal Access - The ability of the Carrier to serve End Users on a presubscribed basis rather than through the use of dial accesscodes. Holidays - Holidays observed by the Carrier as spec~fied in thistariff. LATA Local access and transport area. A geographic area established by the US District Court for the District of Columbia in Civil Action No. 17-49, within which a local exchange company provides communications services. LCR - Used throughout this tariff to mean Least Cost Routing, Inc. unless clearly indicated otherwise by the text. LEC - Local Exchange Company Premises - A building or buildings on contiguous property. Subscriber The person, firm, Customer, corporation or other entity that arranges for the Carrier to provide , discontinue orrearrange telecommunications services on behalf of itself or others under the provisions and terms of this tariff. Least Cost Routing, Inc.' s services and resold facilities are furnished for intraLATA and interLATA communications originating at specified points within the state of Idaho under terms of this tariff. LCR installs, operates, and maintains the communications services provided hereinunder in accordance with the terms and conditions set forth under this tariff. LCR may act as theSubscribers agent for ordering access connection facilities provided by other carriers or entities , when authorized by the Subscriber, to allow connection of a Subscriber s location to the LCR network. The Subscriber shall be responsible for all charges due for such service arrangement. The Company s services and resold facilities are provided on a monthly basis unless otherwise provided, and are available twenty- four hours per day, seven days per week. Limi ta tions Service is offered subject to the availability of the necessary resold facilities and equipment and subj ect to the provisions of this tariff. LCR reserves the right to discontinue or limit service when necessitated by conditions beyond its control, or when the Subscriber or Customer is using service in violation of provisions of thistariff, or in violation of the law. The Company does not undertake to transmit messages, but offers the use of its facilities when available, and will not be liable for errors in transmission or for failure to establishconnections. Limitations,(cont' Use All services and resold facilities provided under this tariff are directly or indirectly controlledby LCR and the Subscriber may not transfer or assign the use of service or facilities without the express written consent of the Company. Such transfer or assignment shall only apply where there is no interruption of the use or location of the service or facilities. Prior written permission from the Company isrequired before any assignment or transfer. All regulations and conditions contained in this tariff shall apply to all such permitted assignees or transferees, as well as all conditions of service. Services provided under this tariff may be used for any lawful purpose for which the service is technically suited. Taxes All state and local taxes (i. e., gross receipts tax , sales tax, municipal utilities tax) are listed as separate line items and are not included in the quoted rates. Idaho LEAST COST ROUTING, INC.Idaho Price List Original Page 5 SECTION 2 - RULES AND REGULATIONS,(CONT'D. ) Payment for Service The Customer is responsible for payment of all charges for services and equipment furnished to the Customer or to an Authorized User of the Customer by LCR. All charges due by the Customer are payableto the Company or to the Company authorizedbilling agent. Any obj ections to billed charges must be reported to the Company or its billing agent within two months after receipt of bill. Adjustments to Customer s bills shall be made tothe extent that circumstances exist whichreasonably indicate that such changes areappropriate. Customer bills for telephone service are due upon receipt, unless otherwise specified by this tariff or by contract. A Customer is in default unless payment is made on or before the due date specified on the bill. If payment is not made within 30 days of the date of the bill , a late payment charge of one and one-half percent (1.5%) per monthly billing period will be applied to all amounts previously billed under this company s tariff (s), including arrears and unpaid late payment charges. In the event that the Company incurs fees orexpenses, including attorney s fees, collecting, or attempting to collect, any charges owed to the Company, the Company may charge the Customer all such fees and expenses reasonably incurred. The Company reserves the right to assess a return- check charge of $15.00 whenever a check or draft presented for payment of service is not accepted by the institution on which it is written. This charge applies each time a check is returned to LCR by a bank for insufficient funds. Payment for Service,(cont' d. Deposi ts The Customer shall be responsible for all calls placed by or through Customer s equipment by any person, including all charges placed against TravelCard numbers. Customers are responsible for thesecurity and usage of all Travel Card numbers. The Customer is responsible for all calls placed viatheir authorization code as result of the Customer s intentional or negligent disclosure ofthe authorization code. Customers claiming thatfive or more calls on any one statement were unauthorized may be required to accept a Travel Card number change issued by LCR. Deposits may be collected from Customers or potential Customers whose credit or payment history is unsatisfactory or unknown to the Company. Advance Payments The Company reserves the right to require an advance payment from a Customer instead of , or in addition to, a deposit. The advance payment shall be in amount equal to or less than two months estimated billing. Liabili ties of the Company The liability of the Company for its willful misconduct or gross negligence which is the sole legal cause of damage or injury is not limited by this tariff. with respect to any other claim or suit, by a Customer or by any others, for damagesassociated with acts or omissions involvinginitiation, installation, provision, termination maintenance, repair, interruption or restoration ofany service or facilities offered under this tariff, the Company s liability, if any, is limited to the actual damages or injury sustained, which in the event of any failure of service shall be deemedto be 1/30 of the monthly charge for service affected for each 24 -hour period during which suchfailure of service occurs and is reported to or known by the Company. In addition, Customer creditsfor interrupted service will be issued, whereapplicable. In no event will Company be responsible for consequential damages or lost profits suffered byCustomer on account of interrupted unsatisfactory service unless Company is found to have been willfully negligent. The Company is not liable for any act or omissionof any other company or companies furnishing a portion of the service. No agents or employees ofother carriers shall be deemed to be agents or employees of the Company. Liabili ties of the Company,(cont'd. The Company shall be indemnified and held harmless by the Customer against: Claims for libel , slander infringement of copyright or unauthorized use of any trade mark, trade name or service mark arising out of the material , data, information , or other content transmitted by the Customer over the Company s facilities; and Claims for patent infringement arising from combining or connecting the Company facilities with apparatus and systems of the Customer; and All other claims arising out of any act or omission of the Customer in connection with any service provided by the Company. The Carrier will make no refund of overpaYments by a Subscriber unless the claim for such overpaYment together with proper evidence be submitted wi thinone (1) year from the date of alleged overpaYment unless billing records prepared by the Company can be produced which would justify a credit beyond oneyear. The preceding language does not constitute a determination by the Commission that a limitationof liability imposed by the Company should be upheld in a court of law. Acceptance for filing bythe Commission recognizes that it is a court' responsibility to determine the validity of theexculpatory clause. Idaho LEAST COST ROUTING, INC.Idaho Price List Original Page 9 SECTION 2 - RULES AND REGULATIONS,(CONT'D. ) Reservation of 800 Numbers The Company will make every effort to reserve " 800" vanity numbers on behalf of customers, but makes no guarantee or warrantee that the requested "800" number(s) will be available or assigned to the customer requesting the number. 10 800 Number Portability If a Customer accumulates undisputed delinquent charges, the Company reserves the right not to honor that Customer request for a change in service, including a request for Resp. Or. change, until such charges are paid in full. The Customer does not retain any rights in 800 numbers which are shared with other Customers of the Company. Shared 800 numbers are not portable. 11 Other Rules 11.The Company reserves the right to discontinue service, limit service, or to impose requirementson Subscribers as required to meet changing regulatory rules and standards of the Idaho Public Utilities Commission. Charges are computed on a time of day basis as described inSection 3.2 of this tariff. Customers are billed based on their use of LCR' s long distance service. No installation charges apply. All service is offeredin conjunction with interstate service and applicable interstate monthly recurring charges and/or minimum monthlyusage charges apply. Calls are originated by dialing a 1-800 access number , followed by the terminating telephone number and personal identification number. Calls may originate from standard residential , business, hotel or pay telephone access lines and may terminate to any interstate orintrastate location. Calls are billed in one minute and additional minute increments. The minimum call duration for billing purposes is one minute. Up to two requests may be made on each callto Directory Assistance. The Directory Assistance charge applies to each call regardless of whether the Directory Assistance Bureau is able to furnish the requested telephone number. Directory Assistance charges are not discounted and will not count toward, nor be calculated as part of any LCR rate plan. These offerings may be limited to certain dates, times or locations and may waive or reduce recurring or nonrecurring charges. Competi ti ve Response Promotion In order to acquire or retain Customers, the Carrier willmatch certain offers made by other interexchange carriers/resellers where the Customer can demonstrate to theCarriers satisfaction that it intends to accept such offer as an inducement to subscribe to or remain subscribed to such other interexchange carrier ' s/reseller ' s services.
