by a Customer or by any others, for damages associated with the ordering (including the
reservation of any specific number for use with a service), installation (including delays
thereof), provision, term ¡nation, maintenance, repair, interruption or restoration of any
service or facilities offered under this Tariff, and subject to the provisions of Section
2.12, the Company's liability, if any, shall be limited as provided herein.
The included tariff language does not constitute a determination by the Commission that
a limitation of liability imposed by the Company should be upheld in a court of law.
Acceptance for filing by the Commission recognizes that it is a court's responsibility to
adjudicate negligence and consequential damage claims. It is also the court's
responsibility to determine the validity of the exculpatory clauses.
