LDC - Used throughout this tariff to mean LDC Telecommunications,Inc. unless clearly indicated otherwise by the text. Company or Carrier - LDC Telecommunications, Inc. unless otherwise clearly indicated by the context. Customer - The person , firm , corporation or other entity whichorders, cancels, amends or uses service and is responsible for payment of charges and compliance with the Company s tariff. End User - Any person , firm , corporation , partnership or other entity which uses the services of the Carrier under the provisions and regulations of this tariff. The End User is responsible for payment unless the charges for the services utilized are accepted and paid by another Customer. Equal Access - The ability of the Carrier to serve End Users on a pre subscribed basis rather than through the use of dial access codes. Holidays - Holidays observed by the Carrier as specified in thistariff. LATA Local access and transport area. A geographic area established by the US District Court for the District of Columbia in Civil Action No. 17-49, within which a local exchange company provides communications services. LEC - Local Exchange Company Premises - A building or buildings on contiguous property. Subscriber The person, firm, Customer , corporation or other entity that arranges for the Carrier to provide, discontinue orrearrange telecommunications services on behalf of itself or others under the provisions and terms of this tariff. Also see Customer. Idaho LDC TELECOMMUNICATIONS, INC.Idaho Price List Original Page 3 SECTION 2 - RULES AND REGULATIONS Undertaking of LDC Telecommunications, Inc. LDC Telecommunications, Inc.' s services and resold facilitiesare furnished for intraLATA and interLATA communications originating at specified points within the state of Idaho under terms of this tariff. LDC installs, operates, and maintains the communications services provided hereinunder in accordance with the terms and conditions set forth under this tariff. LDC may act as theSubscribers agent for ordering access connection facilities provided by other carriers or entities when authorized by the Subscriber, to allow connection of a Subscriber s location to the LDC network. The Subscriber shall be responsible for all charges due for such service arrangement. The Company s services and resold facilities are provided on a monthly basis unless otherwise provided, and are available twenty- four hours per day, seven days per week. Limi ta tions Service is offered subject to the availability of the necessary resold facilities and equipment and subj ect to the provisions of this tariff. LDC reserves the right to discontinue or limit service when necessitated by conditions beyond its control, or when the Subscriber or Customer is using service in violation of provisions of this tariff, or in violation of the law. The Company does not undertake to transmit messages, but offers the use of its facilities when available, and will not be liable for errors in transmission or for failure to establishconnections. Such transfer or assignment shall only apply where there is no interruption of the use or location of the service or facilities. Prior written permission from the Company isrequired before any assignment or transfer. All regulations and conditions contained in this tariff shall apply to all such permitted assignees or transferees, as well as all conditions of service. Services provided under this tariff may be used for any lawful purpose for which the service is technically suited. Taxes All state and local taxes (i. e., gross receipts tax , sales tax, municipal utilities tax) are listed as separate line items and are not included in the quoted rates. Idaho LDC TELECOMMUNICATIONS, INC.Idaho Price List Original Page 5 SECTION 2 - RULES AND REGULATIONS, con' Payment for Service Payment Arrangements The Customer is responsible for payment of all charges for services and equipment furnished to the Customer for transmission of calls via the Company.The Customer agrees to pay to the Company any cost (s) incurred as a result of any delegation ofauthority resulting in the use of his or hercommunications equipment and/or network services which result in the placement of calls via theCompany. The Customer agrees to pay the Company or its authorized agent any and all cost (s) incurred as a resul t of the use of the service arrangement, including calls which the Customer did not individually authorize. All charges due by the Customer are payable to the Company or any agency duly authorized to receivesuch payments. Terms of payment shall be according to the rules and regulations of the agency and subj ect to the rules of regulatory agencies. Anyobj ections to billed charges must be promptly reported to the Company or its billing agent. Adjustments to Customers ' bills shall be made tothe extent that circumstances exist whichreasonably indicate that such changes areappropriate. Charges for installations, service connections, moves, and rearrangements, where applicable, arepayable upon demand by the Company or itsauthorized agent. The billing thereafter willinclude recurring charges and actual usage defined in this rate sheet. In particular and without limitation to the foregoing, the Customer is responsible for any calls placed by or through the Customer s equipment via any remote access features. The Customer is responsible for all calls placed via their authorization code as a result of the Customer intentional or negligent disclosure of theauthorization code. Deposi ts No deposits are required. Advance Payments No advance payment is required. Taxes Company reserves the right to bill any and allapplicable taxes in addition to normal long distance usage charges, including, but not limited to: Federal Excise Tax , State Sales Tax , Municipal Taxes, and Gross Receipts Tax. Such taxes will be itemized separately on Customer invoices. Late Payment Charge and Cost of Collection A late fee of 1.5% per month will be charged on any past due balance. In the event that the Company incurs fees or expenses, including attorney s fees, collecting or attempting to collect, any charges owed to the Company, the Company may charge the Customer all such fees and expenses reasonablyincurred. Return Check Charge A return check charge of $15.00 will be assessedfor checks returned for insufficient funds. Any applicable return check charges will be assessed according to the terms and conditions of thebilling entity (i.e. local exchange company and/or commercial credit card company) and pursuant to Idaho law and Commission regulations. Liabili ties of the Company The liability of the Company for its willful misconduct or gross negligence which is the sole legal cause of damage or injury is not limited by this tariff. With respect to any other claim or sui t, by a Customer or by any others, for damagesassociated with acts or omissions involvinginitiation, installation, provision, termination maintenance, repair , interruption or restoration ofany service or facilities offered under thistariff, the Company s liability, if any, is limited to the actual damages or injury sustained, which in the event of any failure of service shall be deemedto be 1/30 of the monthly charge for service affected for each 24 -hour period during which suchfailure of service occurs and is reported to or known by the Company. In addition, Customer creditsfor interrupted service will be issued, whereapplicable. In no event will Company be responsible for consequential damages or lost profits suffered byCustomer on account of interrupted unsatisfactory service unless Company is found to have been willfully negligent. The Company is not liable for any act or omissionof any other company or companies furnishing a portion of the service. No agents or employees ofother carriers shall be deemed to be agents or employees of the Company. The Company shall be indemnified and held harmless by the Customer against: Claims for libel, slander infringement of copyright or unauthorized use of any trade mark , trade name or service mark arising out of the material , data, information , or other content transmitted by the Customer over the Company s facilities; and Claims for patent infringement arising from combining or connecting the Company facilities with apparatus and systems of the Customer; and All other claims arising out of any act or omission of the Customer in connection with any service provided by the Company. The Carrier will make no refund of overpayments by a Subscriber unless the claim for such overpayment together with proper evidence be submitted withinone (1) year from the date of alleged overpayment unless billing records prepared by the Company can be produced which would justify a credit beyond oneyear. The preceding language does not constitute a determination by the Commission that a limitationof liability imposed by the Company should be upheld in a court of law. Acceptance for filing bythe Commissiono recognizes that it is a court' responsibility to determine the validity of theexculpatory clause. Charges are computed on an airline mileage basis as described in Section 3.2 of this tariff. Charges may vary by service offering, mileage band, class ofcall, time of day, day of week, call duration, and/or volume and term commitment. Customers are billed based on their use of LDC's long distanceservice. For servicesutilizing switched access, mileage measurements for rate schedules are based on the distance in airline miles between rate centers associated with the originating and terminatingstations. For services utilizing dedicated access, mileage measurements for rate schedules are based on the distance in airline miles between the LDC network access point associatedwith the station utilizing Dedicated Access Origination/Termination and the rate center associated withthe called/calling station. The distance between the originating and terminating points is calculated by using the "V" and "H" coordinates of the servingwire centers as defined by BellCore (Bell Communications Research), in the following manner: Step 1: Step 2: Step 3: Step 4: Step 5: Step 6: Formula: Obtain the "V" and "H" coordinates for the servingwire center or network access point serving the Customer s location and the called/calling station. Obtain the difference between the "V" coordinates. Obtain the difference between the "H" coordinates. Square the differences obtained in Step Add the squares of the "V" difference difference obtained in Step and "H" Divide the sum of the square obtained in Step 4 byten (10). Round to the next higher whole number if any fraction results from the division. Obtain the square root of the whole number obtained in Step 5. Round to the next higher whole numberif any fraction is obtained. This is the distance between the originating and terminating locationsof the call. Chargeable time begins when a connection is established between the calling station and the called station. Chargeabletime ends when either party "hangs up" thereby releasing the network connection. unless otherwise specified in this tariff the minimum call duration and rounding of calls for measurement and billing purposes is one minute. Evening Rate Period - Applies to that portion of a call occurring from 5: 00 PM to, but not including,11: 00 PM all days, unless a lower rate wouldnormally apply. Night and Weekend Rate Period - Applies to that portion of a call occurring from 11: 00 PM to, but not including 8: 00 the following morning, all days all day on Saturday and Sunday from 8: 00 AM to, but not including 5:00 PM. When a call is established in one rate period and ends in another rate period , the rate in effect at the calling station applies to the portion of the call occurring within that rate period. When a unit of time is split between two rate periods, the rate applicable to that unit of time is based on the rate period in which it began. The rate is equivalent to theEvening Rate unless a lower rate would normally apply. Holiday rates apply on New Year s Day, Independence Day, Labor Day, Thanksgiving Day and Christmas Day. Evening Rate Period rates will apply to all calls made from 8: 00 AM to, but not including, 11: 00 PM on Company-recognizedholidays. Directory Assistance A Directory Assistance charge applies per intrastate directory assistance calls made from points within the State of Idaho. The customer may make two requests for a telephone number percall. The Directory Assistance Charge applies regardless of whether the operator is able to supply the requested number. Discounts are not applicable to Directory Assistance Charges.Directory Assistance Charges are not included in usage commitments or computed in any discount calculations. A monthly service applies for the dedicated access connection. Discounts apply to total usage billing when the Subscriber commitments to a minimum term of one (1), two (2) or three (3) years. Calls are billed in one minute increments. The initial minimum call duration is one minute for billing purposes. 13.Usage Charges Per Minute $0.298 14 Plan D Service Plan D Service is available to Customers for outbound andtoll-free inbound calling using standard Customer-provided swi tched local lines. Inbound calls using the Customertoll-free number are billed to the Customer instead of the calling party. SECTION 3 - DESCRIPTION OF SERVICE AND RATES, (CONT' D . ) 15 Plan E Service Plan E Service is available to high volume usage Customers for outbound and toll-free inbound calling using standardCustomer-provided switched local lines. Inbound calls using the Customer s toll-free number are billed to the Customer instead of the calling party. To qualify for this plan , the Customer must demonstrate current usage levels of $2000 more per month in interstate and intrastate calling. The Customer may secure a lower usage rate by cornmi ting to a term plan agreement of twelve or twenty four months. Calls are billed in six (6) second increments.
