On March 17, 2006, the Commission received a notice from KMC Telecom V, Inc.
requesting to relinquish its Certificate of Public Convenience and Necessity No. 425 and cancel its
Price Lists in Idaho. The Company indicated it is no longer in operation and has no customers in
Idaho. In its Decision Meeting on April 10, 2006, the Commission determined to approve KMC'
request for cancellation of Certificate No. 423.
COMMISSION FINDINGS
In October 2003 KMC Telecom V, Inc. filed an Application with the Commission
requesting authority to provide telecommunications services within the State ofIdaho. In February
2004, the Commission granted KMC's Application for a CPCN to provide telecommunications
services within Idaho. Order No. 29426.
On March 17 2006, KMC Telecom V, Inc. notified the Commission that it does not have
any customers in Idaho and is no longer offering services in the state, and therefore requested
cancellation of Certificate No. 423 and its price list. Staff recommended the Commission cancel
Certificate No. 423 and remove the Company s price list on file.
ORDER
IT IS HEREBY ORDERED that KMC Telecom V, Inc.'s request for cancellation of
Certificate of Public Convenience and Necessity No. 423 is granted. Certificate No. 423 is no longer
in effect, and KMC Telecom V, Inc. is no longer authorized to provide service in the State ofIdaho.
THIS IS A FINAL ORDER. Any person interested in this Order or in interlocutory
Orders previously issued in this Case No. KMC-03-1 may petition for reconsideration within
twenty-one (21) days of the service date of this Order with regard to any matter decided in this Order
or in interlocutory Orders previously issued in this Case No. KMC- T -03-1. Within seven (7) days
after any person has petitioned for reconsideration, any other person may cross-petition for
reconsideration. See Idaho Code ~~ 61-619 and 61-626.
