COMMENTS OF THE
COMMISSION STAFF
COMES NOW the Staff of the Idaho Public Utilities Commission, by and through its
Attorney of record, John R. Hammond, Deputy Attorney General, in response to Order No.
29450, the Notice of Application and Notice of Modified Procedure in Case No. IZ2-04-
issued on March 22 2004, submits the following comments on IDACOMM, Inc.s Application
for a Certificate of Public Convenience and Necessity (CPCN).
BACKGROUND
On March 12 2004, IDACOMM, Inc. filed an Application for a Certificate of Public
Convenience and Necessity to provide resold and facilities-based local exchange services and
emerging telecommunications services throughout the State ofIdaho. IDACOMM is a wholly
owned subsidiary of IDA CORP, Inc. IDACOMM operates as a separate entity from its parent
corporation. IDACOMM is organized under the laws ofIdaho. The Company has filed a copy
of its Certificate of Authority issued by the Idaho Secretary of State. IDACOMM currently
provides advanced data communications and internet services in Idaho, and currently operates
high speed fiber optic rings in Ada and Canyon counties.
STAFF COMMENTS APRIL 12, 2004
Staff has reviewed the information provided by IDACOMM in its application and
believes it satisfies the requirements of the Commission s Rule of Procedure Ill , IDAP A
31.01.01.111 , and Procedural Order No. 26665 issued November 7, 1996, which sets out the
necessary information to be included with an application for a certificate.
The application indicated IDACOMM intended to initially provide high speed data
communications services to small and medium sized businesses, and gradually expand to
bundling local exchange and long distance products with the existing data products, and also
gradually expanding to the residential market. The application indicated the Company would
provide local exchange services through a combination of its own facilities, leased facilities and
unbundled network elements, as well as resold services. The application indicated the Company
would initially provide service in the area currently served by Qwest, starting in the treasure
valley, and expanding to other communities in Southern Idaho.
The application included financial information about the company that indicated the
Company was in a satisfactory financial position. Staff is satisfied that the Company has the
technical, managerial and financial strength to provide the services identified in the application.
IDACOMM specifically indicated in its application it will comply with all Commission
rules. It has provided an illustrative tariff with its application that demonstrates an understanding
of tariff requirements and processes.
STAFF RECOMMENDATION
Staff recommends that a Certificate of Public Convenience and Necessity to provide
competitive local exchange service in Idaho be provided to IDACOMM, Inc.
