HomeMy WebLinkAbout20190819final_order_no_34414.pdfOffice of the Secretary Service Date August 19,2019 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION IN THE MATTER OF MITEL CLOUD SERVICES,)INC.'S REQUESTFOR CANCELLATION OF )CASE NO.ITN-T-09-01 CERTIFICATE OF PUBLIC CONVENIENCE AND ) NECESSITY NO.499 )ORDER NO.34414 On July 31,2019,Mitel Cloud Services,Inc.(Mitel)requested that its Certificate of Public Convenience and Necessity (CPCN or Certificate)No.499 be cancelled.In its Decision Meeting on August 13,2019,the Commission addressed Mitel's request to cancel Certificate No. 499. COMMISSION FINDINGS In January 2010,the Commission issued Order No.30995 granting Mitel a CPCN to provide competitive local exchange telecommunications service within the State of Idaho. Certificate No.499 was issued to Mitel. On March 20,2015,Mitel notified the Commission that it had changed the name under which it did business from Mitel NetSolutions,Inc.to Mitel Cloud Services,Inc.In April 2015, the Commission amended Certificate No.499 to reflect the name change.Order No.33263. On July 31,2019,the Commission received a letter asking that Mitel be allowed to cancel Certificate No.499.Mitel stated that its services have continued to evolve since its CPCN was granted,and that "it services its customers through VoIP and a variety of nomadic interconnected services as well as private business communication and collaboration solutions." In short,Mitel asserts that it no longer offers local exchange service to its customers.See Order No.32059;Idaho Code §§62-603(13)and 62-604(1)(a).Mitel states that Certificate No.499 is no longer necessary for it to do business in Idaho. Staff reviewed the request and agreed with Mitel that its certificate should be cancelled. We find that the service offerings of Mitel are outside this Commission's authority and do not require a CPCN. Consequently,we cancel Certificate No.499 and direct Staff to remove Mitel's tariff on file. ORDER NO.34414 1 ORDER IT IS HEREBY ORDERED that Mitel's request for cancellation of CPCN No.499 is granted.Certificate No.499 will no longer be in effect upon the issuance of this Order. THIS IS A FINAL ORDER.Any person interested in this Order may petition for reconsideration within twenty-one (21)days of the service date of this Order with regard to any matter decided in this Order.Within seven (7)days after any person has petitioned for reconsideration,any other person may cross-petition for reconsideration.See Idaho Code §§62- 619 and 61-626.
