The Company reserves the right to terminate
services in accordance with rules found in IDAPA
31.D.
Service Offering
Calculation of Distance.Calls are measured, based on airline
distance between the rate center of the
customer terminal or switch location
to the rate center of the destination ofthe call.
1. 2 The distance between the rate centers of
the customer switch and destinationpoint is calculated by using thevertical ("and horizontal ("
coordinates found in AT&T Tariff FCC No.
10, in the following manner.
1.2.Formula
Step 1- Obtain the "V" and "H" coordinates for
the Subscriber s switch and the destination point.
Step 2- Obtain the difference between the "
coordinates of each of the rate centers. Obtain
the difference between the "H" coordinates.

Description of ServicesThe Company endeavors to provide high
quali ty service. All network access is
moni to red and engineered to provide a01 grade of service (99% call
completion ratio). Service is available
24 hours per day, 7 days a week, subj ectto routine maintenance and outages
beyond the control of the Company. The
Company equipment is designed and
engineered to provide high quality
transmission of voice and data with a
minimum level of impairment such noise and echo. However, overall
quali ty may vary somewhat due to the
variabili ty in quali ty of theconnections provided by the localtelephone companies and other
interexchange carriers which is beyond
the Company s control.
The service provided is an automated collect onlyservice, offered only wi thin correctionalfacili ties for the exclusive use of inmates.

(7) days a week.
The Company s service agreements are ineffect for the duration of Agreements
between Inmate Phone Systems Corporation
and Operator Service Provider Customers.

The Company shall not be liable for claimor loss, expense or damage (including
indirect, special or consequential damage),for any interruption, delay, error,omission, or defect in any service,facili ty or transmission provided under
this tariff, if caused by any person or
enti ty other than the Company, by any
malfunction or any service or facility
provided by any carrier, by an act of God,fire, war, civil disturbance, or act
government, or by any other cause beyond
the Company s direct control.
The Company shall not be liable for, andshall be fully indemnified and held
harmless by Operator Service Provider
Customer, Telephone Caller and/or TelephoneCustomer against any claim or loss,
expense, or damage (including indirect,special or consequential damage) for
defamation, libel, slander, invasion
infringement of copyright or patent,
unauthorized use of any trademark, trade
name or service mark, unfair competition,interference with or misappropriation or
violation of any proprietary or creative
right, or any other injury to any person,

property or entity arising out of thematerial, data, information, or othercontent revealed to, transmitted, or usedby the Company under this tariff; or for
any act or omission of the Operator ServiceProvider Customer, Telephone Caller and/orTelephone Customer or for any personalinjury or death of any person caused
directly or indirectly by the installation,maintenance, location, condi tion,operation, failure, presence, use,
removal of equipment or wiring provided bythe Company, if not directly caused by
negligence of the Company.
The Company shall not be liable for any
defacement of or damages to the premises ofOperator Service Provider Customer
resul ting from the furnishing of service
which is not the direct result of the
Company s negligence.
4 No agent or employee of any other carrier
or Company shall be deemed to be an agent
or employee of the Company.

The above tariff language does notconstitute determination by the
Commission that a limitation of liability
imposed by the Company should be upheld in
a court of law. Acceptance for filing bythe Commission recognizes that it is
court'responsibility to adjudicatenegligence and consequential damage claims.It is also the court'responsibility to
determine the validity of the exculpatoryclause.
