ING-T-09-1 COMMENTS OF THE COMMISSION STAFF COMES NOW the Staff of the Idaho Public Utilties Commission, by and through its Attorney of record, Kristine A. Sasser, Deputy Attorney General, and in response to the Notice of Application and Notice of Modified Procedure issued in Order No. 30819 on May 21,2009 in Case No. ING-T-09-01, submits the following comments. BACKGROUND iNetworks Group, Inc. intends to offer service throughout all exchanges curently served by Citizens, Qwest and Verizon. The Company asserts that it is curently in negotiations to complete interconnection agreements. The Company believes that granting its Application for a CPCN will furher the public interest by expanding the availabilty of competitive telecommunications services in the State of Idaho. The Company maintains that it will provide Idaho customers with access to new technologies and service choices. STAFF COMMENTS 1 JUE 11,2009 The Company states that it possesses the requisite financial, managerial, and technical capacities to provide the proposed services. The Company does not intend to collect deposits or .require advance payments from customers and, therefore, requests a waiver of the Commission's escrow account/security bond requirement. STAFF ANALYSIS iNetworks Group, Inc. initially fied its Application and ilustrative tarff on Januar 29, 2009. Staff and the Company's counsel have worked through many filings and iterations to bring the Application and ilustrative tarff into compliance with Idaho statutes and the Commission's Customer Relation's Rules. iNetworks Group has also expressly agreed to comply with all federal numbering guidelines along with number porting requirements. STAFF RECOMMENDATION Staffrecoinends that iNetworks Group, Inc. be granted a CPCN subject to the following conditions: 1. The Company will comply with the Number Pool Administrator and Idaho Commission Order No. 30425, which requires NRUF and utilzation reporting. 2. As a provider of intrastate regulated local exchange services and in accordance with the Commission's Rules of Procedure, iNetworks Group, Inc. wil be required to report and contribute, as appropriate, to the Idaho Universal Service Fund, Idaho Telecommunications Relay System, ITSAP and any requisite anual reporting that may be deemed appropriate in the futue for competitive telecommunication providers. 3. Upon Approval of this Application, iNetworks Group, Inc. wil issue a final price list under Case Number ING-T-09-0L. At which time a certificate wil be issued. 4. The Company agrees that it will relinquish its certificate and any telephone numbers if it is not doing business within one year of its issuance of a CPCN. 5. Because the Company has requested a waiver of the Escrow Account requirement and it will not be collecting deposits, Staff recommends approval.
