BASIC TELECOMMUNICATIONS SERVICE THROUGHOUT IDAHO; CASE NO. IGL-T.18.01. On April 19,2018, Intermountain Infrastructure Group, LLC ("IIG" or "Company") filed an Application with the Commission, per Procedural Order No. 32277 and IDAPA 3l.0l.01.I14, for registration as a facilities-based provider of non-basic local telecommunications services within the State of Idaho. Application at l. At the May 7,2018, Commission Decision Meeting, the Commission approved the processing of this matter under Modified Procedure with a 2l-day comment period. However, subsequent to that meeting Staff entered into discussions with the Idaho Transportation Department ("lTD") in order to better understand the requirements of similarly situated communications companies attempting to utilize public rights-of-way as "utilities" and to coordinate state agency responses thereto. STAFF RECOMMENDATION In order to allow more time for coordination between Staff and ITD, and for Staff to continue to attempt to determine whether and how fiber installations in public rights-of-way fall within the jurisdiction of the Commission, Staff recommends that the Commission continue to process the Company's Application under Modified Procedure but with a 60-day comment period. This procedural change was consented to by the Company's representative.
