" "d" - '-' ' ; APPLICATION OF TARIFF This tariff sets forth the service offerings, rates, terms and conditions applicable to the furnishing of resold intrastate End-User communications services in the State of Idaho by ICG Telecom Group, Inc. Flavin Senior Director, Government and External Affairs PAGE: Original Idaho Public Utilities Commission Office of the Secretary ACCEPTED FOR FILING MAR 3 - 1999 ICG TELECOM GROUP, INC.(.4W~ptance Stamp) 1.0 DEFINITIONS F or the purpose of this tariff, the following definitions will apply: Access: Is connection to one carrier by a second carrier to obtain the services of any or all network facilities and services within the network, including unbundled elements. Access Service ues R:): A written request for special access services executed by the Customer and the Company in the format devised by the Company. The signing of an ASR by the Customer and acceptance by the Company initiates the respective obligations of the parties as set forth therein and pursuant to this tariff, but the duration of the service is calculated from the Service Commencement Date. Should a Customer use the Company s access service without an executed ASR, the Company will then request the Customer to submit one. Account Codes: Permits Centrex Stations and attendants to dial an account code number of up to eight digits. F or use when placing calls over facilities arranged for Automatic Message Accounting (AMA) recording. The account or project number must be input prior to dialing the called number. Advance P ment: Part or all of a payment required before the start of service. Alternative O erator Services: Alternative Operator Services are those services provided by the carrier in which the customer and the End User are totally separate entities. The carrier contracts with the customer to provide the alternative operator services; however, the carrier does not directly contract with the End User to provide the services even though it is the End User who actually pays for the processing of the operator assisted calls. The primary purpose of ANI is to allow for billing of toll calls. Automatic Location Identification (ALl): An E911 feature that provides the name or address or both associated with the calling party s telephone number (identified by ANI as defined below) to the PSAP for display. Additional telephones with the same number as the calling party's (secondary locations, off-premise extensions etc.) are identified with the address of the telephone number at the main location. Bit: The smallest unit of information in the binary system of notation. Collocation: An arrangement whereby the Company s switching equipment is located in a local exchange Company s central office. Commission: The Idaho Public Utilities Commission. Communications Services: The Company s intrastate toll and local exchange switched telephone services offered for both intraLA T A and interLA T A use. Com or Carrier: ICG Telecom Group, Inc. Customer or Subscriber: The person, firm or corporation which orders service and is responsible for the payment of charges and compliance with the Company regulations. This service is offered to the extent facilities are available and where the Company and the Customer jointly arrange for the establishment of dedicated access facilities connecting the Customer s trunk-compatible PBX or other suitable equipment to the Company s POP. The Customer shall be responsible for all costs and charges associated with the dedicated access facilities. Dedicated Outbound Calls: Refers to service that is offered to the extent facilities are available in those cases where the Company and the Customer jointly arrange for the establishment of dedicated access facilities connecting the Customer s trunk- compatible PBX or other suitable equipment to the Company s (POP). The Customer shall be responsible for all costs and charges associated with the dedicated access facilities. osit: Refers to a cash or equivalent of cash security held as a guarantee for payment of the charges. DID Trunk (Direct Inward Dial Trunk): A form of local switched access that provides the ability for an outside party to call an internal extension directly without the intervention of the Company operator. Dial Pulse (or "DP" ): The pulse type employed by rotary dial station sets. Dual Tone Multi-Freauencv (or "DTMF" ): The pulse type employed by tone dial station sets. lex Service: Service which provides for simultaneous transmission in both directions. Emer enc Number Service: A telephone exchange communication service whereby a Public Safety Answering Point (PSAP) designated by the Customer may receive telephone calls dialed to the telephone number 911. The 911 Services includes lines and equipment necessary for transferring and dispatching public emergency telephone calls originated by persons within the telephone central offices areas arranged for 911 calling. mer enc Service umber : An ESN is a Selective Routing (SR) code assigned to each telephone number in an exchange where SR is provided to route E911 calls to an appropriate PSAP. The ESN defines the set of emergency services (e., police, fire, PSAP and medical) within a particular serving area. An ESN is associated with a primary possibly one or more secondary PSAPs. Emer enc Tele hone Service Char e: A charge for the network start-up costs custom notification costs, billing costs including an allowance for uncollectibles and network nonrecurring and recurring installation, maintenance, service, and equipment network charges of the Company providing 911 service. Exchan e Tele hone Com or Tele hone Company Denotes any individual partnership, association, joint-stock company, trust, or corporation authorized by the appropriate regulatory bodies to engaged in providing public switched communication service throughout an exchange area, and between exchange areas within the LATA. Fiber O tic Cable: A thin filament of glass with a protective outer coating through which a light beam carrying communications signals may be transmitted by means of multiple internal reflections to a receiver, which translates the message. Hearin aired: Those persons with communication impairments, including those hearing impaired, deaf, deaf/blind, and speech impaired persons who have an impairment that prevents them from communicating over the telephone without the aid of a telecommunications device for the deaf. Huntin Routes a call to an idle station line in a prearranged group when the called station line is busy. Gettin Started Packa e: Refers to package Company gives to each new customer. IXC or Interexchan e Carrier: A long distance telecommunications services provider. s: Kilobits per second, denotes thousands of bits per second. LATA: A Local Access and Transport Area established pursuant to the Modification of Final Judgment entered by the United States District Court for the District of Columbia in Civil Action No. 82-0192; or any other geographic area designated as a LATA in the National Exchange Carrier Association, Inc. Tariff F .C. No. Local Interconnection Trunkin Service: A local circuit administration point, other than a cross-connect or an information outlet, that provides capability for routing and re-routing circuits. s: Megabits, denotes millions of bits per second. Minimum Point of Presence ("MPOP" ): The main telephone closet in the Customer s building. Monthl Recurrin Char es: The monthly charges to the Customer for services which continue for the agreed upon duration of the service. " ,...--, .. 1.0 DEFINITIONS (cont' 911 Service Area: The geographic area in which the Company will respond to all 911 calls and dispatch appropriate emergency assistance. 911 Trunks: Trunks between a serving central office and a PSAP or between two central offices, except where one of the central offices is a remote unit. Non-Pro rietary Callin Card: Refers to a calling card or travel card which can be billed by any carrier and used on any network, such as an Ameritech card issued in conjunction with local services; as opposed to a card issued by an IXC which can only be used on that carrier s network and billed by that carrier. on-Recurrin : The initial charge, usually assessed on a one-time basis, to initiate and establish service. NP A: Numbering plan area or area code. NXX: First three digits in a local phone number. Identifies the specific telephone company central office which serves that number. Off-Net: A means for carrying traffic to or from the Customer s premises, where the Company leases Other Telephone Company s facilities to deliver traffic to Customer location. (Off-Net traffic consists of all traffic that is not considered to be On-Net traffic. The liability of the Company for errors in billing that result in overpayment by the Customer shall be limited to a credit equal to the dollar amount erroneously billed or, in the event that payment has been made and service has been discontinued, to a refund of the amount erroneously billed. Such causes shall include, without limitation, acts of God, fire, explosion vandalism, cable cut, storm or other similar occurrences, any law, order regulation, direction, action or request of the United States government or of any other government (including state and local governments or of any department agency, board, court, bureau, corporation or other instrumentality of anyone or more of said governments) or of any civil or military authority, national emergencies, insurrections, riots, wars strikes, lockouts or work stoppages or other labor difficulties, supplier failures, shortages, breaches or delays. If Company s failure of performance by reason of force majeure specified above shall be for thirty (30) days or less, then the service shall remain in effect, but an appropriate percentage of charges shall be abated and/or credited in the discretion and determination of Company; if for more than thirty (30) days, then the service may be canceled by either party without any liability. Generally, such activities are not specific to an individual Customer but affect many Customers' services. No specific advance notification period is applicable to all service activities. The Company will work cooperatively with the Customer to determine the reasonable notification requirements. With some emergency or unplanned service-affecting conditions, such as an outage resulting from cable damage, notification to the Customer may not be possible. 1.6 Non-Routine Installation At the Customer s request, installation and/or maintenance may be performed outside the Company s regular business hours, or in hazardous locations. If installation is started during regular business hours but, at the Customer s request, extends beyond regular business hours into time periods including, but not limited to weekends, holidays, and/or night hours, additional charges may apply. The Company will release such information via the Data Management System only after a 911 call has been received, on a call by call basis, only for the purpose of responding to an emergency call in progress. The 911 calling party, by dialing 911 , waives the privacy afforded by non-listed and non-published service to the extent that the telephone number, name, and address associated with the originating station location are furnished to the Public Safety Answering Point. The Company may require applicants for service who intend to use the Company s offerings for resale and/or for shared use to file a letter with the Company confirming that their use of the Company s offerings complies with relevant laws and the Commission s regulations, policies, orders, and decisions. The Company may block any signals being transmitted over its Network by Customers which cause interference to the Company or other Users. Customer shall be relieved of all obligations to make payments for charges relating to any blocked service and shall indemnify the Company for any claim, judgment or liability resulting from such blockage. A Customer, joint User, or authorized User may not assign, or transfer in any manner, the service or any rights associated with the service without the written consent of the Company. The Company will permit a Customer to transfer its existing service to another entity if the existing Customer has paid all charges owed to the Company for regulated communications services, Such a transfer will be treated as a disconnection of existing service and installation of new service, and non-recurring installation charges as stated in this tariff will apply. When billing is based upon Customer usage, usage charges will be billed monthly for the preceding billing period. When service does not begin on the first day of the month, or end on the last day of the month, the charge for the fraction of the month in which service was furnished will be calculated on a pro rata basis. Upon nonpayment of an undisputed delinquent account amounting to the lesser of $50.00 or two (2) months' charges for local exchange service owing to the Company, the Company may, by giving fifteen (15) business days prior written notice to the Customer, discontinue service without incurring any liability. The Company shall provide the customer with a written reminder notice five ~i7)days prior to and place a telephone call to the customer two (2) days prior to the discontinuance of service. Service may be reinstated at such time as Customer pays in full all arrearages, including late payment charges. Upon violation of any of the other material terms or conditions of this tariff the Company may discontinue service without incurring any liability. Company shall give Customer fifteen (15) days notice of discontinuance to give Customer an opportunity to arrange for an alternate service provider. If a casualty renders all or any material portion of the facilities of the underlying carrier used by the Company to provide service to a Customer inoperable beyond feasible repair, the Company, upon written notice to the Customer, may discontinue or suspend service without incurring any liability. U sa e Based Char Where charges for a service are specified based on the duration of use, such as the duration of a telephone call, the following rules apply: 1 Calls are measured in durational increments identified for each service. All calls which are fractions of a measurement increment are rounded-up to the next whole unit. 2 Timing on completed calls begins when the call is answered by the called party. Answering is determined by hardware answer supervision in all cases where this signaling is provided by the terminating local carrier and any intermediate carrieres). MTS enables a User of an exchange access line to place calls to any station on the public switched telecommunications network bearing an NP A - NXX designation associated with points outside the Customer s Local Calling Area, but within the boundaries of the state of Idaho. Each MTS call is billed in 6 second increments after an initial billing period of seconds. At the completion of each Billing Period, the total number of minutes will be rounded to the nearest minute. The Customer may alternate between the two calls by operation of the switch hook, but a three-way conference call cannot be established. Three Wa Callin : Permits the end-user to add a third party to an established connection, When the third party answers, a two-way conversation can be held before adding the original party for a three-way conference. The end-user initiating the conference controls the call and may disconnect the third party to reestablish the original connection or establish a connection to a different third party. The feature may be used on both outgoing and incoming calls. Call Forwardin : Permits the end-user to automatically forward (transfer) all incoming calls to an end-user designated telephone number, and permits the end- user to restore incoming calls to non Call Forwarding operation. Missed Call Dialin : Allows the Customer to return a call to the last incoming call whether the Customer answered the call or not. Upon activation, Miss Call Dialing will re-dial the number automatically and continue to check the number every 45 seconds for up to 30 minutes if the number is busy. The Customer is alerted with a distinctive ringing pattern when the busy number is free. When the Customer answers the ring, the call is then completed. The line is checked every 45 seconds for up to 30 minutes and alerts the Customer with a distinctive ringing pattern when the busy number and the Customer s line are free. The Customer can continue to make and receive other calls while the feature is activated. Call Forwardin Bus : Permits the forwarding of incoming calls when the end- user s line is busy. The forwarded number is fixed by the end-user s service order. Call Forwardin No Answer: Permits the forwarding of incoming calls when the end-user s line remains unanswered after end user designated number of rings. The number of rings and the forwarded number are fixed by the Customer service order, Call Forwardin Selective: Permits the end-user to automatically forward (transfer) calls from up to ten end-user pre-selected number to another telephone number and to restore it to normal operation at their discretion. Call Forwarding Selective can be used in conjunction with Call Forwarding. Sneed Callini! (8 or 30): Permits the Customer to place calls to other telephone numbers by dialing a one- or two-digit code rather than complete telephone numbers. The feature is available as an eight code list or a thirty code list. Either code list may include local and/or toll telephone numbers. To establish or change a telephone number in a code list, the Customer dials an activating code, receives a second dial tone and dials either a one- or two-digit code (for the eight code and thirty code lists, respectively) plus the telephone number. B channels can be aggregated for higher bandwidth applications. The D channel PRI provides the out of band signaling, call control and messaging. The programs are jointly sponsored (federal and state) telephone assistance programs designed to maximize federal contributions to Idaho s low-income customers. The programs provide reductions in monthly rates for single line telephone service and! reductions in one-time costs for installation of telephone service for qualifying customers. Linkup Discounts Linkup Discounts - applied to installation of new service, including line extensions construction of facilities, etc., but shall not apply to customer premises facilities or equipment. A service installation cost reduction of 50% up to $30,00. For an eligible resident of Tribal Lands, an additional reduction of up to $70 maybe applied to cover 100% of the charges between $60 and $130 assessed for initiating telephone service. Up to $70, 10.1.5 Rules Applies to Telecommunication service at the principal residence of the eligible subscriber/head of household, A household is either an individual living alone or a group of individuals living together in common living quarters and facilities under such domestic arrangements and circumstances as to create a single establishment. The eligible participant can receive assistance with telephone service installation costs only once at a residential address. However, if the participant moves to a new address, meets the eligibility criteria and is in good standing with the telephone service provider, there is no limit to the number of times the participant may receive assistance with telephone costs. Nonrecurring charges to change to or from this program because of change in eligibility status will be waived, Lifeline service is not available for foreign exchange service. Only one line per household will qualify for ITSAP discounts. Verification of eligibility will be established by the Department of Health and Welfare and will be reviewed annually, When the customer is no longer eligible, the discount will be discontinued and regular tariff rates and charges will apply. Recovery The cost of providing assistance through ITSAP shall be recovered by imposing a monthly surcharge determined by the Public Utilities Commission and assessed on each line used for providing residential and business access. Signaling The Company and the IXC Customer shall establish Signaling System 7 ("SS7") connectivity to provide call set up time and call tear down capabilities, etc., as specified in Bellcore TR-NWT- 000394 and TR-TSV-000905, or multi-frequency (MF) signaling to support the Service, Such SS7 connectivity may be directly between the Parties or may be between a third party SS7 hub provider and the Parties. 11,IfSS7 connections are made via a third party, the IXC shall be responsible for installing, maintaining and paying for such SS7 links to the Company. 11.2 If SS7 connections are made to Company s Signal Transfer point (STPs), the IXC will be responsible for installing, maintaining and paying for appropriate links to Companys STPs. The design and operation of the SS7 interconnection links shall be tested and must be approved by both Parties prior to the provision of Service.
