GST-T-99-1 AMENDED PROCEDURAL ORDER ORDER NO. 28194 This arbitration case was initiated on August 26, 1999, when GST Telecom Idaho, Inc. filed a Petition for Arbitration pursuant to Section 252(b) of the federal Telecommunications Act of 1996. The purpose of the arbitration is to complete terms for an interconnection agreement between GST and U S WEST Communications, Inc. On September 23, 1999, the Commission issued a Procedural Order, Order No. 28162, establishing a schedule to process and complete the arbitration. The Order noted the deadline for a final Arbitration Order pursuant to Section 252(b)(4)(C) would be December 19, 1999, unless waived by the parties. Following issuance of Order No. 28162, the parties negotiated privately and agreed to alter the procedural schedule set forth in that Order. To accommodate the new schedule, the parties also have waived the statutory requirement that the Commission issue a final decision by December 19, 1999. Accordingly, based on the agreement of the parties, the Commission finds it appropriate to adopt a new procedural schedule as identified by the parties. Therefore, the following schedule is adopted for this case: Direct testimony of the parties filed Rebuttal testimony of the parties filed Hearing convenes Post-Hearing Briefs filed Arbitrator’s initial decision Exceptions to Arbitrator’s Decision Response to Exceptions filed with Arbitrator Arbitrator’s final decision Exceptions to Arbitrator’s decision filed with the Commission November 12, 1999 November 24, 1999 December 8-9, 1999 December 20, 1999 January 14, 2000 January 28, 2000 February 4, 2000 February 11, 2000 February 18, 2000 The hearing will convene on DECEMBER 8, 1999 IN THE COMMISSION’S HEARING ROOM, LOCATED AT 472 W. WASHINGTON STREET, BOISE, IDAHO. Following the filing of the Arbitrator’s final decision and exceptions with the Commission, the parties contemplate an opportunity for oral argument before the Commission. The Commission will schedule an oral argument, which may be conducted by telephone conference, following the filing of exceptions with the Commission. O R D E R IT IS HEREBY ORDERED that the schedule set forth above is adopted by the Commission to process this arbitration proceeding.
