COMMENTS OF THE
COMMISSION STAFF
COMES NOW the Staff of the Idaho Public Utilities Commission, by and through its Attorney of record, Weldon B. Stutzman, Deputy Attorney General, in response to Order
No. 28285, the Notice of Application and Notice of Modified Procedure in Case No.
GNR-T-99-21 issued on February 15, 2000, submits the following comments.
BACKGROUND
On October 22, 2000, Pac-West Telecomm, Inc. filed an Application for a Certificate of Public Convenience and Necessity (CPCN) in compliance with Commission Rules of Procedures, IDAPA 31.01.01.111 and Procedural Order No. 26665. Pac-West is seeking authorization to provide all forms of facilities-based and resold local and long distance services to both business and residential customers within the state of Idaho. Specifically, Pac-West's accompanying tariff references local dial tone, 1+ long distance service, and some feature services such as call forwarding and caller ID. The Applicant intends to lease transport facilities and use its own switching facilities to provide these services. At present, Pac-West has not obtained an interconnection agreement but has requested to negotiate an interconnection agreement with U S WEST Communications, Inc.
Pac-West is a California corporation that received authorization to operate in California as an interexchange carrier in March of 1992, and as a competitive local exchange carrier in December of 1995. Pac-West does not own any subsidiaries or maintain an office in Idaho but does have a registered agent for this state. The Applicant intends to offer service in Idaho beginning in the first quarter of 2000.
DISCUSSION
Staff has reviewed the Application submitted by Pac-West and believes the Company understands and agrees to comply with the Commissions rules and requirements.
STAFF RECOMMENDATION
Based on Staffs review of Pac-West's Application, Staff believes that Pac-West's filing has satisfied all the requirements of the Commissions Rules and Procedural Order No. 26665. Therefore, Staff recommends approval of the Application for Certificate of Public Convenience and Necessity.
