FOR A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY TO PROVIDE LOCAL EXCHANGE TELECOMMUNICATIONS SERVICES. ) ) ) ) ) ) ) CASE NO. GNR-T-99-17 ORDER NO. 28268 On August 23, 1999, an Application was filed by HJN Telecom, Inc. (HJN) for a Certificate of Public Convenience and Necessity to provide local exchange telecommunications services within the state of Idaho. According to the Application, HJN intends to resell the local exchange services provided by GTE Northwest and U S WEST. The Application states that HJN does not intend to provide service in the areas of the state where the local exchange carrier is eligible for a rural carrier exemption pursuant to Section 251 of the Telecommunications Act of 1996. On December 21, 1999, the Commission issued a Notice of Application and Notice of Modified Procedure to process the Application. During the comment period, written comments were filed only by the Commission Staff. Staff reviewed the Application and stated that it complies with the Commission’s rules and procedural Order setting forth the requirement of an Application for a Certificate. Staff noted that HJN has been authorized to provide Title 62 services in the state, and as a Title 62 service provider has been late in reporting and paying Universal Service Fund (USF) and Telecommunications Relay Services (TRS) administration fees, as well as its regulatory fees. Staff recommended approval of HJN’s Application for a Certificate, with a reminder that HJN provide prompt reports and payments to the USF and TRS Administrators. COMMISSION FINDINGS Based on our review of the record, including the filed written comments and Staff’s recommendation, we find that the Application of HJN complies with Procedural Order No. 26665 and the Commission’s Rules to obtain a Certificate of Public Convenience and Necessity. We therefore approve HJN’s Application for a Certificate authorizing it to provide local telecommunication services within Idaho. As a competitive local telecommunications provider, HJN is subject to certain requirements of Idaho Code Title 61 and 62, including obligations to remit appropriate fees to the USF and TRS Administrators and the Commission. O R D E R IT IS HEREBY ORDERED that HJN Telecom, Inc. is granted a Certificate of Public Convenience and Necessity to provide local telecommunications services within Idaho. THIS IS A FINAL ORDER. Any person interested in this Order may petition for reconsideration within twenty-one (21) days of the service date of this Order. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code § 61626.
