FOR A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY TO PROVIDE LOCAL EXCHANGE TELECOMMUNICATIONS SERVICES. ) ) ) ) ) ) ) CASE NO. GNR-T-99-16 ORDER NO. 28188 On August 23, 1999, MVX.COM Communications, Inc. (MVX.COM) filed an Application for a Certificate of Public Convenience and Necessity to provide competitive local exchange services within the state of Idaho. MVX.COM is a California corporation and a wholly-owned subsidiary of MVX.COM, Inc., also a California corporation. The Company proposes to resell local exchange service to residential and business customers in the U S WEST and GTE service areas, using the facilities of the incumbent local exchange carrier. On September 10, 1999, the Commission issued a Notice of Application and Notice of Modified Procedure. During the period for the filing of written comments, only the Commission Staff filed comments. Staff recommended approval of MVX.COM’s Application. COMMISSION FINDINGS Based on our review of the record, including the filed written comments and Staff’s recommendation, we find that the Application of MVX.COM Communications, Inc., complies with Procedural Order No. 26665 and the Commission’s Rules to obtain a Certificate of Public Convenience and Necessity. We therefore approve MVX.COM’s Application for a Certificate to provide local exchange telecommunications services within the areas of the state served by U S WEST and GTE Northwest Incorporated. O R D E R IT IS HEREBY ORDERED that MVX.COM Communications, Inc. is granted a Certificate of Public Convenience and Necessity to provide local telecommunications services within the areas of Idaho currently served by U S WEST and GTE Northwest Incorporated. THIS IS A FINAL ORDER. Any person interested in this Order may petition for reconsideration within twenty-one (21) days of the service date of this Order. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code § 61626.
