GNRT9914 ORDER NO. 28330 On August 19, 1999, Triad Communications of Idaho filed an Application for a Certificate of Public Convenience and Necessity in compliance with Commission Rules of Procedure, IDAPA 31.01.01.111 and Procedural Order No. 26665 to provide data transmission services in Idaho. Staff advised Triad Communications that the Idaho PUC does not issue certifications for data transmission. Staff further advised Triad Communications that the Commission only issues a Certificate of Public Convenience and Necessity for basic local service. On March 15, 2000, pursuant to Commission Rule 67 (IDAPA 31.01.01.067), Triad Communications requested that its Application be withdrawn without prejudice. Triad asked to reserve the right to re-apply at such time as it will provide local services regulated by the Commission. Based upon a review of the Application, the Commission rules, and the Staff’s comments, the Commission grants Triad’s request to withdraw its Application. O R D E R IT IS HEREBY ORDERED that Triad Communications, Inc.’s Application for a Certificate of Public Convenience and Necessity is withdrawn and Case No. GNR-T-99-14 is closed. THIS IS A FINAL ORDER. Any person interested in this Order or in interlocutory Orders previously issued in this Case No. GNR-T-99-14 may petition for reconsideration within twenty-one (21) days of the service date of this Order with regard to any matter decided in this Order or in interlocutory Orders previously issued in this Case No. GNR-T-99-14. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code  61626.
