GNR-T-99-12 ) ) CERTIFICATE NO. 368 ) ) ORDER NO. 29088 On July 17, 2002, Comm South Companies, Inc. notified the Commission that it is not conducting business in Idaho and has no plans to enter the market in the foreseeable future. Consequently, Comm South requested "the withdrawal" of its Certificate of Public Convenience and Necessity, No. 368, issued by the Commission on February 3, 2000. Based upon the request of the Company, the Commission finds that it is appropriate to cancel Comm South's Certificate of Public Convenience and Necessity No. 368. Order No. 28243 approving Comm South's Application to conduct business also required the Company to acquire a performance bond in the amount of $50,000. Given the request to withdraw its Certificate, the bond requirement is also cancelled 1.0 11 Alls-03 IT IS HEREBY ORDERED that Comm South's request to withdraw its Certificate of Public Convenience and Necessity is granted. The Commission hereby cancels Certificate No. 368 granted to Comm South Companies. IT IS FURTHER ORDERED that the requirement to obtain a bond set out in Order No. 28243 is rescinded. THIS IS A FINAL ORDER. Any person interested in this Order (or in issues finally decided by this Order) or in interlocutory Orders previously issued in this Case No. GNR-T-99-12 may petition for reconsideration within twenty-one (21) days of the service date of this order with regard to any matter decided in this Order or in interlocutory Orders previously issued in this Case No. GNR-T-99-12. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code §§ 61-626 and 61-619..
