FOR A CERTIFI­CATE OF PUBLIC CONVENIENCE AND NECESSITY TO PROVIDE LOCAL EXCHANGE TELECOMMUNICATIONS SERVICES. ) ) ) ) ) ) CASE NO.  GNR-T-98-9 ORDER NO.  27955 On July 1, 1998, ICG Telecom Group, Inc. (ICG) filed an Application for a Certificate of Public Convenience and Necessity.  To satisfy the requirements of the Commission’s Rules of Procedure and Procedural Order No. 26665, ICG filed revisions to its Application on September 25, 1998 and December 18, 1998.  By its Application, ICG seeks authority to provide local exchange service pursuant to Title 61, Idaho Code, to Idaho residences and businesses within the U S WEST and GTE service areas of the state.   ICG is a privately-held Colorado corporation, and is a wholly-owned subsidiary of ICG Holdings, Inc.  ICG was formed in 1993 to provide all forms of telecommunication services, including resold and facilities-based local exchange and interexchange services.  ICG currently is authorized to provide local exchange services in fourteen states.  The Company plans to provide local exchange services primarily to business customers, and will initially provide only resold local exchange services. On January 15, 1999, the Commission issued a Notice of Application and Notice of Modified Procedure to process the Application.  See IDAPA 31.01.01.201-204.  Written comments were filed during the comment period only by the Commission Staff.  Staff stated that ICG’s filings meets the requirements of the Commission’s rules and requirements for approval of an Application for a Certificate of Public Convenience and Necessity.  Staff therefore recommends that ICG’s Application be approved. COMMISSION FINDINGS Based on our review of the record, including the filed written comments and Staff’s recommendation, we find that the Application of ICG Telecom Group, Inc., complies with Procedural Order No. 26665 and the Commission’s Rules to obtain a Certificate of Public Convenience and Necessity.  We therefore approve ICG Telecom’s Application for a Certificate to provide local exchange telecommunications service in the areas of the state served by U S WEST and GTE. O R D E R IT IS HEREBY ORDERED that ICG Telecom Group, Inc. is granted a Certificate of Public Convenience and Necessity to provide local telecommunications service in those areas of the state served by U S WEST and GTE. THIS IS A FINAL ORDER.  Any person interested in this Order may petition for reconsideration within twenty-one (21) days of the service date of this Order.  Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration.  See Idaho Code § 61-626.
