GNR-T-00-2 GNR-T-97-22 EXPEDITED PROCEDURAL MOTION TO MOVE DATE FOR FILING REBUTTAL TESTIMONY IN THE MATTER OF THE INVESTIGATION TO ESTABLISH THE IDAHO HIGH COST FUND AS REQUIRED BY IDAHO CODE §62-610A THROUGH F. ) ) ) ) ) Pursuant to Commission Rule 256.03 (IDAPA 31.01.01.256.03) Commission Staff moves the Commission to change the date for filing rebuttal testimony in these dockets to Friday, August 11, 2000. Rebuttal is currently due Monday, August 7, 2000. This would move the date by four (4) days. The Commission should grant this expedited motion for two reasons. First, all parties who have previously filed testimony, with the exception of GTE Northwest Incorporated (GTE/Verizon), have agreed either in writing or verbally to moving the date. Second, GTE/Verizon filed a Motion to Suspend Docket on August 2, 2000, requesting the Commission to suspend the dockets for eight weeks, including the filing deadline for rebuttal, in light of its appeal of the Fifth Circuit Opinion in GTE Service Corp. v. FCC, 183 F.3d 393 (5th Cir. 1999) to the United States Supreme Court and the recent Eighth Circuit opinion on remand in Iowa Utilities Board v. FCC. On August 2, 2000, due to the current schedule, the Commission issued a scheduling order requiring all parties to respond to GTE/Verizon’s Motion by August 7, 2000. Order No. 28471. GTE/Verizon also requested the Commission rule expeditiously. Therefore, this short extension of time will allow the Commission to consider and rule on GTE/Verizon’s Motion. A request for an extension is a procedural motion and pursuant to Commission Rule 256, the Commission can act without waiting for responses from the other parties. Staff asserts that it has notified all parties’ representatives of this motion by personal delivery of the motion via facsimile. In addition, the Commission has good cause to issue its order granting this procedural motion because the parties need to know whether they are still required to file rebuttal on Monday, August 7, 2000. Therefore, the Commission Staff respectfully requests the Commission to grant this motion and issue a decision today. Respectfully submitted this 4th day of August 2000. Cheri C.
