In particular, Ridgeline Energy LLC, through a subsidiary company, Rockland Wind Farm LLC, developed, partially owns, and operates the Rockland Wind Farm, which is an 80 MW PURPA project located near American Falls, Idaho. Electric output from the Project is sold to Idaho Power Company pursuant to a First Amended Electric Service Agreement (FAFESA) and approved by the Commission in Order No. 32125. Ridgeline Energy LLC claims a direct and substantial interest in this proceeding because Idaho Power Company's proposal to apply proposed Schedule 74 to existing FESAs could directly or indirectly affect Ridgeline Energy LLC's rights and obligations under the FAFESA. 4.Although this petition is filed after the deadline established in Order No. 32352, Ridgeline Energy LLC has good cause for the untimely filing and a substantial reason for delay given that Ridgeline Energy LLC recently confirmed that certain proposals raised in direct testimony, such as Idaho Power Company's proposed Schedule 74, could, if approved by the Commission, apply retroactively to existing contracts and therefore may have a direct and indirect impact on Ridgeline Energy LLC's FESAs. RIDGELINE ENERGY LLC'S PETITION TO INTERVENE-2 5. Ridgeline Energy LLC's intervention will not disrupt or prejudice existing parties or unduly broaden the issues beyond those listed in IPUC Order No. 32352 issued in this docket. Ridgeline Energy LLC agrees to be bound by all scheduling orders existing in this docket prior to its intervention. Further, as a condition of granting intervention, Ridgeline Energy LLC would agree that its participation be limited as follows: • Requesting that the Commission take official notice of existing Ridgeline FESAs; • Submitting a legal brief on or before July 20, 2012 relating to legal issues associated with proposed Schedule 74; • Cross examining Company witness Tessia Park at the evidentiary hearing. 6. Without the opportunity to intervene herein, Ridgeline Energy LLC would be without any means of participation in this proceeding, which may have a material impact on the rates, terms and conditions of the FAFESA. WHEREFORE, Ridgeline Energy LLC respectfully requests that the Commission grant this Petition to Intervene and authorize Ridgeline Energy LLC to participate in the above-entitled proceedings with full rights as a formal party, subject to the conditions suggested herein.
