TO CERTIFY CERTAIN LECS COMPLIANCE WITH FCC PAYPHONE ORDERS. ) ) ) ) ) ) CASE NO. GNR-T-97-5 ORDER NO. 28537 On April 11, 1997, MCI Telecommunications Corporation and AT&T Communications of the Mountain States, Inc. filed an Emergency Petition to certify that certain LECs were complying with FCC Payphone Orders. On August 29, 1997, the Commission issued a Notice of Joint Petition and Notice of Prehearing Conference. On October 19, 1999, MCI filed a request for a prehearing conference and since that time no further action or progress has occurred in this case. On September 21, 2000, Commission Staff received correspondence from MCI’s counsel Dean J. Miller who advised that this matter has been resolved in the context of companion litigation in another state and therefore it can be closed. Miller also states that Eileen Benner of AT&T concurs with this result. Accordingly, Staff recommended that this matter be closed. Based on this information this matter shall be closed. O R D E R IT IS HEREBY ORDERED that the Petition in Case No. GNR-T-97-5 is dismissed and this matter is closed.
