SUPPLEMENTAL COMMENTS OF THE COMMISSION STAFF, U S WEST COMMUNICA-TIONS, INC., AND AT&T COM-MUNICATIONS OF THE MOUNTAIN STATES, INC.
Pursuant to a Notice and Order of the Commission, a settlement conference was convened in this case on May 26, 1999, at the offices of the Public Utilities Commission. As a result of the discussions during the settlement conference, the Commission Staff, U S WEST Communications, Inc., and AT&T Communications of the Mountain States, Inc. (AT&T) resolved certain issues in regard to U S WEST’s intraLATA toll dialing parity implementation plan. In a process approved by the Commission, the parties also agreed to file additional comments to clarify the resolution of issues and recommend resulting changes to U S WEST’s toll dialing parity plan. Accordingly, these comments represent an agreement by the parties that U S WEST’s toll dialing parity plan should be amended or clarified as follows:
1. The time period for waiver of a one-time customer PIC change charge should be 90 days rather than 120 days.
2. U S WEST may use a one-time bulk bill process for recovery of waived PIC change charges as outlined in its implementation plan.
3. U S WEST will process PIC changes in no more than five business days.
4. Regarding cost recovery, U S WEST will apply its proposed equal access network reconfiguration charge (EANRC) upon implementation of toll dialing parity. The EANRC will apply to the total intraLATA originating minutes of use. The cost recovery period will be three years.
5. Within one year of implementation, U S WEST will provide a report to the Commission regarding the costs to implement its toll dialing parity plan. A cost recovery docket will be opened to review specific costs associated with implementing toll dialing parity and allow for an adjustment to and a true-up of the EARNRC recovery in the event that the recovery by U S WEST is too high or too low.
6. U S WEST’s Plan provides that it will accept carrier-initiated changes of intraLATA selections beginning July 22, 1999. The parties Stipulate that the Authorization Date (the date the carrier received authorization from the customer to make the change on their behalf) of any such change must be after the actual mailing date of the Customer Notification the form of which was approved by the Commission on May 26, 1999.
The parties stipulate that agreements and compromises in this case were made to resolve issues in regard to U S WEST’s implementation of intraLATA dialing parity in Idaho and should not be used or considered as applicable precedent in other jurisdictions.
