The Commission’s Rule 18.02 provides a means of updating the list of utilities
operating in Idaho and subject to the Commission’s annual regulatory fee.IDAPA
31.01.01.018.02.More specifically,telephone corporations that ‘fail to pay their special
regulatory fees,are no longer conducting business in Idaho,and thu to maintain a designated
agent for service with the Commission Secretary ...may be administratively removed from the
list of utilities....“Id.At our decision meeting on March 31.2014,Staff provided a list of
telephone corporations that met the criteria mentioned above.For most if not all of these
telephone corporations,Staff further asserted that these corporations were no longer registered
with the Idaho Secretary of State to conduct business in Idaho.Based upon Staff’s
recommendation,the Commission finds that it is appropriate to administratively remove these
telephone corporations from the list of registered utilities authorized to provide
telecommunications service in Idaho.
BACKGROUND
Idaho Code §s5 61-1001 and 62-611 provide that each telephone corporation subject
to the Commission’s Title 61 or Title 62 jurisdiction pay an annual regulatory fee “to defray the
amount to be expended by the Commission for expenses in supervising and regulating the public
utilities.”On or before April 1 of each year,each telephone corporation is required to report its
gross operating revenue from intrastate business in Idaho for the preceding calendar year.Idaho
Code §61-1003.Each telephone corporation then pays its proportioned regulatory fee to the
Commission in two equal semi-annual installments.Idaho Code §6 1-1005.
Commission Rule 16.03 requires that all utilities (including telephone corporations)
designate a person as their agent in Idaho to be served with summons and complaints.IDAPA
3 1.01.01.016.03.More specifically,telephone corporations ‘shal1 be responsible for maintaining
on file with the Commission Secretary the current name,mailing address and e-mail address of

the person designated as the agent to receive service.”Id.Other Commission rules and Orders
require that telephone corporations file with the Commission their principal business address
within Idaho and,if not incorporated in Idaho,then a Certificate of Authority from the Idaho
Secretary of State and the Secretary of State where the corporation or business entity is
registered.See Rules 111,112,114;Commission Order No.26665.
Rule 16.01 also provides that documents issued by the Commission may be served by
mail on the agent for service of process listed in Rule 16.03.Service by mail constitutes due and
timely notice to the telephone corporation and no further service is necessary to bind the
corporation.IDAPA 31.01.01.16.01.
Commission Staff alleges that the telephone corporations listed in the Attachment to
this Order have failed to pay their regulatory fee for one or more years.Commission Staff
maintains that it forwarded the annual assessments to each company at its address on file with
the Commission Secretary.When the assessment notices went unanswered,Commission Staff
attempted to verify whether the telephone corporations were still operating in Idaho.Idaho law
requires that all business entities have a registered agent for service.Staff further reported that
the Secretary of State’s list of business entities authorized to conduct business in Idaho currently
shows that most if not all of these telephone corporations have had their Certificates
administratively revoked,cancelled or withdrawn.
COMMISSION FINDINGS
After reviewing Staffs report and recommendations,we find that the companies
indicated in the Attachment to this Order have failed to:1)pay their regulatory assessment(s);2)
maintain current mailing addresses;and 3)maintain a designated agent for service with the
Commission Secretary.Based upon information obtained from the Secretary of State’s office,
we also conclude that these telephone corporations are no longer authorized to conduct telephone
business in Idaho.Consequently,we find it is appropriate to remove these companies from our
list of telephone utilities,and these companies are precluded from providing telecommunications
services in Idaho.Based upon their failure to pay their regulatory fees as required by law,we
also find it is appropriate to cancel their tariffs,price lists,and Certificates (where issued).
This Order becomes effective 21 days after the service date of this Order.If prior to
the effective date of this Order,any of the listed telephone corporations pay their delinquent
regulatory fees and update their necessary information,then it may be appropriate for these

corporations and Staff to enter into a Consent Agreement pursuant to Rule 58,IDAPA
31.01.01.058.
ORDER
IT IS HEREBY ORDERED that the telephone corporations listed in the Attachment
to this Order are prohibited from providing telecommunications services in Idaho.These
companies shall be removed from the list of authorized telephone corporations.
IT IS FURTHER ORDERED that this Order shall become effective 21 days from the
service date of this Order.When this Order becomes effective,the telephone corporations listed
in the Attachment shall no longer be authorized to provide telecommunications services in Idaho
and their tariffs,price lists,and Certificates (where issued)shall be cancelled.
IT IS FURTHER ORDERED that the Commission Secretary serve this Order upon
all incumbent and competitive local exchange companies.
THIS IS A FINAL ORDER.Any person interested in this Order (or in issues finally
decided by this Order)or in interlocutory Orders previously issued in this Case No.GNR-T-14-
04 may petition for reconsideration within twenty-one (21)days of the service date of this Order
with regard to any matter decided in this Order or in interlocutory Orders previously issued in
this case.Within seven (7)days after any person has petitioned for reconsideration,any other
person may cross-petition for reconsideration.See Idaho Code §6 1-626.
