(“TNCII”) provides this courtesy notification of its current compliance with the Federal Communications Commission’s (“FCC”) Report and Order and Further Notice of Proposed Rulemaking, in Docket Nos. WC Docket No. 10-90, et al., FCC 11-161 (the “USF/ICC Transformation Order”), as amended, and Section 51.911, 47 C.F.R. §51.911, July 1, 2013 terminating interstate switched exchange access rate benchmarking compliance requirements. In pertinent part, Section 51.911(c) of the FCC’s rules, Access reciprocal compensation rates for competitive LECs, promulgated under the USF/ICC Transformation Order, establishes that Beginning July 1, 2013, notwithstanding any other provision of the Commission's rules, all Competitive Local Exchange Carrier Access Reciprocal Compensation rates for switched exchange access services subject to this subpart shall be no higher than the Access Reciprocal Compensation rates charged by the competing incumbent local exchange carrier, in accordance with the same procedures specified in §61.26 of this chapter On January 17, 2013, TNCII submitted its initial switched exchange access price list, Idaho P.U.C. Price List No. 1 (“Price List”), to the Idaho Public Utilities Commission. TNCII’s Price List contains intrastate rates that currently comply with Section 61.26 of the FCC’s rules, obviating the need for further amendment to comply with the July 1, 2013 interstate switched exchange access rate benchmarking requirement set forth in the USF/ICC Transformation Order and 47 C.F.R. §51.911.
