VIOLATED THE TERMS OF ITS PRICE LIST AND THE COMMISSION'S OPERATOR SERVICES AND PAY TELEPHONE RULE 104.04. CASE NO. GNR- T -04- NOTICE OF PETITION NOTICE OF SCHEDULE NOTICE OF HEARING ORDER NO. 29456 YOU ARE HEREBY NOTIFIED that on March 15 2004, the Staff of the Idaho Public Utilities Commission, pursuant to Idaho Code ~~ 62-616 and 62-620, filed a Petition recommending that the Commission initiate an investigation to resolve subscriber complaints, determine if OCMC is providing service in compliance with its Price List and to decide if OCMC, Inc. has violated the Commission s Operator Services and Pay Telephone Rules, IDAPA 31.51.01 et seq. Staff has alleged that OCMC, Inc., an operator services provider ("OSP"), operating in the State of Idaho as itself or under the assumed business names of OPTIC OM, Inc., One Call Communications, Inc. AdvantTel, LiveTel, SuperTel, RegionTel or 1-800-MAX-SA VE (hereinafter "OCMC") has violated the Commission s Operator Services and Pay Telephone Rule 104.04 and the terms of its own Price List between the dates of March 15, 2002 and July 29 2003. YOU ARE FURTHER NOTIFIED that the Commission has opened an investigation based on Staffs Petition under the Case No. GNR-04- YOU ARE FURTHER NOTIFIED that discovery is available in Case No. GNR-04- pursuant to the Commission s Rules of Procedure, IDAPA 31.01.01.221-234. NOTICE OF SCHEDULE YOU ARE FURTHER NOTIFIED that by Stipulation the Staff of the Idaho Public Utilities Commission and OCMC, Inc. have agreed upon a schedule for the processing this case. this Order the Commission adopts the parties proposed schedule. JUNE 22. 2004. IN THE COMMISSION HEARING ROOM. 472 WEST WASHINGTON STREET. BOISE. IDAHO, continuing to June 23 at the same location, if necessary. YOU ARE FURTHER NOTIFIED that all hearings and prehearing conferences in this matter will be held in facilities meeting the accessibility requirements of the Americans with Disabilities Act (ADA). Persons needing the help of a sign language interpreter or other assistance in order to participate in or to understand testimony and argument at a public hearing may ask the Commission to provide a sign language interpreter or other assistance at the hearing. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted pursuant to Idaho Code ~ 61-601 et seq. and the Commission s Rules of Procedure, IDAPA 31.01.01.000 et seq. ORDER IT IS HEREBY ORDERED that the Commission open,. an investigation to determine if OCMC, Inc. or any of its affiliates doing business under assumed business names in the State of Idaho have violated the terms of the Company s Price List and or whether they have violated the Commission s Operator Services and Pay Telephone Rule 104.04. IT IS FURTHER ORDERED that the Commission adopts the scheduling and hearing dates above.
