GNR- T -03- NINE-MONTH REVIEW ON ECONOMIC AND OPERATIONAL IMPAIRMENT CASE NO. GNR- T -03- REGARDING ACCESS TO SPECIFIC UNES YOU ARE HEREBY NOTIFIED that on June 17 2003, the Commission issued a Notice of State of Proceeding and Notice of Right to Intervene in these cases that were opened by the Commission in response to an order the Commission believed was imminent from the Federal Communications Commission. The FCC publicized an order to be issued in CC Docket No. 01-338 , commonly known as the Triennial Review Order. The FCC has not yet actually adopted and released the Triennial Review Order. In its earlier Notice of Right to Intervene, the Commission established an intervention deadline of June 27, 2003. YOU ARE FURTHER NOTIFIED that on June 26, 2003, Verizon Northwest, Inc. (Verizon) filed a Motion for Extension of Time in which to intervene in Case No. GNR-03- and Case No. GNR-03-23. Verizon noted that the FCC has not yet released the Triennial Review Order, and Verizon asserted that interested parties may wish to see the order as actually adopted by the FCC before deciding whether to intervene and participate in the state proceedings. Verizon requested that the Commission extend the date for intervention to ten days after the FCC releases its Triennial Review Order. The Commission at its decision meeting on July 7, 2003, approved the request ofVerizon to extend the date to intervene. YOU ARE FURTHER NOTIFIED that the Commission has determined to extend the date for intervention in Case No. GNR-03-22 and Case No. GNR-03-23. Petitions to Intervene may be filed in either case or both cases no later than ten days following the release NOTICE OF EXTENSION OR TIME TO INTERVENE date on the FCC's Triennial Review Order.Persons desiring to intervene in either Case No. GNR-03-22 or Case No. GNR-03-23 for the purpose of presenting evidence or cross- examining witnesses at hearing must file a Petition to Intervene with the Commission pursuant to this Commission s Rules of Procedure, Rules 72 and 73, IDAP A 31.01.072 and .073. Persons intending to participate at hearing must file a Petition to Intervene on or before the tenth day following the FCC's release date for the Triennial Review Order. Please specify in the Petition whether an intervention is sought in Case No. GNR-03-22 (the 90-day review) or Case No. GNR-03-23 (the nine-month review), or both. Persons desiring to present written comments without parties ' rights of participation and cross-examination are not required to intervene and may present their comments without prior notification to the Commission or the parties. YOU ARE FURTHER NOTIFIED that all hearings will be conducted pursuant to the Rules of Procedure adopted by the Idaho Public Utilities Commission. IDAP A 31.01.01.000 seq.
