HomeMy WebLinkAbout20031202Final Order No 29390.pdfOffice of the Secretary Service Date December 2, 2003 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION IN THE MATTER OF THE APPLICATION OF GLOBCOM INCORPORATED FOR A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY TO PROVIDE LOCAL EXCHANGE TELECOMMUNICATIONS SERVICES. CASE NO. GNR- T -03- ORDER NO. 29390 On May 21 , 2003 , Globcom Incorporated filed an Application for a Certificate of Public Convenience and Necessity (CPCN) to provide resold and facilities-basedlUNE-P local exchange service within the State of Idaho. In addition, the Company contends that it will provide interexchange service. The Company states that it has no local exchange customers at this time in the State ofldaho. Globcom states that its headquarters is in Northbrook, Illinois and that it is incorporated under the laws of that state. The Company obtained a Certificate of Authority to transact business as a foreign corporation from Idaho s Secretary of State on April , 2003. Although the Company does not maintain an office in Idaho, it does have a registered agent in this state. Globcom does not hold ownership or management interest in any other company and is privately held by two individuals who hold 100% of the Company stock. Globcom has submitted its unaudited financials for the period ending November 30, 2002. Globcom s price list for providing in-state long distance, toll-free inbound calling, directory assistance and calling card service was approved in May 2003. With this Application Globcom proposes to provide flat-rated and measured local exchange service to residential and business customers, private lines, data services, and Centrex services. The Company does not propose to collect advance payments or deposits so no escrow account has been established. The Company has not yet obtained an interconnection agreement in Idaho. Globcom has been granted authority to provide local exchange service in other states such as Kentucky and Maine. The Company states that granting its Application for a Certificate is in the public interest because Globcom s entry into the local telecommunications services market will enhance competition in Idaho. ORDER NO. 29390 STAFF RECOMMENDATION Staff has reviewed the Application submitted by Globcom Incorporated and believes the Company understands and agrees to comply with the Commission s Rules and requirements. Based on this review of Globcom Incorporated's Application, Staff believes that the Company filing has satisfied all the requirements of the Commission s Rules and Procedural Order No. 26665. Therefore, Staff recommended approval of the Application for Certificate of Public Convenience and Necessity. COMMISSION FINDINGS AND DECISION Based on the comments, the law and the record, the Commission grants the Application.Accordingly, Globcom Incorporated shall be issued a Certificate of Public Convenience and Necessity. Furthermore, the Commission grants a waiver of the requirement to establish an escrow account for deposits. ORDER IT IS HEREBY ORDERED that Globcom Incorporated'Application for a Certificate of Public Convenience and Necessity is granted. THIS IS A FINAL ORDER. Any person interested in this Order or in interlocutory Orders previously issued in this Case No. GNR-03-20 may petition for reconsideration within twenty-one (21) days of the service date of this Order with regard to any matter decided in this Order or in interlocutory Orders previously issued in this Case No. GNR-03-20. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code ~ 61-626.
