DBA NTCH- IDAHO, INc. OR CLEAR TALK FOR DESIGNATION AS AN ELIGIBLE TELECOMMUNICATIONS CARRIER. CASE NO. GNR- T -03- IN THE MATTER OF THE APPLICATION OF NPCR, INC. DBA NEXTEL PARTNERS SEEKING DESIGNATION AS AN ELIGIBLE TELECO MMUNI CA TI ONS CARRIER. CASE NO. GNR-03- ORDER NO. 29333 On August 25, 2003 , Dean J. Miller, local counsel for NPCR, Inc. dba Nextel Partners filed a Motion for Limited Admission Pro Hac Vice, pursuant to Idaho Bar Commission Rule 222, for Philip R. Schenkenberg. In the Motion, Mr. Schenkenberg certified that he is an active member, in good standing, of the bar of the State of Minnesota; that he maintains a regular practice of law in Saint Paul, Minnesota and is not a resident nor licensed to practice law in Idaho. Mr. Schenkenberg also certified that he has not previously been admitted under Idaho State Bar Rule 222 and has not been denied admission under this rule in this or in any other jurisdiction. Mr. Miller and Mr. Schenkenberg certified that a copy of this Motion has been served on all other parties in these cases and that a copy of the Motion, accompanied by a $200 fee, has been provided to the Idaho State Bar. Mr. Miller also acknowledged that unless he is specifically excused, his attendance is required at all proceedings in which Philip R. Schenkenberg appears. STAFF REVIEW AND RECOMMENDATION Staff stated that recently the Commission issued a Notice of Proposed Rulemaking regarding its Rules of Procedure. Case No. RUL-03-, IDAPA 31-0101-0301. These Proposed Rules incorporate Idaho Bar Commission Rule 222 that provides for limited admission for attorneys not licensed in Idaho but in other states. See Proposed Rules of Procedure 19 and 43. Staff reviewed this Motion and believed that it complied with Idaho Bar Commission Rule 222 and the Commission s Proposed Rules of Procedure 19 and 43. Accordingly, Staff recommended that the Commission grant this Motion. ORDER NO. 29333 COMMISSION DECISION Based on the foregoing, the Commission grants the Motion for Limited Admission Pro Hac Vice for Philip R. S chenkenb erg. ORDER IT IS HEREBY ORDERED that the Motion for Limited Admission Pro Hac Vice for Philip R. Schenkenberg is granted.
