DBA CLEART ALK'S REQUEST TO WITHDRAW ITS ELIGIBLE TELECOMMUNICATIONS CARRIER DESIGNATION ORDER NO. 30877 CASE NO. GNR-03- On July 20, 2009, NTCH Idaho, Inc. dba Cleartalk filed a request to withdraw its eligible telecommunications carrier (ETC) designation. The Company stated that it was merging with Syringa Wireless effective July 27 2009. On July 23 2009, Syringa Wireless also advised the Commission that Syringa Wireless and Cleartalk were merging. Syringa s letter stated that it will continue to offer "Cleartalk (Idaho Telecommunication Service Assistance Program) recipients their credits for monthly service." In its Decision Meeting on August 10 , 2009, the Commission determined to approve Cleartalk's request to withdraw its ETC designation status. COMMISSION FINDINGS On June 11 , 2003, Cleartalk was granted ETC status in 17 non-rural wire centers in southeastern Idaho. Order No. 29261. On August 28 2008, Syringa was granted ETC status in southern Idaho that included the same 17 non-rural wire centers. Order No. 30629. On July 20, 2009, Cleartalk filed a request that its ETC designation be withdrawn. Staff recommended the Commission approve Cleartalk'request to withdraw its ETC designation after confirming Syringa s commitment to fulfill Cleartalk's ETC obligations. The Commission finds that Cleartalk's customers, including the Idaho Telecommunications Service Assistance Program recipients, will see no change as a result of Cleartalk's ETC withdrawal. The Commission accordingly approves Cleartalk's request to withdraw its ETC designation status in southeastern Idaho. ORDER IT IS HEREBY ORDERED that NTCH Idaho, Inc. dba Cleartalk's request to withdraw its eligible telecommunications carrier designation status in southeastern Idaho is granted. THIS IS A FINAL ORDER. Any person interested in this Order may petition for reconsideration within twenty-one (21) days of the service date of this Order. Within seven (7) ORDER NO. 30877 days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code ~ 61-626.
