OF CERISTAR, INc. FOR A CERTIFICATE
OF PUBLIC CONVENIENCE AND
NECESSITY ORDER NO. 29373
CASE NO. GNR-O3-
On January 24, 2003, CeriStar, Inc. filed an Application with the Commission for
a Certificate of Public Convenience and Necessity ("CPCN") to provide facilities-based and
resold local exchange telecommunications services in Idaho. Staff completed its review of
CeriStar s Application on March 25 2003 and requested CeriStar clarify items in the Application
and make changes to the illustrative tariff. When Staff received no reply, Staff inquired on May
8 about the status of CeriStar s response. The Company s consultant told Staff that the
consultant would notify Staff when CeriStar responded. After receiving no further
communication from the consultant or the Company, on September 22 Staff sent a letter to the
consultant and the Company requesting a response by October 17. Staff advised that it would
seek dismissal of CeriStar s Application if the Company did not reply by October 17. Because
CertiStar did not respond, Staff recommended that the Commission dismiss CeriStar
Application in this case without prejudice.
Based on these facts, the Commission finds it reasonable to dismiss CertiStar
Application for a CPCN without prejudice.
ORDER
IT IS HEREBY ORDERED that CeriStar, Inc.'s Application for a Certificate of
Public Convenience and Necessity is dismissed without prejudice.
THIS IS A FINAL ORDER. Any person interested in this Order (or in issues finally
decided by this Order) or in interlocutory Orders previously issued in this Case No. GNR-03-
may petition for reconsideration within twenty-one (21) days of the service date of this Order
with regard to any matter decided in this Order or interlocutory Orders previously issued in this
case. Within seven (7) days after any person has petitioned for reconsideration, any other person
may cross-petition for reconsideration. See Idaho Code ~~ 61-626 and 62-619.
