Advance Payment:A payment required before the start of service.Advancedpayment may consist of any requiredconstructioncost,all appropriate non-recurring charges,and an estimate of the first month's recurring charges. Bit:The smallest unit of information in the binary system of notation. CCS:One hundred call seconds or one hundred seconds of telephoneconversation.One hour of traffic is equal to 36CCS. Nonlisted Service:Means a Customeris not listed in the publisheddirectory,but is listed in the directory assistancedatabase. Non-Published Service:Means a Customeris not listed in the publisheddirectory or in the directory assistance database. Recurring Charges:The charges to a Customer for services,facilities and equipment,which recur monthly for the agreedupondurationoftheservice. The services offered herein may be used for any lawful purpose.Thereare no restrictions on sharing or resale oftheCompany'sservices.However,the Customer remains liable for all obligations underthis price list even ifsuchsharingorresalearrangementsexistregardlessoftheCompany's knowledge of these arrangements.IfserviceisjointlyorderedbymorethanoneCustomer,each is jointlyand severably liable for all obligations. The services the Companyoffers shall not be used for any unlawful purposes or for any use for which theCustomerhasnotobtainedallrequiredgovernmentalapprovals,authorizations,licenses,consents and permits. Company services may be connectedto the servicesor facilities of other communicationscarriers only whenauthorizedby,and in accordance with,the terms and conditions of any price lists of such other communicationscarriers. The Companymay require a Customer to immediately shut down its transmission of signals if said transmissioniscausinginterferencetoothers. The services of the Companyare furnished for the transmission of voice communicationsbut may also be usedfordata,facsimile,signaling,metering,or other similar communications,subject to the transmission capabilitiesofthetechnologiesorcombinationoftechnologiesavailable.Service is available twenty-four hours a day,sevendaysaweek. 2.2 Shortage of Equipment or Facilities The Companyreserves the right to limit or to allocate the use of its existing and future facilities when necessarybecauseofalackoffacilitiesorduetoanycausebeyondtheCompany's control. The furnishing of serviceunder this price list is subject to the availabilityon a continuing basis of all facilitiesnecessarytoprovidetheservice.Serviceswill be provided using the Company'sfiber optics and other facilitiesaswellasfacilitiestheCompanymayobtainfromothercarriers. 2.3 Selection of Transmission The Company selects and/orarranges for directly or with its underlying carrier(s)the channels and/or servicecomponentsandunderlyingnetworkfacilitiesusedtoprovideservice.The Companymay modify or change thechannels,servicecomponents and underlying Company facilities or the underlying carrier at any time subject toPart68oftheFCC's Rules and Regulations and this price list. Issued:September 20,2002 Effiective:September __,2002 Jon M.Hesse,President BridgeBand Communications,Inc. 514 S.23rd Aveune Bozeman,Montana 59718 Bäd d Ö nm mcain Ìnc IÀa P e Ùst Ño Page 17 2.4 Notification of Service-Affecting Activjties The Company will provide the Customer with reasonable notification of serviceaffecting activities that mayoccurduringthenormaloperationofitsbusiness.Such activities may include,but are not limited to,equipment or facilities additions,removalsor rearrangementsand routine preventivemaintenance.Generally,such activitiesarenotspecifictoanindividualCustomerbutaffectmanyCustomers'services.No specific advancenotificationperiodisapplicabletoallservice-affecting activities.The Companywill work cooperatively with the Customertodeterminereasonablenotificationrequirements.Notification to the Customermay not be possible with someemergencyorunplannedserviceaffectingconditions,such as an outage resulting from cable damage. 2.5 Provision of Equipment and Facilities The Company shall make a reasonable effort to provide serviceto a Customeron or beforea particular date,subject to the provisions of and compliance by the Customer with the regulations containedin this price list.TheCompanydoesnotguaranteeavailabilityofserviceonanydatecertainandshallnotbeliableforanydelaysincommencingservicetoanyCustomer. Special construction will be undertakenat the discretion of the Company consistent with budgetaryresponsibilitiesandconsiderationfortheimpactonCompany'sother Customers and contractualresponsibilities. 2.8 Ownership of Facilities Title to all facilities and equipment,and related plans and proposals,provided by the Companyin furnishingserviceremainswiththeCompany,its agents or contractors.Such facilities and equipment,plans and proposalsshallbereturnedtotheCompanybytheCustomerwheneverrequested,within a reasonable period following therequestandinasgoodconditionasreasonablewearwillpermit. 2.9 Government Authorization The provision of the Company's services is subject to and contingent upon the Companyobtaining and retainingallgovernmentalauthorizationsthatmayberequired.The Company shall use reasonable efforts to obtain andkeepineffectallsuchgovernmentalauthorizations.The Company shall be entitled to take any action necessarytobringitsfacilitiesand/or services into conformancewith any requirement or request of the FederalCommunicationsCommissionorothergoverningentityoragency. 2.10 Rights-of-Way Provisioning of the Company's services is subject to and contingent upon the Company's ability to obtain andmaintainrights-of-way and access to public and private property necessary for installation of the facilities used toprovidetheCompany'sservices to the Customer's servicepoint as agreed to by the Company. 2.11 Liability 2.11.1 Exculpatory Clause THE INCLUDEDPRICE LIST LANGUAGEDOES NOT CONSTITUTE A DETERMINATIONBYTHECOMMISSIONTHATALIMITATIONOFLIABILITYIMPOSEDBYTHECOMPANYSHOULDBEUPHELDINACOURTOFLAW.ACCEPTANCE FOR FILING BY THECOMMISSIONRECOGNIZESTHATITISACOURT'S RESPONSIBILITYTO DETERMINE THEVALIDITYOFTHEEXCULPATORYCLAUSE. The Company shall not be liable for any delay or failure of performance of equipmentdue to causesbeyonditscontrol,including but not limited to:acts of God,fire,flood,explosion or other catastrophes;any law,order,regulation,direction,action or request of the United States government,or of any othergovernment,including state and local agency,commission,bureau,corporation,or other instrumentalityofanyoneormoreofthesefederal,state or local governments,or of any civil or military authority;national emergencies;insurrections;riots;wars;unavailabilityof rights-of-way or materials;or strikes,lockout,work stoppages,or other labor difficulties. The Company shall not be liable for any act,omission or defect of any entity furnishing services,facilities or equipment used for or with the Company's services,to the Companyor to the Customer,orfortheactsoromissionsofcommoncarriersorwarehousemen. With respect to any service or facility provided by the Company,the Customer shall indemnify,defendandholdharmlesstheCompanyfromandagainstallclaims,actions,damages,liabilities,costs andexpenses,for: (a)Any loss,destructionor damage to property of the Customer or any third party,or thedeathorinjuryofanyperson,to the extent caused by or resulting from the negligent orintentionalactoromissionoftheCustomer,its employees,agents,representativesorinvites;and (b)Any damages or losses due to the fault or negligenceof the Customer or due to thefailureormalfunctionofCustomerprovidedequipmentorfacilities. The Company does not guarantee nor make any warranty with respect to installations it provides for useinanexplosiveatmosphere.The Customerindeninifies and holds the Companyharmless from anyliabilitywhatsoever,and for any damages caused or claimed to have been caused in any way,directly orindirectly,as a result of any such installation. The Company is not liable for any defacementof or damage to Customer's premises resulting from thefurnishingofservicesorequipmentortheinstallationorremovalthereof,unless such defacement ordamageiscausedbythewillfulmisconductoftheCompany's employees or agents. The Company's entire liability,if any,for any claim,loss,damage or expense from any cause whatsoevershallinnoeventexceedsumsactuallypaidtheCompanybytheCustomerforthespecificservicesgivingrisetotheclaim.No action or proceeding against the Company shall be commenced more than one yearaftertheserviceisrendered.With respect to the furnishing of Company'sservices to public safetyansweringpointsormunicipalemergencyserviceproviders,the Company'sliability,if any,will belimitedtothelesserof: (a)The actual monetary damages incurred and proved by the Customeras the direct result of theCompany's action,or failure to act,in providing the service;or (b)The sum of $50.00. In the event parties other than Customer,including but not limited to joint users and the Customer'sCustomers,shall haveuse of the Company'sservicedirectly or indirectly through the Customer,then theCustomeragreestoforeverindemnifyandholdtheCompanyharmlessfromandagainstanyandallsuchclaims,demands,suits,actions,losses,damages,assessments or payments which may be asserted by saidpartiesarisingoutoforrelatingtotheCompany'sfurnishing of service. THE COMPANYMAKES NO WARRANTIES OR REPRESENTATIONS,EXPRESSEDORIMPLIED,EITHER IN FACT OR BY OPERATION OF LAW,STATUTORY OR OTHERWISE,INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULARUSE,EXCEPT THOSE EXPRESSLY SET FORTH HEREIN. 2.12 Indemnification With respect to any serviceor facility provided by the Company,the Customershall indemnify,defend and holdharmlesstheCompanyfromandagainstallclaims,actions,damages,liabilities,costs and expenses;for: (a)Any loss,destruction or damage to property of the Customeror any third party,or the death or injuryofanyperson,to the extent caused by or resulting from the negligent or intentional act or omission of theCustomer,its employees,agents,representativesor invitees;and (b)Any claim,loss,damage,expense or liability for infringement of any copyright,patent,trade secret,oranyproprietaryorintellectualpropertyrightofanythirdparty,arising from any act or omission by theCustomer,including without limitation,use of the Company's services and facilities in a manner notcontemplatedbythispricelistoranyagreementbetweentheCustomerandtheCompany. ive:Sept Jon M.Hesse,President BridgeBand Cononunications,Inc. 514 S.23rd AVCUDO Bozeman,Montana 59718 BridgeBand Communications,Inc.Idaho Price List No.1 Page 21 2.l 3 Conflicts Between Price List and Commission Rules If this Price List contains provisions that deny or restrict a Customer's rights otherwise protected by Commissionrules,Commission rules supersede any conflicting tariff or price list provisions that deny or restrict any of thoserights,unless otherwise ordered by the Commission,court order,or statute. 2.14 Allowances for Interruptions in Service A credit allowance will be given for interruptions of service,subject to the provisions of this section. 2.14.1 Credit for ServiceInterruptions A credit allowance will be made when an interruption occurs because of a failure of any componentfurnishedbytheCompanyunderthispricelist.An interruption in service is considered to exist when acircuit,service or facility is unusable.An interruption period begins when the Customerreports a circuit,serviceor facility to be interrupted and releases it for testing and repair interruptions shall not exceed anyapplicablemonthlyrates. 2.14.2 Limitations on Allowances No credit allowance will be made for: (a)Interruptions due to the negligence of the Customer,or noncompliance with,or acts of omissionregardingtheprovisionsofthispricelistbytheCustomer,authorizeduser or joint user; (b)Interruptions of service during any period in which the Companyis not given full and free accesstoitsfacilitiesandequipmentforthepurposeofinvestigatingandcorrectinginterruptions; (c)Interruptions of service during a period in which the Customercontinues to use the serviceon animpairedbasis; (d)Interruptions of service during a period when the Customer has released service to the CompanyformaintenancepurposesorforimplementationofaCustomerorderforachangeinservicearrangements;and (e)Interruption of servicedue to circumstances or causes beyond the control of the Company. 2.15 Obligations of the Customer The obligations of the Customershall include the following: (a)The Customershall provide at no charge,as specified by the Company,any personnel,equipment,space,power,heating and air conditioning needed to operate,and maintain a proper operatingenvironmentfortheCompany's facilities and equipmentinstalled on the Customer's premises Issued:September 20,2002 Efflective:September ,2002 Jon M.Hesse,President BridgeBand Communications,Inc. 514 S.23"Aveune Bozeman,Montana 59718 BridgeBand Communications,Inc.Idaho Price List Ño Page 22 (b)If required by the Company,the Customershall obtain,maintain,and otherwise havefullresponsibilityforallrights-of-way and conduits necessary for installation of the Company'sfacilitiesfromthebuildingentranceorpropertylinetothelocationoftheCompany'sequipment space on theCustomer'spremises.The Customer may be requiredto bear any costs associated with obtaining andmaintainingtherights-of-way described herein,including building modification costs.The Customershallalsoberesponsibleforcomplyingwithallapplicablelaws,and obtaining all required permits orotherapprovalsrelatedtothelocationandinstallationoftheCompany's facilities and equipment in theCustomer'spremises or within the rights-of-way for which the Customer is responsible.The CustomerandtheCompanymaymutuallyagreetoenterintoacontractunderwhichtheCompanywillprovidesomeorallsuchnon-regulated services and facilities. (c)The Customershall grant or obtain permission for the Company'semployees or agents toenterthepremisesoftheCustomeratanytimeforthepurposeofinstalling,inspecting,maintaining,repairing,or removing the facilities or equipmentof the Company and/or inspecting theCustomer-provided equipment which is connected to the Company'sfacilities (d)The Customershall be responsiblefor the provision,operation and maintenance of anyCustomer-provided terminal equipmentconnected to the Company'sequipment and facilities,and forensuringcompatibilitywiththeCompany'sequipment and facilities.The Customer shall be responsibleforensuringthattheCustomer-provided equipmentshall not cause damage to the Company'sequipment,facilities and wiring or injuryto the Company'semployees or to other persons.Upon the Company'srequest,the Customerwill submit to the Companya completemanufacturer'sspecification sheet for eachitemoftheCustomer-provided equipmentthat is or is proposedto be attached to the Company'sfacilities.The Companymay provide,at the Customer's expense,any additional protective equipmentthat,in the sole opinion of the Company,is requiredto prevent damage or injury that could result fromtheconnectionofanyCustomer-providedequipment. (e)The Customerwarrants that the services pursuant to this price list are intrastate in nature. (b)Using service in such a way that it interferes unreasonablywith the use of Companyservices byothers. 2.l 6.3 Fraudulent Use The fraudulent use of,or the intendedor attempted fraudulent use of service is prohibited and can resultinthediscontinuanceofservicesassetoutbythispricelist.Fraudulent use consists of using orattemptingtouseservicewiththeintenttoavoidthepayment,either in whole or in part,of the pricelistedchargesfortheserviceincludingbutnotlimitedto: (a)Rearranging,tampering with,or making connectionsnot authorizedby this price list to anynetworkcomponentsusedtofurnishservice;or (b)Using fraudulent means or devices,tricks,schemes,false or invalid numbers,false creditdevices,or electronic devices. 2.17 CustomerEquipment and Channels 2.17.1 Ge eral A Customermay transmit or receive information or signals via the facilities of the Company.TheCompany'sservices are designed primarily for the transmissionof voice-gradetelephonicsignals,except as otherwise stated in this price list.A Customermay transmit any form of signal that is compatible withtheCompany'sequipment,but the Companydoes not guarantee that its services will be suitable for purposes other than voice-gradetelephonic communication except as specifically stated in this price list. 2.17.2 Interconnection of Facilities (a)Any special interface equipmentnecessary to achievecompatibility between the facilities andequipmentoftheCompanyusedforfurnishingCommunicationsServicesandthechannels,facilities,orequipmentofothersshallbeprovidedattheCustomer's expense. (b)Communications Services may be connected to the servicesor facilities of other communicationscarriersonlywhenauthorizedby,and in accordance with,the terms and conditions of the price lists oftheothercommunicationscarrierswhichareapplicabletosuchconnections. (b)Facilities furnished underthis price list may be connected to Customerprovided terminalequipmentinaccordancewiththeprovisionsofthispricelist.All such terminal equipmentshall be registeredby the FederalCommunicationsCommission pursuant to Part 68 of Title 47,CodeofFederalRegulations;and all Userprovided wiring shall be installed and maintained incompliancewiththoseregulations. (b)If the protective requirements for Customer-providedequipmentare not being complied with,theCompanymaytakesuchactionasitdeemsnecessarytoprotectitsfacilities,equipment,and personnel.The Company will notify the Customerpromptly if there is any need for further corrective action.Withintendaysofreceivingthisnotice,the Customermust take this corrective action and notify the Companyoftheactiontaken.If the Customerfails to do this,the Companymay take whateveradditional action isdeemednecessary,including the suspension of service,to protect its facilities,equipmentand personnelfromharm. 2.18 Payments 2.18.1 Customer Obligations (a)The Customer shall pay outstanding charges in full within thirty days of the invoice date.Charges normally will be invoiced in advance,with monthly recurring charges invoiced on or about thefirstofthemonthforwhichthechargesapply.Amounts not paid within thirty (30)days after the date oftheinvoiceareconsidereddelinquentandaresubjecttoLatePaymentChargespursuanttosection1.1.9ofthispricelist. (b)The Customershall pay all charges for use of the service by any persons whetheror notauthorizedbythecustomer,except in those instances where it has been determinedthat the Customer'spresentandformeremployees,agents and authorizedusers were not responsible for calls billed to theCustomerviathirdpartybillingandtheCompanydidnotverifythatthechargesforthecallwouldbeaccepted.The Customeris not responsible for unauthorizeduse of serviceto the extent such use isproximatelycausedbytheCompany'swillful or negligent act. (c)If required by the Company,the Customershall make an advancepayment beforeservices arefurnishedandsuchadvancepaymentwillbecreditedtotheCustomer's initial bill.The Company mayrequiresuchanadvancepayment,in addition to a deposit,if the Companyconsiders this action necessarytosafeguarditsinterests. (d)The Customeris responsiblefor payment of any sales,use,gross receipts,excise,access or otherlocal,state and federal taxes,charges or surcharges (excluding taxes on the Company's net income)imposed on or based uponthe provision,sale or use of the Company'sservices. (e)A $25.00 service charge shall be imposed for any payment for which a draft is returned forinsufficientfunds. Issued:September 20,2002 Effiective:September _,2002 Jon M.Hesse,President BridgeBand Communications,Inc. 514 S.23rd Bozeman,Montana 59718 BridgeBand Communications,Inc.Idaho Price List No.1 Page 25 2.18.2 Late Payment_Charges A Late Payment Chargeof one and a half percent (1 1/2%)will apply to each Customerbill when thepreviousmonth's bill has not been paid in full,leaving an unpaid balance carried forward.The latepaymentchargeisappliedtothetotalunpaidamountcarriedforwardandisincludedinthetotalamountdueonthecurrentmonth's bill.The amount of the late paymentpenalty shall be indicated on theCustomer's bill. 2.18.3 Disputed Bills Any Customerwho disputes a portion of a bill renderedfor Companyservices shall pay the undisputedportionofthebillandprovidewrittennoticetotheCompanythatsuchunpaidamountisindisputewithinthirty(30)days of receipt of the bill.If such written notice is not receivedby the Company withinthirty(30)days as indicated above,the Companyshall consider the bill statement to be due and payableinfullbytheCustomer.Payment of the amount due by the Customer does not constitute a waiver of theCustomer's rights under the provisions of IDAPA31.41.01.204 to challengeany billing amount due orpaidtotheCompany. (a)In the event a Customer and the Companycannot resolve a billing dispute to their mutualsatisfaction,the Customermay contact the Idaho PUC and proceedin accordance with the Idaho PUC'srules. (b)Once the billing dispute is resolved,the Customer shall submit payment of any outstandingamountsdeemeddue,to the Company,within five (5)working days of notification of the amount due,orasorderedbytheIdahoPUCorcourt. 2.18.4 Payment Arrangements When a Customercannot pay a bill in full,the Company may continue to serve the Customerif theCustomerandtheCompanyagreeonareasonableportionoftheoutstandingbilltobepaidimmediately,and the manner in which the balance of the outstandingbill will be paid. In deciding on the reasonableness of a particular agreement,the Companywill take into account theCustomer'sability to pay,the size of the unpaidbalance,the Customer's payment history and length ofservice,and the amount of time and reasons why the debt is outstanding. Payments are to be applied to the undisputedbalance owed by the Customer.A Customermay designatehowapaymentinsufficienttopaythetotalbalancedueshallbeapplied.If applicable,and in the absenceofinstructionsfromtheCustomer,a partial payment to the Company shall be allocated amongtheprovidersbasedupontheratiooftheundisputedamountduetoeachprovidertotheundisputedtotalamountbilled.Such payments shall be applied first to the oldest undisputedbalances. If a Customer fails to make the payment agreed upon by the date that it is due,the Companymay,but isnotobligatedto,enter into a second payment arrangement. No payment arrangementbinds a customer ifit requiresthe Customer to forego any right provided for intheIdahoPUCRules. A Customer'sfailure to pay for undisputedMTS charges billed by the Companymay result in loss of0+or )-and 1+dialing access to MTS services until such time as the customer pays the undisputedchargesandapplicablereconnectioncharges,if any. Customer failure to pay undisputedcharges for other services may result in discontinuanceof thoseservices. 2.18.5 Moves,Adds and Changes Upon written request from the Customer,the Company will transfer an existing servicefrom one locationtoanother,change from one class of serviceto another,or add additional services or features to specificlinesandequipment.The Companymay charge the Customera non-recurring charge for such service. 2.18.6 Taxes,Charges,Fees In addition to the rates and charges described in this price list,the Customer is responsiblefor paymentofanytaxes,charges or fees ordered by the IdahoPUC,the Idaho State Legislature,or local and countygovernments. 2.19 Deposits (a)If the Customer cannot establish a satisfactory credit standing with the Company,the Customershallmakeadepositbeforeaserviceisfurnishedorcontinued.Such deposit shall be held as a guaranteeforthepaymentofcharges.The Companymay require such a deposit,which may be in addition to anadvancepayment,if the Companyconsiders this action necessary to safeguardits interests.The depositshallnotexceedtwo(2)months of estimated annual billings.At any time,at its option,or after twelve(12)months of service,if the Customerhas not been delinquent in the payment of the Companybills,theCompanymayreturnthedepositorcreditittotheCustomer's account.When a serviceis discontinuedtheamountofanyapplicabledeposit,plus accrued interest,will be applied to the Customer's account andanycreditbalanceremainingwillberefunded. (d)Any deposit,plus accrued interest,may be applied to the Customer's telephone account followingcompletionoftwelvemonths'satisfactorypayment.The credit will be applied against service in the 13thand,if appropriate,subsequent months once satisfactory credit is established.Upon the Customer'srequest,the refund shall be made in the form of a check issued and mailed to the Customer. 2.20 Refusal of Services If the Company intends to deny an available service to an applicant,the Company will provide theapplicantwithawrittenexplanationofitsrefusaltoserve.The written explanation shall include: a)The reasons for denial of the service; b)Actions the applicant may take in order to receive the denied service;and c)A statement that an informal or formal complaint concerning denial of the service may be filedwiththeCompanyorwiththeIdahoPUC. 2.20.1 Grounds for Refusal of Service The Companymay refuse to establish serviceif any of the followingconditions exist: (a)The applicant has an outstandingamount due for similar utilityservices and the applicant isunwillingtomakeacceptablearrangementswiththeCompanyforpayment; (b)A condition in which,in the Company's judgment,is unsafe or hazardous to the applicant,thegeneralpopulation,or the Company'spersonnel,agents or facilities; (c)The applicantrefuses to provide the Company with a deposit after having failed to meet thecreditcriteriaforwaiverofdepositrequirements; (d)The applicant is known to be in violation of the Company'sprice lists filed with the Commission; (e)Failure of the applicant to furnish such funds,suitable facilities,and/or rights-of-way which havebeenspecifiedbytheCompanyasnecessarytoandaconditionforprovidingservicetotheapplicant;or (f)The applicant has falsified his/heridentity for the purposeof obtaining service. 2.21 Discontinuance of Service 2.21.1 With Written Notice to the Customer Issued:September 20,2002 Effiective:September ,2002 Jon M.Hesse,President BridgeBand Communications,Inc. 514 S.23rd Bozeman,Montana 59718 BridgeBand Communications,Inc.Idaho Price List No.I Page 28 Except as otherwise specified in this price list or Idaho PUC rules,the Companymay,upon reasonablewrittennoticetotheCustomer,discontinue services for any of the followingreasons: (a)For nonpaymentof any undisputed amounts owing to the Company;(b)The premises have been vacated by the Customer;(c)For tamperingwith the Company'sproperty;(d)For violation of rules,service agreements,or filed price lists;(e)For use of Customer equipment which adverselyaffects the Company's property,facilities,orservicetoitsotherCustomers,or upon condemnationof any material portion of the facilities used by theCompanytoprovideservicetoaCustomer,or if a casualty renders all or any material portion of suchfacilitiesinoperablebeyondfeasiblerepair;or(f)For any governmentalprohibition,or required alteration of the services provided,or anyviolationofanyapplicablelaworregulation,or unlawful use of service or use of service for unlawfulpurposes,the Companymay immediately discontinue or suspend service;or(g)For fraudulent obtaining or use of service,including,but not limited to: (1)Providing false information to carrier the Companyregarding the Customer's identity,address,creditworthiness,or current or planned use of common communications;(2)Using or attempting to use service by rearranging,tampering with,or makingconnectiontotheCompany's service where not authorized by this price list;(3)Using tricks,schemes,false or invalidnumbers,false credit devices,electronic devices;or (4)any other fraudulent means or device. Whenever a fraudulent obtaining or use of a service is detected,the Companymay discontinue servicewithoutnotice,as described in Section 2.21.2 of this price list;provided,however,that if the Customermakesimmediatepaymentfortheestimatedamountduefortheservicethathadbeenfraudulentlyobtained,and for all costs resulting from such fraudulent use,the Companymay choose to continue suchservice,subject to any applicable deposit requirements. 2.21.2 Without Written Notice to the Customer The Company may deny or discontinue the furnishing of any and/or all service(s)to a CustomerimmediatelyandwithoutpriornoticetotheCustomerandwithouttheCustomer's permission for one ormoreofthefollowingreasons: (a)DangerousCondition.A condition immediately dangerous or hazardous to the life,physicalsafety,or property exists,or it is necessary to prevent a violation of federal,state or local safety or healthcodes. (e)Misrepresentation of Identity.The Customerhas misrepresented the Customer's identity forpurposesofobtainingtelephoneserviceandeitherdoesnothaveorhasaninadequatesecuritydeposit onfilewiththeCompany. 2.21.3 Upon CustomerRequest The Companywill,upon Customer request,discontinue or suspend services due to the Customer's: (a)Insolvency; (b)Assignment for the benefit of creditors;(c)Filing for bankruptcy or reorganization;or(d)Failure to discharge an involuntary petition in bankruptcywithin the time permitted by law. 2.21.4 If Rule 402 Complaint is Pending Except as authorizedby order of the Idaho PUC or of the Judiciary,local exchange service shall not beterminatedforfailuretopayamountsindisputewhileacomplaintregardingthattelephoneserviceandproperlyfiledpursuanttoIDAPA31.41.01.402is pending before the IdahoPUC,or while a case placingatissuepaymentforthattelephoneserviceispendingbeforeacourtintheStateofIdaho. 2.22 Customer Cancellationof Service If the Customercancels a service order or terminates servicebeforethe completion of the term of servicespecifiedintheserviceorderforanyreason,the Customeragrees to pay to the Companyall costs,fees,and expenses reasonablyincurred in connectionwith special construction and with the term of service.Inaddition,the Customermay be liable for termination charges up to a maximum amount equal to the totalchargesapplicablefortheremainingtermspecifiedintheserviceorder. 2.23 Termination of Service Contract (a)After the expiration of the initial contract period,and if no new contract period is agreed upon,inwriting,by the Company and the Customer,servicemay be terminated upon thirty days advancenotice totheCompany.The Customer shall be responsiblefor payment of all charges due to the date ofterminationoftheservice,including charges calculatedat a month-to-month rate after the expiration ofthecontractperiod. (d)The Customermay terminate service prior to the expiration of the term if the CustomerordersnewservicethroughtheCompanyforaspecificlengthofserviceandaminimummonthlybillingcommitmentexceedingtheoriginalagreement.The former service will terminate on the start date of thenewservice. 2.24 Changes in Equipment and Services The Company may substitute,change or rearrangeany equipment,facility or system used in providingservicesatanytimeandfromtimetotime,but shall not therebymaterially decrease the technicalparametersoftheservicesprovidedpursuanttotheCustomer's service order. The Customershall not cause or allow any facilityor equipmentof the Companyto be rearranged,moved,disconnected,altered or repaired without the Company's prior written consent. Upon receipt of a written request from the Customer,the Companywill add,delete or change locationsorfeaturesofspecificcircuitsand/or equipment.The Customershall be liable for nonrecurring chargesforanysuchchanges.If a request for deletion of a service represents a cancellation prior to theapplicabletermofservice,the Company may assess termination charges. 2.25 Restoration of Service A reconnection charge of $100.00shall be imposed on any Customerwhose servicehas beendiscontinuedpursuanttoSection9.1.6 of the Rate Schedule.The Company reserves the right to imposeadditionaladvancepaymentand/or deposit requirementson such Customersprior to restoration ofservice,and to refuse to restore serviceuntil all amounts due have been paid. Should the Customerrequest that servicebe restored during a period other than regular working hours,such as evenings or weekends,the Customermay be requiredto pay an after-hour charge of $175.00 forservicereconnection. 2.26 Assignment The Company may,without obtaining any further consent from the Customer,assign any of its rights,privileges or obligations under this price list to any subsidiary,parent,or affiliateof the Company;pursuantto any sale or transfer of substantially all the business of the Company;or pursuant to anyfinancing,merger or reorganization of the Company.The Customermay,upon prior written consent oftheCompany,which consent shall not be unreasonablywithheld,assign its rights,privileges orobligationsunderthispricelisttoanysubsidiary,parent,or affiliate of the Customer;pursuantto anysaleortransferofsubstantiallyallthebusinessoftheCustomer;or pursuant to any financing,merger orreorganizationoftheCustomer.The Company reserves the right to terminate serviceif the Customermakesanyassignment,transfer,or disposition of its rights,privileges or obligations under this price list Issued:September 20,2002 Effiective:September ,2002 Jon M.Hesse,President BridgeBand Conununications,Inc. 514 S.23'"Aveune Bozeman,Montana 59718 Page 31 without the consent of the Company.Any lawful successor of the Customer,or any other entity,whichacceptstheCompany's service,shall be obligated to pay to Company any amounts due. 2.27 License,Agency or Partnership The Company grants no license,expressed or implied,to the Customer by virtue of an agreement for thefurnishingofservicethereunder.Neither the Customernor any joint or authorized users shall represent orotherwiseindicatetoitsCustomersorothersthattheCompanyjointlyparticipatesintheCustomer's orjointuser's services.The relationship between the Companyand the Customer shall not be that ofpartnersoragentsforoneortheother,and shall not be deemed to constitute a partnershipor agencyagreement,unless such relationship or agreement is expressly agreed to in writing by both the CompanyandtheCustomer. 2.28 Proprietary Information Neither the Companynor the Customeror any joint or authorized user shall disclose or use for anypurposeotherthanagreeduponbythepartiesanyplans,drawings,trade secrets or other proprietaryinformationoftheotherpartywhichismadeknowninthecourseofthefurnishingofservicethereunder,without prior written consent,except as may be required by law. 2.29 Promotions The Company reserves the right to provide promotional offerings from time to time.The Company willnotifytheIdahoPUCoftherates,terms &conditions of any such promotions. 2.30 911 The Company will provide necessary Customerinforination to the incumbent local exchange carrier forappropriateroutingofE911calls.The Company's switches will be equippedwith E9l l trunks and allE911trafficwillbeswitchedbytheCompanytotheincumbentlocalexchangecarrierforrouting. 2.31 Public Notice The Company shall give "public notice"of all proposedchanges in rates.Public notice must bereasonabledesignedtocallaffectedCustomers'attention to the proposed changes in rates.Legaladvertisementsalonewillnotbeconsideredadequatepublicnotice.Individualnotice to all Customersaffectedwillalwaysconstitutepublicnotice. 3.0 RESALE TELECOMMUNICATIONS SERVICES 3.1 Applicationfor Resale Local Exchange Services This section contains the regulationsand rates applicable to the provision of Resale Local ExchangeServicesbytheCompany.The Companywill offer Resale Local Exchange Services in the QwestCommunications,Inc.,Teton Telecom,Silver Star Telecom and Verizon Northwest,Inc.serving area. arrangementthat allows channels to function with one numberperchannelgroup.UAS includes a DS-1 facility with common equipment and a network connection,whichprovidesswitchingforlocalexchangeandtollnetworkaccess.Each DSI facility utilizes I through 24channelsconfiguredwithtrunk-side termination and one number functionality. 3.4.5 Optional Features 3.4.5.1 Call Blocking Allows a Customerto control the disclosure of his/her name and or telephonenumber to asubscriberofCallerIdentificationbydialingacodebeforeeachcalltochangetheindicator frompublictoprivate. 3.4.5.2 Call Forwarding -Variable Allows the Customer to forward incoming calls to anothernumberby dialing a code,plus thenumberthatistoreceivethecall.Call Forward -Variable will work on one trunk at a time when used with PBX trunks.This feature also removes that trunk from rotary hunting during use. 3.4.5.3 Call Forwarding -Busy Allows incoming calls to a busy station to be 3.4.5.8 Call Transfer Allows the Customerto transfer an incoming call to a third party,or to add a third party to anexistingcallformingathreepartyconnection,and then to leave the connectionwithoutdisconnectingthecall. 3.4.5.9 Call Waiting Allows the Customerto alternatebetweentwo calls by flashing the switchhook.Flashingtheswitchhookholdsthefirstcallwhilethesecondcallisanswered.The Customerhears a shorttoneontheline,which signals that a call is waiting.The tone is heard only by the Customer;theincomingcallerhearsaregularringingsignal. 3.4.5.10 Caller Identification -Name &Number Allows for the automatic delivery of a calling party's name and telephonenumber (includingnon-published and non-listed telephonenumbers)to the called Customer,which gives the calledCustomeranopportunitytodecidewhethertoanswerthecallimmediatelyornot.The name andnumberaredisplayedonCustomerprovidedequipment. 3.4.5.1l Caller Identification -Number Allows for the automaticdelivery of a calling party's telephone number (including non-publishedandnon-listed telephonenumbers)to the called Customer,which gives the called Customeranopportunitytodecidewhethertoanswerthecallimmediatelyornot.The name and numberaredisplayedonCustomerprovidedequipment. 3.4.5.12 theoriginatinglineandthelinetobeansweredmustbeequippedwiththefeature. 3.4.5.14 Directed Call Pick-up with Barge In Allows the Customer to answer a call directed to another line,which has been answeredor isringingbyapresetaccesscodeandthetelephonenumberofthelinetobeanswered.Both theoriginatinglineandthelinetobeansweredmustbeequippedwiththefeature. 3.4.5.15 Distinctive Ring Alert Allows a Customerto receivean audible Call Waiting tone or Distinctive Ringing signal from alineequippedwithCallWaiting.If the called line is idle,a Distinctive Ringing signal will beheard.If the called line is busy,the called line will receive a Call Waiting tone. 3.4.5.16 Do Not Disturb Allows for calls to be acknowledgedwithout having the telephone ring.When the featureisactivated,callers hear a Customer-selected greeting indicating that the Customeris not available. 3.4.5.17 Hot Line Establishes a switched connection to a predeterminednumber when the Customer's telephonegoesoff-hook.No dialing is required and an incoming call is processed automatically to thepredeterminedtelephonenumber. 3.4.5.18 Hunting Basic Hunting -Availableto Customers with two or more individual line services,basic huntingallowsincomingcallstoaCustomer's busy line to overflow to lines that are not busy. Circular Hunt-A hunting patternthat starts at the dialed numberand continues in ascendingorderofthedesignatednumbersinthathuntgrouptothelastnumberinthegroup.If no idlenumberisreached,the hunt will proceedto the first numberof the designated hunt group andcontinuethroughthegroupuntilanidlelineisreachedoruntilreachingthenumberimmediatelyprecedingthedialednumber. Last Call Return Customers who do not wish to receiveblocked calls can activate AnonymousCallRejectionbypressing*77 (1177 on rotary telephones).The code to deactivateis *87 (1187onrotarytelephones).While the featureis activated,incoming blocked calls are routed to anannouncementinthecentraloffice.Anonymous Call Rejection is automatically available tobusinessCustomerswheretechnicallyfeasibleandtomonthly(subscription)Customers only. 3.4.5.20 Line Blocking Allows a Customerto permanently change the indicator from public to private preventing thedeliveryofhis/her name and/or telephonenumberto a subscriberof Caller Identification. 3.4.5.21 Priority Call Allows a Customerto assign a maximum of fifteen telephonenumbers to a special list forincomingcalls.The Customerwill hear a distinctive ring at his/her location when calls arereceivedfromtelephonenumbersonthatlist. 3.4.5.22 Speed Calling -8 and 30 Allows the Customerto call a preselected group of telephonenumbers by dialing I or 2 digitsratherthantheentiretelephonenumber.Speed Calling is available with an 8 or 30 telephonenumbercapacity.In order for Speed Calling to be provided to PBX Customers,all trunks must beequippedwithspeedcallingandhaveacommonnumberingplan. 3.4.5.23 Three-Way Calling Allows the Customerto call a preselected group of telephonenumbersby dialing 1 or 2 digitsratherthantheentiretelephonenumber.Speed Calling is available with an 8 or 30 telephonenumbercapacity.In order for Speed Calling to be provided to PBX Customers,all trunks must beequippedwithspeedcallingandhaveacommonnumberingplan. One DID Additivecharge applies for each DID-equipped trunk or DIDequipped channel or channelgroup. A Block CompromiseChargewill apply for each number a Customerwishes to remove from a reservedDIDblockofnumbers. 3.4.7 ISDN -Primary Rate Interface (ISDN-PRI) The basic PRI servicestructure consists of 23 B-channels and one Dchannel,or 24 B channels,for a totaltransmissionrateof1.544 Mbit/s,which is equivalentto a Tl facility.Each 64 Kbit/s B-channel carriesuserinformationsuchasvoicecalls,circuit-switched data,or video.The D-channel is a 64 Kbit/schannelthatisusedtocarrythecontrolorsignalinginformation. 3.4.7.l ISDN-PRI Configuration Options a)23 B +D:This service configuration provides for 23 B-channelsand 1 D-channel.TheB-channelscarry user information such as voice calls,circuit-switched data,or video,while theD-channel handles signaling information.When equipped,the D-channel can control a maximumof459B-channels.The B-channels may be provisioned on the same facility as the D-channel oronotherPRST1facilities. b)24 B:This service Places a call for a calling party who is identified as being disabled and is unable to dial the callbecauseofthatdisability. The access code for FGD switching is a uniform access code of the form I OXXX or lOIXYX.These uniform access codes will be the assigned access numbers of all FGD access provided to the Customer by the Company.No access code is required for calls to a Customerover FGD Switched Access Serviceif the End User's telephone service is arrangedfor pre-subscriptionto that Customer. Where no access code is required,the number dialed by the Customer's End User shall be a seven orten-digit number for calls in the North American Numbering Plan (NANP).For international calls outside the NANP,a seven to twelve-digit numbermay be dialed.The form of the numbers dialed by the Customer'sEnd User is NXX-XXXX,0,00,or 1 +NXX-XXX,NPA +NXX-XXX,0,00 or 1 +NPA + NXX-XXXX,and,when the end office is equippedfor International Direct Dialing,01 +CC NN or 011 +CC +NN. When the I OXXX or 10 1 XXX access code is used,FGD switching also provides for dialing the digit 0 or 00 for access to the Customer's operator,911 for access to emergency reporting service,or at the Customer'soption,the end-of-dialing digit (#)for cut-through access to the Customer's premises. A Customer may order 950 or FGD to activate a Customer'sdesignated 950XXY_Xaccess code.ThiswillallowtheCompanytodirectthosedesignated950-XXY-X calls dialed by the Customer's End Users to the Customer'saccess service.The Customermust be preparedto handle normally dialed FGD calls,as well as calls dialed with the designated 950-XXY-X access code which requires the Customerto receive additional address signaling.Such calls will be rated as FGD. 7.5 Ordering Procedures Ordering and provisioning procedures for the Company's Switched Access Serviceare as set forth in this price list. The Customer shall provide all information necessary for the Companyto provide and bill for the requested service including: (a)Customer name and premises address(es). (b)Billing name and address (when different from Customername and address). When placing an Access Order for service,the Customer shall specify,at a minimum:information for SwitchedTransport as describedin this price list.This information is inadditiontothebasicTrunksideSwitchedAccessServicearrangementinformation. 7.5.1.2 Trunk-side Switched Access Service For Trunkside Switched Access Service ordered in trunks,the Customer shall specify thenumberoftrunksandtheendofficewhenSwitchedTransportandLocalSwitchingoptionsaredesired.When ordering trunks to an access tandem or FGD trunks to aCustomer-providedtandem,the Customermust also provide the Companyan estimate oftheamountoftrafficitwillgeneratetoand/or from each end office subtendingthe access tandem or Customer-providedtandem to assist the Companyin its own efforts toprojectfurtherfacilityrequirements.In addition,the Customershall specify forterminatingaccess,whether the trunks are to be arrangedin trunk group arrangements orprovidedassingletrunks.The traffic type must also be specified using the same categories as described in this price list,to enable efficient provisioning and billingftinctions. When a Customerorders Switched Access Service in trunks,the Customer is responsible to assure that sufficient access facilities have been ordered to handle its traffic. 7.5.1.3 LIDB When the Customerorders LIDB,the Customermust specify the Originating Point Code(s)and Location Identification Code(s)that will access the Company's LIDB per access order. 7.5.1.4 FGD with SS7 When the Customerorders FGD Service with SS7 out of band signaling,the Customer must specify the CCSAC Service required betweenthe Customer's SPOI and the Company's STP location per access order. 7.5.2 Order Modifications The Customermay request a modification of its Access Order at any time prior to notification by the Companythat serviceis available for the Customer's use.The Companywill make every effort to accommodate a requested modification when it is able to do so with the normal work force assigned to completesuch an order within normal business hours. Any increase in the numberof Switched Access Servicefacilities or trunks will be treated as anewAccessOrder(for the increased amount only) 7.5.2.1 Design Change The Customermay request a design change to the serviceordered.A design change isanychangetoanAccessOrder,which requires engineeringreview.An engineeringreviewisareviewbyCompanypersonneloftheserviceorderedandtherequested changes to determinewhat change in the design,if any,is necessary to meet the changes requested by the Customer.Design changes include such things as a change of End User premises within the same serving wire center,the addition or deletion of optional features,functions,or a change in the type of Transport Termination (Switched Accessonly),type of channel interface,type of Interface Group or technical specification package. Design changes do not include a change of Customerpremises,End User premises to adifferentservingwirecenterorendofficeswitch.Changes of this nature will require the issuance of a new order and the cancellation of the original orderwith appropriatecancellationchargesapplied. The Company will review the requested change,notifythe Customerwhether the change is a design change,if it can be accommodatedand if a new servicedate is required.If theCustomerauthorizestheCompanytoproceedwiththedesignchange,a Design ChangeChargewillapply. A Design Change Charge will apply,on a per order,per occurrence basis.This chargewillalsoapplytochangeanincorrectaddressaslongasthenewaddressisinthesamewirecenterastheincorrectaddressandthechangeismadepriortotheissuanceoftheDesignLayoutReport(DLR).If a change of service date is required,the Service Date Change Chargewill apply.If the change of End User premises within the same servingwirecenterisrequested,Expedited Order Charges may also apply. 7.5.2.2 ServiceDate Change Access Order servicedates for the installation of new services or rearrangementsofexistingservicesmaybechanged.A ServiceDate Change Chargewill apply,on a perorderperoccurrencebasis,for each servicedate changed,pursuant to this price list. If the servicedate is changed to an earlier date,the Customerwill be notified by theCompanythatExpeditedOrderChargesassetforthinthispricelistwillapply.Such charges will apply in addition to the Service Date Change Charge. When,for any reason the Customerindicates that servicecannot be accepted on theservicedate,and the Companyaccordingly delays the start of service,a Service DateChangeChargewillapply.If the Customerrequested service date is more than 120calendardaysaftertheoriginalservicedate,the order will be canceled by the Company and reissued with the appropriatecancellation charges applied. 7.5.2.3 ExpeditedOrders A Customermay: a)When placing an Access Order for service(s),request a service date that is prior to the assigned service date. b)Request an earlier servicedate on a pending or negotiated Access Order, and c)Request a change of End User premises within the same serving wire center. If the Customerrequests an earlier servicedate and/ora change of End User premises within the same serving wire center,and the Company agrees to provide the service on an expeditedbasis,an Expedited Order Chargewill apply. When an expedited servicedate is missed,the Expedited Order Charge will apply unless the Companycauses the missed servicedate. If costs other than additional labor are to be incurred when an Access Order is expedited, the Companywill develop,determineand bill the Customerfor the additional costs. 7.6 Pre-subscription Pre-subscriptionis a procedurewhereby an End User or location provider may select and designateto theCompanyaninterexchangecarrier(s)to access,without dialing an access code for calls leaving the localserviceareaoftheCompany.The interexchangecarriers are referred to as the End User's or locationprovider's primary interexchangecarrier.The End User or location provider will be allowed to select aprimaryinterexchangecarrierforintraLATAcallsandaprimaryinterexchangecarrierforinterLATA calls. (b)End users or location providers that choose to change their primary interexchangecarrierwithinonemonthoftheeffectivedateoftheirnewservicewillnotbechargedforthechange. (c)Subsequent to a one-monthperiod followinginstallation of Local Exchange Service,foranychangeinselection,including a change from one access code to anotheraccess code for thesameinterexchangecarrier,a nonrecurring charge applies.The nonrecurring chargefor a primaryinterexchangecarrier(PIC)change is billed to the End User who is the subscriberto the LocalExchangeService.However,an interexchangecarrier may,at its option,may elect to pay thechargeforanyEndUserand/or location provider at any time.The nonrecurring charge for a PICchangeissetforthinthispricelist. 7.6.2 Dispute Application for Pre-subscription If the End User or location provider disputes a PIC change,the Companywill investigatetheoriginofthechangeandshallrestoretheEndUserorlocationprovidertotheirpreviousPIC.IfthechangewasduetoCompanyerror,the End User or location provider will be returned to theirpreviousprimaryinterexchangecarrierfreeofcharge.If the change was submitted by aninterexchangecarrier,and the interexchangecarrier is unable to produce the signed End User orlocationproviderLetterofAuthorization(LOA),the nonrecurring charges will be assessed to theunauthorizedinterexchangecarrier. If there is a conflict betweenan End User,a location provider,or their respectiveagent,on theonehand,and an interexchangecarrier on the other hand,over the designationof the primaryinterexchangecarrier,the Companywill honor the designationselected by the End User,locationproviderortheirrespectiveagent,regardless of any contractual obligations the End User,location provider or agent may havewith one or more interexchangecarriers. If there is a conflict betweenan End User and/or location provider,on the one hand,and theiragentontheotherhand,over the designationof the primary interexchangecarrier,the CompanywillhonorthedesignationselectedbytheEndUserand/or location provider,regardless of anycontractualobligationstheEndUserand/or location provider may have with one or moreinterexchangecarriersoragents. The Companywill bill the canceling interexchangecarrier the service ordercharge for each EndUserandlocationprovidertheinterexchangecarrierhaspre-designatedto it.Such charge willnotapplytothecancelinginterexchangecarrierwherethecancelinginterexchangecarriertransfersorassignsitsFGDservicesandtheassociatedIOXY-X or 10 1 XY X code to anotherinterexchangecarrierinsuchmannerthattheCompanydoesnotchangeEndUserorlocationproviderrecordsorEndUserand/or location provider PIC designation,or if anotherinterexchangecarrierelectstopaytheserviceorderchargeonbehalfofthecancelinginterexchangecarrier. 7.6.4 InterexchangeCarrier Initiated Conversionsfor Pre-subscription When an interexchangecarrier requests that their End User and/or location provider be changedfromoneaccesscodetoanotheraccesscodeonamassconversionbasis,e.g.,an interexchangecarrierusingtwoormorePICdesignationsoraninterexchangecarrierassumingownershipofanotherinterexchangecarrier's End Users and/orlocation providers etc.,charges as set forth inthispricelistshallapply. 7.7 Billing and Jurisdictional Reporting Requirements The following requirementsare in addition to the terms and conditions containedin the GeneralRegulationssectionofthispricelist. 7.7.1 Obligations of the Customer The Customermust indicate a projected Percent of Interstate Use (PIU)factor in a whole number(i.e.,1-100)when ordering SwitchedAccess Service.A Customer provided PIU factor isrequiredoneachAccessServiceRequest(ASR). Upon ordering terminating FGD Service,the Companywill developthe projected PIUfactoruntiltheCompanyreceivesaletterfromtheCustomer(by certified U.S.Mail return receipt requested)authorizing the Company to develop the projected PIU factorfromaCustomer-provided report. Customers who choose to provide a projected PIU factor for terminating FGD accessminutesshallsupplyapercentageinwholenumber(i.e.,a number0-100).The Companywilldesignatethenumberobtainedbysubtractingtheprojectedterminatinginterstate percentage from 100 as the projected terminating intrastate percentage of use.TheprojectedPIUfactorsuppliedbytheCustomerisusedbytheCompanytoapportion theterminatingusagebetweeninterstateandintrastateuntilarevisedreportisreceived. The Customer-providedPIU factor will be used until the Customerreports a differentprojectedPIUfactor.No prorating or back billing will be done based on the Jurisdictional Report. 7.7.1.2 Failure to Report When the Customerdoes not supply the quarterly reports,the Companywill follow theproceduressetoutinparagraphs(a)--(c). a)If the Customerdoes not supply the reports,the Company will assume the PIUfactorstobethesameasthoseprovidedinthelastreport.For those cases in which aquarterlyreporthasneverbeenreceivedfromtheCustomer,the Companywill assume the PIU factors to be the same as those provided in the order for service. b)Upon receipt of the Customer's work papers and summary,the Company willbeginusingthePlUfactorsderivedfromtheworkpapersandsummarywiththenextbillingperiodandwillreviewtheworkpapersandsummarysubmittedwithinthirty(30) days from receipt of the information. c)If after review of the information,it is determinedthat a billing dispute exists, the Company will continue to use the derived PlU factor and begin audit procedures. b)The time period coveredby the bill; c)Thedue date of the bill; d)Any amounts transferred from anotheraccount;e)Any amounts past due;f)Anypayments credits applied to the Customer's account since the last bill;g)The total amount due;h)Names of other entities,if any,for which the Customeris also being billed by CompanyforserviceswhicharenotprovidedbytheCompany,including,the identification of theservice(s)billed,and the amount(s)of those billings;i)The mailing address(es)or toll-free telephonenumber(s)availableto Customers in theserviceterritoryforansweringinquiriesabouttelephoneservicesbilled;j)An itemization of all non-recurring charges;k)An itemization of the following recurring charges:total local exchange service bill(mileage or zone charges and charges for extended area service may be included in the totalratherthanasseparateitems),touch tone capability,custom calling features,non-primarydirectorylistings,wire maintenanceplans,equipmentleases,and governmentally imposedtaxes,surcharges or subscriberline charges.All otherrecurring charges may be included in amiscellaneousbillingcategoryiftheCompanyexplainsthechargesinwritingpursuanttoIDAPA31.41.02101charges for each element of packaged services,local measured service,orothercallingplansinwhichindividualcallsarenotbilledneednotbeseparatelyitemizediftheCompanyprovidesanexplanationofthoseservicespursuanttoIDAPA31.41.02 10 l;and,l)For MTS bills,the number called,the date,time,duration,destination,and charge foreachcall.For collect and third party calls,the Company will itemize the origin of the call, 8.2.2 Billing Under InappropriateRates If a Customerwas billed underan inappropriaterate,the Companywill recalculate theCustomer's past billings and correctly calculate future billings based on the appropriate rate;except that the Company shall not be requiredto adjust billings when it has acted on good faithbaseduponavailableinformationorwhentheCustomerwasgivenwrittennoticeofoptionsundertheCompany'sserviceofferings and did not make a timely election to exercise theCustomer's options.A Customerhas been billed underan inappropriaterate if: a)the Customerwas billed under a rate for which the Customerwas not eligible;or b)The Customer,who is eligible for billing undermore than one rate,was billed under aratecontrarytotheCustomer's election,or the election was made based upon erroneousinformationprovidedbytheCompany. 8.2.3 Customers With Good Credit -Final Bills Issued:September 20,2002 Effiective:September ,2002 Jon M.Hesse,President BridgeBand Communications,Inc. 514 S.23rd AVOUDC Bozeman,Montana 59718 IirÏÌgeBandC6mn unÏc tÏor In rc o Page 62 When Customerwith good credit voluntarilyterminates service with the Company,the final billshallcontainorbeaccompaniedbyastatementthattheCustomerhadgoodcreditwiththeCompanyuponthedatethestatementwasissued.When an applicant for servicepresents such astatementtoalocalexchangeCompany(whether from one regulated by the Commissionorotherwise),the statement constitutes evidenceof good credit in the application for service.However,presentation of such a statement will not require the Companyto consider theapplicanttohavegoodcreditsolelyonthebasisofthatstatement. 8.3 Complaints 8.3.1 Conference Upon receiving a complaint or request for conference,the Companyshall promptly,thoroughlyandcompletelyinvestigatethecomplaint,confer with the Customeror applicant when requested,and notify the Customeror applicant of the results of its investigation and make a good faithattempttoresolvethecomplaint.The oral or written notification shall advise the CustomerorapplicantthattheCustomerorapplicantmayrequesttheCommissiontoreviewtheCompany'sproposeddispositionofthecomplaint. 8.3.2 Record of Complaints The Companyshall keep a record of written complaints and requests for conferences pursuant toIDAPA31.41.01.401 and 402.Theserecords shall be retainedfor a minimum of one year atofficeoftheCompanywherethecomplaintswerereceivedorwhereconferenceswereheld.TherecordsshallbereadilyavailableuponrequestbythecomplainingCustomerorapplicant,theCustomerorapplicant's agent possessing written authorization,or the Commission.The recordsmustnotewhethertheCustomerwasadvisedasrequiredbypursuanttoIDAPA31.41.01.401.03thattheCustomerorapplicantmayrequesttheCommissiontoreviewtheCompany'sproposeddispositionofthecomplaint. When directed by the Commission,the Companyshall submit a report to the Commission thatstatesandclassifiesthenumberofcomplaintsmadetotheCompanypursuanttoIDAPA31.41.01.401and 40,and the general subject matter of the complaints. 8.4 ServiceOutages 8.4.1 Definition Service Outage -when a Customer'slocal telephoneservicequalitydeteriorates to such an extentthattheCustomercannotmakelocalcallsorcannotreceivelocalcallsorcannotusetheserviceforvoicegradecommunicationbecauseofcross-talk,static,or other transmission problems,theCompanywillrespondtoaCustomer'sreport of as a l lservice outage"and proceed inaccordancewiththissection. 8.4.2 Receipt and Recording of Reports Issued:September 20,2002 Effiective:September ,2002 Jon M.Hesse,President BridgeBand Communications,Inc. 514 S.23rd Bozeman,Montana 59718 ho Pr e Page 63 The Company shall provide for the receipt of Customertrouble reports at all hours and make afullandpromptinvestigationofanresponsetoallreports.The Companyshall maintain anaccuraterecordoftroublereportsmadebyitsCustomers.The record shall include accurateidentificationoftheCustomerorserviceaffected,the time,date,and nature of the report,theactiontakentoclearthetroubleorsatisfytheCustomer,and the time of trouble clearance orotherdisposition.The record shall be available to the Commission or its authorizedrepresentativesuponrequestatanytimewithinfiveyearsofthedateofarecord. 8.4.3 _Repair Service Standards When informed by a Customerof a serviceoutage as defined by subsection 9.4.1 of this sectiontheCompanyshall: a)Restoreservice within sixteen (16)hours after the report of the outage if the CustomernotifiestheCompanythattheserviceoutagecreatesanemergencyfortheCustomer;or b)Restore service within twenty-four (24)hours after the report of the outage if noemergencyexists,except that outages reportedbetween noon on Saturday and 6:00 p.m.on thefollowingMonday,whichever is sooner. 8.4.4 Failure to Restore Servicein a Timely Manner The Company shall notify the Customerof unavoidablechanges in the agreed repair schedule;however,if the Company does not restore service within the times set out by this subsection 9.4.3ofthissection,the Company shall credit the Customer's account for an amount equal to themonthlyrateforone(1)month of basic local exchange service,unless: a)The Customerfails to keep an appointmentwith the Company that was agreed tobetweentheCompanyandtheCustomerwhentheoriginalcommitmentwasmade; b)The disruption of telephone servicewas caused by natural disaster or other causes notwithintheCompany'scontrol affecting large groups of Customers; c)Conditions exist wherethe personalsafety of a repair technician would be jeopardizedandtheCompanyhasusedreasonablejudgmentanddiligencetorestoreservice,giving dueregardfortheneedsofvariousCustomersandtherequirementsofthetelecommunicationsservicepriorityprogramorderinFCCDocket88-341 (a47 D.F.R.Part 64,Appendix A); d)The Customer causes the Customer's own outage; e)The Customer does not make a reasonable effort to arrange a repair visit within theservicerestorationdeadline;or, Issued:S 20,2002 ective:September ,2002 Jon M.Hesse,President BridgeBand Communications,Inc. 5 14 S.23rd Aveune Bozeman,Montana 59718 BridgeBand Communications,Inc.Idaho Price List No.I Page 64 f)The Company determines that the outage is attributable to the Customer's own equipmentorinsidewire. 8.5 Rate Information The Company shall transmit annually to each Customerwith less than six lines and give to each suchnewCustomeratthetimeofinitiationoflocalexchangeserviceaclearandconcisewrittenexplanationofalltheservicestowhichtheCustomersubscribesandthechargesforthoseservices. 8.5.1 Customer Notice of Rate Change Proposed bv the Company If the Company applise for a rate change for any serviceregulated by the Commission underthePublicUtilitiesLaw(Chapters 1 through 7,Title 61,Idaho Code)provided to any Customerwithlessthansixlines,it shall give to each such Customera statement (Customernotice)announcingtheapplication,and the amount of any rate increase noticed by the application.The notice shallbeclearthattheapplicationisaproposal,subject to public review and a Commission decision.ItshallalsoinformCustomersthatacopyoftheCompany's application is available for publicreviewattheofficesofboththeCommissionandtheCompany. 8.5.2 Distribution of CustomerNotices The Customernotices referred to in subsection 9.5.1 of this section may be mailed to CustomersasbillinsertsoverthecourseofabillingcycleormaybecontainedinadditionalcommentpagestotheCustomer's monthly bill.If additional comment pages are used,the information required bytheserulesshallbeclearlyidentified,easily understood,and pertain only to the proposed ratechange. 8.6 Directories and Customer Listmgs The Company will provide customer directory listings to the incumbentlocal exchange company forpublication. 8.7 ServiceTermination Unless otherwise provided by this price list or as required by the Commission or other local,state,orfederalauthorities,the Companywill not terminateserviceto a Customeruntil a minimum of twenty-four(24)hours after notice or a diligent attempt to notify the Customer 8.7.1 Seven-DayNotice Except as otherwise provided under the provisions of IDAPA 31.41.01.303.04and 31.41.01.305,the Company will mail to the Customer written notice of termination at least seven (7)calendardaysbeforetheproposeddateoftermination.The written notice will contain the informationrequiredbyIDAPA31.41.01.306.
