FOR A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY TO PROVIDE LOCAL EXCHANGE SERVICES IN IDAHO. ) ) ) ) ) ) CASE NO. GNR-T-02-8 ORDER NO. 29091 On May 2, 2002, BasicPhone, Inc. filed an Application for a Certificate of Public Convenience and Necessity (“CPCN”) to provide local residential and business dial tone on a prepaid basis in Idaho. On July 3, 2002, the Commission approved BasicPhone’s Application and required the Company to post a bond in the amount of $5,000 as a condition for issuance of its CPCN. Order No. 29067. On July 28, 2002, BasicPhone filed a timely Petition for Reconsideration. After review of BasicPhone’s filing and the record in this case we shall grant the Company’s Petition for Reconsideration. As a result we shall not require BasicPhone to post a bond as a condition for issuance of its CPCN. Commission Order No. 29067 shall be modified consistent with our decision. Accordingly, BasicPhone’s CPCN shall be issued without further delay. O R D E R IT IS HEREBY ORDERED that BasicPhone’s Petition for Reconsideration is granted. Accordingly, the Company shall not be required to post a $5,000 bond as a condition for issuance of its CPCN. THIS IS A FINAL ORDER ON RECONSIDERATION.  Any party aggrieved by this Order or other final or interlocutory Orders previously issued in this Case No. GNR-T-02-8 may appeal to the Supreme Court of Idaho pursuant to the Public Utilities Law and the Idaho Appellate Rules.  See Idaho Code §§ 61-627 and 62-619.
