HomeMy WebLinkAbout29084.docBEFORE THE IDAHO PUBLIC UTILITIES COMMISSION IN THE MATTER OF WESTCOM LLC’S APPLICATION FOR APPROVAL OF A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY. ) ) ) ) ) CASE NO. GNR-T-02-6 ORDER NO. 29084 On March 29, 2002, an application for a Certificate of Public Convenience and Necessity to provide basic local exchange service was filed by Westcom, LLC, doing business as Digital Easy Chair. Westcom’s Application states that it plans to offer facilities-based local exchange services, intra-exchange private lines, frame relay services, and ISDN services to subdivision residents over a fiber optic network. Westcom is a limited liability company organized in the State of Idaho, and plans to provide its services to customers throughout Qwest’s southern Idaho service area. On May 21, 2002, the Commission issued a Notice of Application and Notice of Modified Procedure to process Westcom’s Application. Staff reviewed Westcom’s Application and supporting documentation and filed written comments recommending approval of its Application. Westcom has satisfied the Commission’s application requirements and also avers that it will comply with all relevant Commission rules. Although Westcom is a new company, the financial information submitted by the Company indicates that it has a positive net income for 2001 and thus far in 2002. The Company also has established an escrow account with a local bank in the event that customer deposits are required. The Commission finds that Westcom has satisfied all the requirements of the Commission’s rules and Procedural Order No. 26665 setting forth the requirements for an application for a Certificate of Public Convenience and Necessity. It is therefore appropriate for the Commission to approve the Application of Westcom. O R D E R IT IS HEREBY ORDERED that the Application of Westcom, LLC dba Digital Easy Chair for a Certificate of Public Convenience and Necessity is granted to enable Westcom to provide basic local exchange service in the area of southern Idaho served by Qwest Communications. THIS IS A FINAL ORDER. Any person interested in this Order (or in issues finally decided by this Order) or in interlocutory Orders previously issued in this Case No. GNR-T-02-6 may petition for reconsideration within twenty-one (21) days of the service date of this order with regard to any matter decided in this Order or in interlocutory Orders previously issued in this Case No. GNR-T026. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code § 61-626.
