GNR-01- ORDER NO. 30795 On April 22, 2009, the Commission received a letter from Tel West Communications LLC requesting withdrawal of its Certificate of Public Convenience and Necessity (CPCN) No. 410 issued by the Commission on April 17, 2003, in Order No. 29221. Tel West stated it has no current customers in Idaho and has discontinued service with no future plans to provide service within Idaho. Tel West further requested any existing price sheet or tariff on file be removed. In its Decision Meeting on May 4, 2009, the Commission approved Tel West's request for cancellation of Certificate No. 410. COMMISSION FINDINGS In December 2001 , Tel West Communications, LLC filed an Application with the Commission requesting authority to provide telecommunications services within the State ofidaho. In April 2003, the Commission granted Tel West's Application for a CPCN to provide telecommunications services within Idaho. Order No. 29221. On April 22, 2009, Tel West requested cancellation of its Certificate and stated that it does not currently provide local exchange services to any customers within Idaho. Accordingly, no customers will be affected by cancellation of Tel West's Certificate. Staff recommended the Commission cancel Certificate No. 410 and remove the Company s price list or tariff on file. ORDER IT IS HEREBY ORDERED that Tel West Communications, LLC's request for cancellation of Certificate of Public Convenience and Necessity No. 410 is granted. Certificate No. 410 is no longer in effect, and Tel West is no longer authorized to provide services in the State of Idaho. THIS IS A FINAL ORDER. Any person interested in this Order or in interlocutory Orders previously issued in this case may petition for reconsideration within twenty-one (21) days of the service date of this Order with regard to any matter decided in this Order or in interlocutory ORDER NO. 30795 Orders previously issued in this case. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code 9 9 61-619 and 61-626.
