(NOS) filed an application with the Idaho Public Utilities Commission for a Certificate of Public Convenience and Necessity on March 28, 2001. Since that date, the Telecommunications Staff at the Commission has worked with the Company to revise its proposed tariffs to comply with Commission requirements. In addition, the Staff has asked for a Company response to numerous customer complaints to ensure NOS is capable of complying with the Commission’s Customer Service Rules. Despite fairly lengthy communications to the Company regarding these issues, NOS has not responded to most of the requests for information. For example, correspondence was provided to Andrea Edmonds of Kelley Drye on November 6, 2001, requesting a response from the Company no later than January 6, 2002. The Company did not respond at all to that request for information. Because NOS has not responded to Staff’s request for information, it is not possible to complete the application and present it to the Commission for approval of NOS’s Certificate of Public Convenience and Necessity. Staff intends to present on the Commission’s March 25, 2002, decision meeting a recommendation that NOS’s application be dismissed. Please contact me or the Telecommunications Staff at the Commission with appropriate information no later than March 21, 2002, to avoid dismissal of NOS’s application. If Staff does not hear from NOS by then, the Staff will recommend that the Commission dismiss NOS’s application on March 25, 2002. Please contact me if you have any questions. Sincerely, Weldon B.
