On March 26, 2001, SCC Communications Corporation (SCC) filed an Application for a Certificate of Public Convenience and Necessity to provide local exchange telecommunications services within the state of Idaho. On April 13, 2001, the Commission issued a Notice of Application and Modified Procedure requesting interested persons file written comments regarding the Application. Order No. 28701. Only the Commission Staff filed comments and it supported the issuance of the Certificate. Based upon our review of the Application and the Staff’s comments, the Commission grants SCC’s Application.
THE APPLICATION
SCC is a publicly traded company headquartered in Boulder, Colorado. The Company asserts that it is a leading provider of 911 data management services to the telecommunications industry. In its Application SCC states that it manages data records for almost 100 million telecommunications subscribers in 28 states and processes over 140,000 orders per day. SCC also claims to be authorized to provide telecommunications service in 10 states, with applications pending in 17 states.
SCC states that it intends to provide facilities-based and resold local exchange and intrastate, interexchange two-way voice and data telecommunication services in Idaho to incumbent and competitive local exchange providers, wireless providers, telematics service providers, residence and business customers, and to public safety agencies. The Company requests specific authority to provide 911 Safety Net( service throughout Idaho, including the service areas of the small independent telephone companies. While SCC proposes to terminate emergency calls in areas of small independent telephone companies, SCC does not intend to offer dial tone local exchange service and traditional long distance toll services within or between small independent telephone company exchange areas.
SCC stated that it would comply with all applicable Commission rules and requirements. The Company requested that the Commission grant it an exemption from Commission requirements to report and remit fees to the Universal Service or Telecommunications Relay Service Funds.
STAFF COMMENTS
Staff reviewed SCC’s Application and concluded SCC understands the Commission’s rules and requirements. SCC included with its Application an illustrative tariff that demonstrated an understanding of Commission tariff requirements and processes. The Company has over 20 years of experience providing its services and Staff believes the Application demonstrates the technical expertise to provide the services identified.
Staff recommended that the Commission approve SCC’s Application for a Certificate of Public Convenience and Necessity but does not agree with the Company’s request for waivers from the requirements to report and remit required fees to the Universal Service and Telecommunications Relay Services Funds. The fact that SCC will be leasing facilities from incumbent local exchange carriers is not sufficient to warrant a waiver from these requirements.
COMMISSION FINDINGS
Based on the Commission’s review of the record and Staff’s comments, the Commission finds that SCC’s Application complies with the Commission’s Rules to obtain a Certificate of Public Convenience and Necessity. The Commission therefore approves SCC’s Application for a Certificate to provide local exchange service within the state of Idaho. The Commission denies SCC’s request for a waiver from Commission requirements to report and remit fees to the Universal Service or Telecommunications Relay Service Funds.
O R D E R
IT IS HEREBY ORDERED that SCC Communications Corporation is granted a Certificate of Public Convenience and Necessity to provide local telecommunications service within the state of Idaho subject to the provisions of Section 251 (f) of the federal Telecommunications Act.
IT IS FURTHER ORDERED that SCC Communications Corporation’s request for an exemption from the Commission’s requirements to report and remit fees to the Universal Service and Telecommunications Relay Services Funds is denied.
THIS IS A FINAL ORDER. Any person interested in this Order or in interlocutory Orders previously issued in this Case No. GNR-T-01-5 may petition for reconsideration within twenty-one (21) days of the service date of this Order with regard to any matter decided in this Order or in interlocutory Orders previously issued in this Case No. GNR-T-01-5. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code ( 61626 and 62-618.
